Warrant vesting Control of Portion of Seccombe’s Road
in the Epsom Road Board, and apportioning the Cost
of Maintenance of the Same.

ISLINGTON, Governor.

WHEREAS by section twelve of the Public Works
Amendment Act, 1909 (hereinafter termed “the
said Act”), it is provided that where a road or street
lies along the boundary of two or more districts, whether
that road or street is wholly within one or is partly within
one and is partly within another of those districts, or is
within none of those districts, the Governor may from
time to time, by Warrant under his hand gazetted, direct
which of the local authorities of those districts shall have
control of the road or street, or any part thereof, and also
may in like manner determine from time to time whether
any of those local authorities shall contribute to the cost of
the construction or maintenance of that road or street, and,
if so, in what proportions: And whereas the portion of
road known as Seccombe’s Road described in the Schedule
hereto, and hereinafter termed “the said portion of road,”
forms the boundary between the Epsom Road District and
the Borough of Newmarket:

And whereas a dispute has arisen as to which local
authority should have control of the said portion of road,
and what proportion of the cost of constructing and main-
taining the said portion of road should be borne by the
local authorities affected:

And whereas an inquiry was duly held and a report was
made in respect to the matter:

And whereas it is expedient that effect should be given
to the recommendations contained in the said report, and
that provision should be made for the purposes and in the
manner hereinafter set forth:

Now, therefore, I, John Poynder, Dickson-Poynder,
Baron Islington, the Governor of the Dominion of New
Zealand, in pursuance and exercise of the power and
authority vested in me by the said Act, and of all other
powers and authorities in anywise enabling me in this
behalf, do hereby direct that, from and after the date of
this Warrant, the portion of road described in the Schedule
hereto (other than the footpaths, channelling, and kerbing
on the sides of the said portion of road) shall be under the
control of the Epsom Road Board; and, in further pur-
suance of the aforesaid powers and authorities, I do hereby
fix and determine that the cost of constructing, maintain-
ing, and lighting the said portion of road shall be borne in
the following proportions—viz., the Epsom Road Board to
bear half of such cost and the Newmarket Borough Council
to bear half of such cost respectively, and that the Epsom
Road Board and the Newmarket Borough Council shall
each control, construct, and maintain at its own expense
the footpath, channelling, and kerbing on its own side of
the said portion of road.

And I do also further direct that any contribution
hereby required to be made as aforesaid by the New-
market Borough Council shall be paid from time to time,
in the proportion hereinbefore prescribed, out of the funds
of the said Borough Council, within a period of thirty
days after demand in writing made by or on behalf of the
Epsom Road Board, and that such payment shall be made
from time to time to the Clerk of the Epsom Road Board
for and on account of the Newmarket Borough Council.

SCHEDULE.

ALL that portion of road in the Auckland Land District,
known as Seccombe’s Road, situated on the boundary
between the Epsom Road District and the Newmarket
Borough; as the said portion of road is more particularly
delineated on the plan marked P.W.D. 30698, deposited in
the office of the Minister of Public Works, at Wellington,
in the Wellington Provincial District, and thereon coloured
blue and lettered A B.

As witness the hand of His Excellency the Governor,
this twenty-first day of March, one thousand
nine hundred and twelve.

the Mount Eden Borough and Mount Roskill Road
Board, and apportioning the Cost of the Maintenance
of the Same.

WHEREAS by section twelve of the Public Works
Amendment Act, 1909 (hereinafter termed “the
said Act”), it is provided that where a road or street
lies along the boundary of two or more districts, whether
that road or street lies wholly within one or is partly
within one and is partly within another of those districts,
or is within none of those districts, the Governor may from

Roskill Road Board; and, in further pursuance and exer-
cise of the aforesaid powers and authorities, I do hereby
fix and determine that the cost of forming, metalling, and
maintaining the portion of road firstly described in the
Schedule hereto shall be borne by the Mount Eden Borough
Council, and that the formation, metalling, and mainten-
ance of the portion of road secondly described in the
Schedule hereto shall be borne by the Mount Roskill Road
Board. And I do hereby further direct that such forma-
tion and metalling shall in both cases be eighteen feet
wide, and that the work shall be done by the above local
authorities respectively within twelve months from the
thirty-first day of March, one thousand nine hundred and
twelve.

FIRST SCHEDULE.

ALL that portion of road in the Auckland Land District
situated on the boundary between the Mount Roskill Road
District and the Borough of Mount Eden, known as Stony
or Boundary Road, commencing at its junction with Mount
Roskill Road (also known as Dominion Road), and running
in an easterly direction to the centre-line of Love’s Lane,
being a distance of 28 chains or thereabouts.

SECOND SCHEDULE.

Also all that portion of road in the said land district,
and situated on the boundary between the Mount Roskill
Road District and Borough of Mount Eden, commencing
at the centre-line of Love’s Lane and proceeding in an
easterly direction to its junction with Three Kings Road,
being a distance of 28 chains or thereabouts.

As the said portions of road are more particularly deline-
ated on the plan marked P.W.D. 30824, deposited in the
office of the Minister of Public Works, at Wellington, in
the Wellington Provincial District, and thereon coloured
red, and lettered M N and N O respectively.

As witness the hand of His Excellency the Governor,
this twenty-first day of March, one thousand
nine hundred and twelve.

ISLINGTON, Governor.

WHEREAS by section eleven of the Scenery Pre-
servation Amendment Act, 1910, it is enacted that
it shall be lawful for the Governor, whenever he deems
it expedient for the purposes of scenery-preservation, to
grant in fee-simple any area of Crown land in exchange
