for the fee-simple of any other land which in his opinion is of approximately equal value, and that such exchange may be made under the provisions of section one hundred and forty-two of the Land Act, 1908 :
And whereas, in the opinion of the Governor, it is expedient to exchange the Crown land described in the First Schedule hereto for the land described in the Second Schedule, and the owner of the land described in the Second Schedule has agreed to such exchange :
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in exercise of the aforesaid powers and authorities, doth hereby declare that it is his intention to grant in fee-simple the area of Crown land described in the First Schedule hereto in exchange for the fee-simple of the area of the land described in the Second Schedule.
FIRST SCHEDULE.
DESCRIPTION OF CROWN LAND AUTHORIZED TO BE EXCHANGED.
All that area in the Southland Land District, containing by admeasurement 8 acres 2 roods 28 perches, more or less, being Section No. 17, Block 1, Lillburn Survey District. Bounded towards the north by a road along the bank of the Waiau River, 434 links, 486·3 links, 642·1 links, and 191·6 links; towards the south-east by a public road, 1022·5 links; and towards the south-west by Section No. 3, in the said block, 1382·9 links : be all the aforesaid linkages more or less : as the same is delineated on the plan marked L. 23/3, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered green.
SECOND SCHEDULE.
DESCRIPTION OF LAND TO BE OBTAINED IN EXCHANGE THEREFOR.
All that area in the Southland Land District, containing by admeasurement 17 acres and 30 perches, more or less, being part of Section No. 1, Block 1, Lillburn Survey District. Bounded towards the north-east by other part of said Section No. 1, 1521·8 links; towards the south-east by a public road, 1163·7 links; towards the south-west by Section No. 14, in the said block, 1189 links; and towards the west and north-west by other part of said Section No. 1, 132·6 links, 131·9 links, 294·1 links, 435·2 links, and 491·8 links : be all the aforesaid linkages more or less : as the same is delineated on the plan marked L. 23/3, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.
