And whereas subsection two of that section further en-
acts that, save with the precedent consent of the Governor
in Council, leave to appeal shall not be granted by the
Chief Judge under this section unless application for same
is made within five years after the making of the order
appealed from :

And whereas application has been made to the Chief
Judge of the Native Land Court to grant leave to appeal
against the decision of the Native Land Court, dated the
fourteenth day of April, one thousand nine hundred and
four, in respect of the succession to the interests of Tai-
mona Pita, deceased, in Kokohuia Block : And whereas it
is expedient that such leave to appeal should be granted :

Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and exercise of
the power and authority conferred upon him by subsection
two of section fifty of the Native Land Act, 1909, and
acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby consent to the
Chief Judge granting the applicant leave to appeal as
aforesaid. And it is hereby declared that this Order in
Council is made under the provisions in that behalf of the
Native Land Act, 1909, and shall operate accordingly as
a consent of the Governor in Council to the proceedings
hereby authorized.

Exempting a Native from the Provisions of the Native
Land Act, 1909, with respect to Landless Natives, and
consenting to the Confirmation of an Alienation by the
Maori Land Board.


ISLINGTON, Governor.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-
fifth day of March, 1912.

Present :

THE RIGHT HONOURABLE SIR J. G. WARD, BART.,
RESIDING IN COUNCIL.

WHEREAS by section four hundred and twenty-five
of the Native Land Act, 1909, it is enacted that—

  1. The Governor may by Order in Council, in any case
    in which he thinks it expedient so to do, consent to the
    confirmation of any alienation, or to the confirmation of
    any resolution of assembled owners, or to any purchase by
    the Native Land Purchase Board, or to any exchange of
    Native land, notwithstanding the fact that any Native
    may thereby become landless within the meaning of this
    Act; and thereupon the said confirmation, purchase, or
    exchange may take place and shall have effect in the same
    manner as if that Native retained Native freehold land
    sufficient for his adequate maintenance :

  2. No such consent shall be given except on the recom-
    mendation of the Native Land Court or the Maori Land
    Board of the district in which the land is situated :

  3. No such consent shall be given unless the Governor
    is satisfied that the Native is able to maintain himself
    by his own means or labour, and that the transaction con-
    sented to is not contrary to the public interest :

And whereas, to enable confirmation of a sale of Otoro-
hanga 1B Section 1 Block by Kiti Paiaka, the Waikato-
Maniapoto District Maori Land Board recommends that
such consent shall be given : And whereas it is expedient
so to do :

Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council thereof, doth hereby
consent to the confirmation of the aforesaid sale, notwith-
standing the fact that the Natives may thereby become
landless within the meaning of the said Act. And it is
hereby declared that this Order in Council is made under
the provisions in that behalf of the Native Land Act,
1909, and shall operate accordingly as a consent of the
Governor in Council to the proceedings hereby authorized.

Regulations for Deer-shooting, Wairca.


ISLINGTON, Governor.

IN exercise of the powers vested in me by the Animals
Protection Act, 1908 (hereinafter called “the said
Act”), I, John Poynder Dickson-Poynder, Baron Isling-
ton, the Governor of the Dominion of New Zealand, do
hereby make the following regulations prescribing the
deer-shooting season in that part of the Rotorua Acclimatization
District comprised in the part of the County of Wairoa
(excluding therefrom the Mahia Peninsula) which is in
the said acclimatization district, and the conditions affect-
ing the same, and also the form of license and the fee
payable therefor.


REGULATIONS.

  1. RED-DEER stags may be taken or killed within the above-
    mentioned part of the Rotorua Acclimatization District
    from the 10th April, 1912, to the 30th April, 1912 (both
    days inclusive).

  2. Licenses to take or kill such deer may be issued by
    the Postmaster at Wairoa, on payment of a license fee
    of £3, in the form prescribed in the Schedule hereto, and
    subject to the said Act and these regulations. The num-
    ber of such licenses shall not exceed five. Provided that
    not more than one such license shall be issued to the same
    person.

  3. No licensee shall take or kill more than two stags, and
    no stag shall be killed carrying antlers with less than ten
    points.

  4. No hind or fawn shall be taken or killed on any pre-
    text whatever; and no licensee shall allow any dog to
    accompany either himself or any attendant he may have
    with him.

  5. Nothing herein contained shall extend to authorizing
    any person to sell any deer or portion thereof.

  6. Any person committing a breach of any of these regu-
    lations shall be liable, on conviction, to a fine not exceed-
    ing £20.

deer stags, of not less than ten points, within that part of

visions of the Animals Protection Act, 1908, and all regu-
lations thereunder in force within the said district.
