Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by section one hundred and twenty-one of the Local Bodies' Loans Act, 1908, and section seven of the Local Bodies' Loans Amendment Act, 1910, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the said public notification and the said poll shall be valid and effectual to all intents and purposes as though the same had been properly published or taken as required by the before-mentioned Acts, and that the proceedings in connection with the said loan shall not be called in question by reason only of the irregularities aforesaid.

Validating Proceedings in connection with a Loan of £4,000 proposed to be raised by the Taihape Borough Council.

At the Government Buildings, at Wellington, this nineteenth day of March, 1912.

WHEREAS the Taihape Borough Council did, on the tenth day of January, one thousand nine hundred and twelve, take a poll of the ratepayers of the Taihape Water-supply Special-rating District on the proposal to borrow the sum of four thousand pounds, under the provisions of the New Zealand State-guaranteed Advances Act, 1909, for the purpose of completing the waterworks in such special-rating district: And whereas the voting-paper used at the said poll was made out in the form prescribed by the Local Elections and Polls Act, 1908, instead of form 1 in the Second Schedule to the Local Bodies' Loans Act, 1908: And whereas it appears that the ratepayers have not been misled by such irregularity, and it is expedient to validate the same:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by section one hundred and twenty-one of the Local Bodies' Loans Act, 1908, and section seven of the Local Bodies' Loans Amendment Act, 1910, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the said poll shall be and be deemed to have been as good and effectual as if the voting-papers used at such poll had been in the form given in the Second Schedule to the Local Bodies' Loans Act, 1908, and that the proceedings relative to such loan of four thousand pounds shall not be called in question by reason only of the irregularity aforesaid.

Vesting a Gravel Reserve in the Featherston County Council.

ISLINGTON, Governor.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this nineteenth day of March, 1912.

PRESIDING IN COUNCIL.

WHEREAS the land described in the Schedule hereto has been permanently reserved for gravel purposes: And whereas, in the opinion of the Governor, it is expedient to vest the said reserve in the Featherston County Council:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by the fourth section of the Public Reserves and Domains Act, 1908, doth hereby declare that, from and after the day of the date hereof, the reserve described in the Schedule hereto shall become vested in the Chairman, Councillors, and Inhabitants of the Featherston County, in trust, for gravel purposes.


SCHEDULE.

ALL that area in the Wellington Land District, containing by admeasurement 1 acre, more or less, being Section No. 8A, Block XIII, Huangarua Survey District. Bounded towards the south-west, north-west, and north-east by Section No. 8 of said block, a distance of 316·2 links in each case, and towards the south-east by Awhea Road, 316·2 links; be all the aforesaid linkages more or less; as the same is delineated on the plan marked L. 1911/1580, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

Withdrawing Land from the Operation of the Kauri-gum Industry Acts.

ISLINGTON, Governor.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this nineteenth day of March, 1912.

Present:

PRESIDING IN COUNCIL.

WHEREAS by section thirty-three of the Kauri-gum Industry Act, 1908 (hereinafter termed “the said Act”), it is enacted that the Governor may by Order in Council declare that land set apart under the said Act as a kauri-gum reserve, and which is no longer required for the purpose of gum-digging, shall be no longer subject to the said Act, and thereupon the land shall cease to be a kauri-gum reserve, and shall be dealt with by the Land Board as ordinary Crown land; provided that such Order in Council shall only be issued in pursuance of a resolution of the Land Board, supported by such independent evidence as the Governor in Council deems necessary:

And whereas the Land Board of the Auckland Land District passed a resolution recommending that the portion of Te Mata Kauri-gum Reserve Extension No. 2 described in the Schedule hereto be declared to be no longer subject to the said Act, and such resolution was duly gazetted and publicly notified in accordance with section nine of the Kauri-gum Industry Amendment Act, 1910: And whereas no objection has been received to the said proposal:

Now, therefore, I, John Poynder Dickson-Poynder, Baron Islington, the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon me by section thirty-three of the Kauri-gum Industry Act, 1908, and section nine of the Kauri-gum Industry Amendment Act, 1910, and acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the portion of Te Mata Kauri-gum Reserve Extension No. 2 described in the Schedule hereto shall be no longer subject to the provisions of the Acts aforesaid.


SCHEDULE.

ALL that area in the Auckland Land District, containing by admeasurement 57 acres and 9 perches, more or less, being Section 26 and part Section 15, Block VI, Hukerenui Survey District, and forming part of Te Mata Kauri-gum Reserve Extension No. 2, set apart by Order in Council dated 21st August, 1899, and published in Gazette of 24th August, 1899, page 1555. Bounded towards the north-east generally by a public road, 212·4, 831·5, 706·5, and 721·4 links; towards the east by Section 24, Block VI, Hukerenui Survey District, 2228·1 links; towards the south by part Section 15 and Section 32 of Block VI aforesaid, 2268·8 links; and towards the west by Section 23, Block VI aforesaid, 2781·6 links: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. 5525/3, deposited in the Head Office, Department of Lands, at Wellington, and thereon edged red.
