receipt for the sum paid in, together with a memorandum of particulars relating thereto.

Moneys received from defaulter to be paid to Board’s account.

  1. All moneys received by the Government from any defaulter shall be paid to the credit of the Civil Service Officers’ Guarantee Account as aforesaid, and the Chairman of the Board shall be duly notified of the particulars of such payment; but if recovered before any calls have been made in respect of the defalcation the claim of the Government on the assurers shall be reduced by the amount of the moneys so recovered, and such moneys shall not be paid to the credit of the bank account as aforesaid; but if recovered after the call shall have been made, then the moneys so recovered shall remain at the credit of the Civil Service Officers’ Guarantee Account, and shall be applied in reduction of the amount to be made good in respect of the next subsequent defalcation.

Excess of assessment to be applied in reduction of subsequent defalcation.

  1. In case there shall be any balance remaining after making good the amount of defalcation as aforesaid such balance shall remain at credit of the Civil Service Officers’ Guarantee Account, and shall be applied in reduction of the amount to be made good in respect of the next subsequent defalcation.

Board’s accounts. Audit of same.

  1. The Board shall keep proper accounts of all sums received and paid by it; and an abstract of such accounts, signed by the Chairman, and supported by appropriate vouchers, shall be transmitted during the month of April in each year for examination by the Controller and Auditor-General, who shall return the same with such remarks as he may think necessary.

Confidential reports.

  1. The Board may receive and consider confidential reports and communications on matters which concern the integrity of any officer, and act therein as may seem expedient.

To whom Regulations apply.

Exemptions.

  1. These regulations shall apply to every officer in the Civil Service of the Dominion within the meaning of any Act for the time being in force relating to such service, whether appointed before or after the passing of the said Act, except as provided by section 22 thereof; and the following officers and classes of officers of the Civil Service, to whom it is considered these regulations should not apply, are hereby exempted from the operation thereof, that is to say,—

The Governor’s Establishment.

The Solicitor-General.

The Assistant Law Officer.

The Law Draftsman.

The Public Trustee, and all other officers, clerks, and persons employed by or in the Public Trust Office.

The Secretary to Cabinet.

Officers employed in the working, management, control, or supervision of all railways now or hereafter in any manner vested in His Majesty the King.

Lighthouse-keepers and their assistants.

Officers serving outside the limits of the Dominion of New Zealand.

Nor shall these regulations apply to any member of the Executive Council, to the bank appointed under the Public Revenues Act, 1910, or any officer of such bank, nor to any officer of the Civil Service whose salary is less than one hundred pounds per annum.

Southland Hospital and Charitable Aid Board declared a Local Authority for the Purposes of the Public Health Act.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this nineteenth day of March, 1912.

Present:

THE RIGHT HONOURABLE SIR J. G. WARD, BART.,
PRESIDING IN COUNCIL.

WHEREAS by section eighty-three of the Hospitals and Charitable Institutions Act, 1909, it is provided that, on the recommendation of the Inspector-General of Hospitals, and with the consent of the local authorities concerned, the Governor may by Order in Council, upon such terms and conditions as he thinks fit, combine for such of the purposes of the Public Health Act, 1908, as are mentioned in the Order the districts of any two or more local authorities situate within a hospital district, and declare that for those purposes the Hospital and Charitable Aid Board of the district shall be deemed to be the local authority within the combined districts:

And whereas the Inspector-General of Hospitals has recommended that the following districts, situate within the Southland Hospital District—namely,

CAMPBELLTOWN BOROUGH,
WINTON BOROUGH,
LAKE COUNTY,
MATAURA BOROUGH,
QUEENSTOWN BOROUGH,
SOUTHLAND COUNTY, and
WYNDHAM TOWN BOARD

should be combined for such of the purposes of the Public Health Act, 1908, as are hereinafter mentioned, and the local authorities concerned have consented thereto:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities above recited, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby combine the above-mentioned districts for such of the purposes of the Public Health Act as are mentioned in the Schedule hereto, and doth hereby declare that for these purposes the Southland Hospital and Charitable Aid Board shall be deemed to be the local authority within the combined districts.

SCHEDULE.

Sections of the Public Health Act, 1908, containing the purposes of that Act for which the said districts are combined, and for which purposes the Southland Hospital and Charitable Aid Board is to be deemed the local authority:—

Mortuaries or morgues … Sections 46, 49, and 50.

Privies, ashpits, and drains Sections 53, 55, and 56 (to apply only to the districts of those local authorities in which no sewerage systems exist).

Scavenging and cleaning … Sections 61 (1), 61 (2) (to apply only when so recommended by the District Health Officer), and 63.

Nuisances … Sections 70–75 and 77–84.

Offensive trades … Sections 85–88.

Inspection of food … Section 89.

Insanitary buildings … Sections 90 and 91.

Miscellaneous provisions … Sections 94, 98, 100, 104, 106, 107, 109, 112; 108 only in so far as it relates to making by-laws for the purposes specified in the aforementioned sections.

WHEREAS the Waikohu County Council lately proposed to raise a loan of five thousand pounds, under the Local Bodies’ Loans Act, 1908, and its amendments, for the purpose of deviating the Kanakanaia Settlement Road: And whereas there was an interval of twenty-five days between the last public notification of the intention to raise the loan and the date when the poll was taken, which is contrary to the requirements of section eleven of the before-mentioned Act as amended by section three of the Local Bodies’ Loans Amendment Act, 1910: And whereas the notices of intention to raise the loan do not state that it is not the intention to pay out of the loan the interest for the first year, as required by section eight
