remedy the default specified in that notice, and if the said company fails to comply with the terms of the notice within the said period, it shall be liable to a penalty of £10, to be recoverable by or on behalf of the Minister as a debt due to the Crown.

.11. Notwithstanding anything in the last preceding clause of these conditions, if the said company fails to comply with the terms of any such notice for ninety days after the receipt thereof, the Governor in Council may thereupon revoke this license without further notice.

  1. For the purpose of ascertaining whether the conditions of this license are being faithfully complied with by the said company, the Minister or any person appointed by him in that behalf may at all reasonable times enter on the said company’s lands and works and inspect the same.

  2. Nothing in this license shall be deemed in any way to interfere with, affect, or abridge any rights or powers vested in His Majesty the King, or in the Governor on his behalf, authorizing the construction, management, or working of any public works, nor shall any compensation be payable to or on behalf of the said company for injury done to the works herein authorized by the construction, management, or working of any such public work as aforesaid, or for the loss occasioned thereby, or for the exercise of any such right or power as aforesaid.

  3. This license shall, unless previously determined in pursuance of the foregoing conditions, expire and determine on the expiration or cancellation of the license to take and use water from the Waingongoro River, issued to the said company under the powers contained in the Water-power Act, 1903, and dated 3rd May, 1905.

Order in Council fixing Date of Payment of Income-tax.

ISLINGTON, Governor.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this fourth day of January, 1912.

Present:

THE HONOURABLE SIR JAMES CARROLL, K.C.M.G.,
PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers and authority vested in him under the Land and Income Assessment Act, 1908, and the Land-tax and Income-tax Act, 1911, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and determine that the respective duties leviable under the said Acts by way of income-tax shall be paid in one sum on Wednesday, the thirty-first day of January, one thousand nine hundred and twelve.

And in further pursuance and exercise of the powers and authority aforesaid, and with the like advice and consent as aforesaid, His Excellency doth also determine that the place where the said duties of income-tax shall be payable shall be the office of the Commissioner of Taxes, at the Government Buildings, Wellington; and that notice to the foregoing effect shall be given by the said Commissioner accordingly.

Altering Regulations for Trout and Perch Fishing in the Auckland Acclimatization District.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this fourth day of January, 1912.

PRESIDING IN COUNCIL.

WHEREAS it is enacted in Part II of the Fisheries Act, 1908, that the Governor in Council may from time to time, by Order in Council gazetted, make regulations to have force and effect throughout New Zealand, or only in such waters or places as are specified in the regulations:

And whereas by Order in Council dated the twenty-second day of July, one thousand nine hundred and seven, and published in the New Zealand Gazette No. 64, of the twenty-fifth day of the same month, regulations for the Auckland Acclimatization District were made providing, inter alia, that no lure or bait other than the natural or artificial fly or natural or artificial minnow and any small indigenous fish, insect, grasshopper, beetle, spider, caterpillar, or creeper shall be used in any of the rivers or streams in the said acclimatization district, and it is desirable to alter such regulations by providing that artificial fly only shall be used for taking trout in the Waihou River above the Okoroire Hotel:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in exercise of the powers and authorities conferred upon him by the said Act and of all other powers enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby add the following proviso to clause eight of the hereinbefore-recited regulations: “Provided that no bait other than artificial fly shall be used in taking fish in the Waihou River above the site on which the Okoroire Hotel now stands.”

Authorizing the Laying-off of a Street in the City of Nelson of a Width less than 66 ft. but not less than 40 ft.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this fourth day of January, 1912.

Present:

THE HONOURABLE SIR JAMES CARROLL, K.C.M.G.,
PRESIDING IN COUNCIL.

WHEREAS by section one hundred and seventy-eight of the Municipal Corporations Act, 1908, it is, inter alia, provided that where the configuration of any borough is such as that within any particular area or areas thereof it is difficult or inexpedient to construct streets of the width of sixty-six feet as required by the said Act, the Governor may, by Order in Council defining the limits of such particular area or areas, authorize the Council to permit within such area or areas the construction of streets and private streets of a width less than sixty-six feet, but not less than forty feet:

And whereas the configuration of part of the City of Nelson is such that within the area described in the Schedule hereto it is inexpedient to construct a street of sixty-six feet in width:

Now, therefore, in pursuance and in exercise of the powers vested in him by the Municipal Corporations Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Nelson City Council to permit the laying-off of a street of a width less than sixty-six feet, but not less than forty feet, within the area described in the Schedule hereto.


SCHEDULE.

ALL that area situated in the City of Nelson bounded by Mount, North, Esk, and Kawai Streets, and by a line from Mount Street to Kawai Street, about 15 chains north-east of and parallel to Esk Street; as the said area is more particularly delineated on the plan marked P.W.D. 29330, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon bordered red.
