By-laws for Waimangu Scenic Reserves.—Notice No. 1468.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-
third day of January 1911.

PRESIDING IN COUNCIL.
WHEREAS the reserves referred to in the Schedule
hereto have been brought under the provisions of
the Tourist and Health Resorts Control Act, 1908, and it
is expedient to make by-laws in respect to the manage-
ment and control of such reserves:
Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Do-
minion, and in pursuance and exercise of the powers and
authorities conferred on him by the said Act and by the
Public Reserves and Domains Act, 1908, doth hereby
make the following by-laws with respect to the manage-
ment, control, and general regulation of the said re-
serves.
BY-LAWS.
WAIMANGU SCENIC RESERVES.
-
IN these by-laws “General Manager” means the
General Manager of the Department of Tourist and Health
Resorts, and includes any person who may be acting for
the General Manager. “Caretaker” means the person
having the general charge and control (under the direc-
tion of the General Manager) of the Waimangu Scenic
Reserve. “The reserves” mean the reserves described in
the Schedule hereto. -
No person shall pick any flower, or break or destroy
any plant, shrub, or tree growing on the reserves. -
No person shall place, deposit, or leave any bottle
or glassware, paper, straw, dirt, rubbish, or any offensive
or noxious matter of any kind within the reserves or any
part thereof, except in any receptacle provided for the
purpose. -
No person (except the caretaker) shall place in any
thermal spring, or in any spring or pool, or in any water-
race, channel, or reservoir in the reserves, any clothes
or soap or any substance or article. -
No horse, dog, or other animal shall be allowed
within any fenced portion of the reserves; and for each
time any horse, dog, or other animal trespasses or is
allowed to trespass in such fenced portion of the reserves,
the owner of such horse, dog, or other animal shall be
liable for breach of these by-laws. This by-law shall
not, however, apply in the case of dogs which are led by
a cord or chain, nor to horses drawing any carriage, nor
to saddled horses. -
No person shall trespass upon any portion of the
reserves which may be set apart for planting, or where
the soil is loose, or upon grass kept cut for lawns or
ornamental purposes. -
No person shall break, remove, deface by writing
or marking, or otherwise injure or damage any rock or
stone or silica within the reserves. -
No person shall bathe in any pool within the re-
serves unless permission so to do be first obtained from
the caretaker. -
Any person behaving to the annoyance of any other
person shall, if requested by the caretaker, immediately
leave the reserves, and may be prohibited at any future
time from again entering. -
No person shall take photographs, or canvass for
the sale of photographs, within the reserves without the
written permission of the General Manager, which must
be first had and obtained. -
No person shall, without the written permission of
the General Manager, carry or use any gun, rifle, or fire-
arm, or use any net, engine, instrument, or device for the
capture or destruction of any bird or animal within the
reserves. -
Every person who commits a breach of any of these
by-laws shall upon conviction be liable to a fine not ex-
ceeding five pounds for every such breach.
SCHEDULE.
Waimangu Scenic Reserves.
All that area in the Auckland Land District, containing
by admeasurement 97 acres, more or less, situated in
Blocks XV and XVI, Tarawera Survey District, com-
mencing at a point 2875 links due south from the north-
east corner of Section No. 1, Block XV, Tarawera Survey
District. Bounded towards the north-west generally by
lines through Run 79; towards the north-east by a line
bearing 100° 34′, 375 links, and by Rotomahana Lake;
towards the south-east generally by lines through Run 79;
and towards the west by Section 1, Block XV, Tarawera
Survey District, to the point of commencement: be all
the aforesaid bearings and linkages more or less: as the
same is delineated on the plan marked L. 51799/104A,
deposited in the Head Office, Department of Lands, at
Wellington, and thereon edged brown.
All that area in the Auckland Land District, containing
by admeasurement 135 acres 3 roods, more or less, being
Section 2, Block XV, Tarawera Survey District, com-
mencing at the north-east corner of Section 3, Block XV,
Tarawera Survey District. Bounded towards the north-
west generally by Run 79, towards the east generally by
Rotomahana Lake, and towards the south-east generally
by reserve for internal communication to the point of com-
mencement; as the same is delineated on the plan marked
L. 51799/104B, deposited in the Head Office, Department
of Lands, at Wellington, and thereon edged red.
All that area in the Auckland Land District, containing
by admeasurement 139 acres 2 roods 16 perches, more or
less, being Section 4, Block XV, Tarawera Survey Dis-
trict, commencing at a point on the shore of Lake Roto-
mahana, such point being the north-easternmost extremity
of the reserve for internal communication purposes here-
before described. Bounded towards the north-west by
the said reserve for internal communication a total dis-
tance of 13932·6 links; towards the south-west (450·9
links), south-east (1049·6 links), and again towards the
south-west (500 links) by the internal-communication re-
serve aforesaid; again towards the south-east by lines
through Run 79, bearing 77° 25′, 3877·3 links, and 57° 25′,
8079·3 links, to Lake Rotomahana; and again towards the
north-east by the said lake to the point of commence-
ment: be all the aforesaid bearings and linkages more
or less: as the same is delineated on the plan marked
L. 51799/104C, deposited in the Head Office, Department
of Lands, at Wellington, and thereon edged red.
All that area in the Auckland Land District, containing
by admeasurement 6 acres 1 rood, more or less, being
Section 5A, Block XV, Tarawera Survey District, com-
mencing at the north-east corner of Section 1, Block XV,
Tarawera Survey District. Bounded towards the north-
west by Run 79: towards the south-east by reserve for
internal communication; and towards the west by Sec-
tion 1, Block XV, Tarawera Survey District, to the point
of commencement: as the same is delineated on the plan
marked L. 51799/104D, deposited in the Head Office,
Department of Lands, at Wellington, and thereon edged
red.
All that area in the Auckland Land District, containing
by admeasurement 6 acres 1 rood 12 perches, more or less,
being Section 3, Block XV, Tarawera Survey District,
commencing at the southernmost corner of Section 2,
Block XV, Tarawera Survey District. Bounded towards
the south-east and south-west by reserve for internal com-
munication, and towards the north-west by Run 79, to the
point of commencement; as the same is delineated on
the plan marked L. 51799/104E, deposited in the Head
Office, Department of Lands, at Wellington, and thereon
edged red.
