Now, therefore, I, John Poynder Dickson-Poynder, Baron Islington, the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers and authorities vested in me by the Public Works Act, 1908, and the Public Works Amendment Act, 1909, and of every other power and authority in anywise enabling me in this behalf, do hereby direct that the portions of the said road, being the portions firstly and secondly described in the Schedule hereto, shall be under the exclusive care, control, and management of the Whangarei Borough Council; and that the portions of the said road being the portions thirdly and fourthly described in such Schedule shall be under the exclusive care, control, and management of the Whangarei County Council; and, in further pursuance and exercise of the powers aforesaid, I do hereby fix and determine that the cost of maintaining, repairing, improving, or reconstructing the said portions of road is to be borne by the local authorities hereinafter mentioned in the following proportions—viz., the Whangarei Borough Council to bear the whole of such cost in respect to that piece of road firstly described in the Schedule hereto, the Whangarei Borough Council and the Whangarei County Council to each bear one-half of such cost in respect to that piece of road secondly described in the Schedule hereto, the Whangarei County Council to bear the whole of such cost in respect to that portion of road thirdly described in the Schedule hereto, and the Whangarei County Council and the Kamo Town Board to each bear one-half of such cost with respect to the piece of road fourthly described in the Schedule hereto:

And I do also hereby further direct that such matters as the kerbing, repairing, or constructing of footpaths, and channelling in respect to the two pieces of road secondly and fourthly described in the Schedule hereto shall, if required, be undertaken independently by each local body in respect of its own side of such pieces of roads, and that the general cost of maintenance, repairs, improvements, and reconstruction of the road shall be kept distinct from expenditure in connection with these matters:

And I do hereby direct that any contribution hereby required to be made as aforesaid by the Whangarei County Council shall be paid from time to time in the proportions hereinbefore prescribed out of the funds of the said Council within a period of thirty days after demand in writing made by or on behalf of the Council of the Borough of Whangarei, and such payments shall be made from time to time to the Clerk of the said Borough Council for and on account of the Whangarei County Council:

And I do also hereby direct that any contribution hereby required to be made as aforesaid by the Kamo Town Board shall be paid from time to time in the proportions hereinbefore prescribed out of the funds of the said Town Board within a period of thirty days after demand in writing made by or on behalf of the Council of the County of Whangarei, and such payments shall be made from time to time to the Clerk of the said County Council for and on account of the Kamo Town Board.

SCHEDULE.

FIRSTLY, all that portion of the said road situated in the Borough of Whangarei, commencing at a point near the post-office about 3 chains south of Cameron Street, and proceeding thence in a northerly direction generally, terminating at the boundary of the Borough of Whangarei near its junction with Whauwhau Road, being a distance of 153 chains, more or less:

Secondly, all that portion of the said road forming the boundary between the Borough of Whangarei and the Whangarei County, commencing at the terminating-point herein firstly described, and proceeding thence in a northerly direction and terminating at the southern boundary of the Kamo Town District, being a distance of 24 chains, more or less.

Thirdly, all that portion of the said road situated in the Kamo Town District, commencing at the terminating-point herein secondly described, and proceeding thence in a north-westerly direction generally, and terminating at the boundary of the Kamo Town District, at the north-western corner of Section 117, Block VIII, Purua Survey District, being a distance of 175 chains, more or less.

Fourthly, all that portion of the said road forming the boundary between the Kamo Town District and the Whangarei County, commencing at the terminating-point herein thirdly described, and proceeding thence in a north-westerly direction, and terminating at the north-eastern corner of Section 119, Block VIII, Purua Survey District, being a distance of 21 chains, more or less.

All in the Auckland Land District; as the said portions of road are more particularly delineated on the plan marked P.W.D. 30407, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon lettered E-D, D-C,

C-B, and B-A, and coloured purple, yellow, blue, and green respectively.

As witness the hand of His Excellency the Governor, this seventeenth day of October, one thousand nine hundred and eleven.

Warrant vesting Control of the Coalgate and Glentunnel Bridges in the Selwyn County Council, and apportioning the Cost of Maintenance of the same between the Malvern County Council and the Selwyn County Council.

ISLINGTON, Governor.

WHEREAS by section one hundred and twenty of the Public Works Act, 1908 (hereinafter called “the said Act”), it is, inter alia, enacted that the Governor may, by Warrant under his hand publicly notified and gazetted, direct that any bridge already constructed, or which may hereafter be constructed, over or across any river or arm of the sea respectively shall, from and after a date to be fixed in such Warrant, be under the exclusive care, control, and management of such local authority as shall be mentioned in that behalf in such Warrant; and may by any such Warrant as aforesaid fix and determine whether all or any, and, if so, what part, of the cost, whether theretofore incurred or thereafter to be incurred, of maintaining, repairing, improving, or reconstructing any such bridge is to be provided and paid by the local authority or local authorities; and may by any such Warrant as aforesaid direct how, when, and to whom any such payment is to be made:

And whereas it is expedient that provision should be made under the hereinbefore-in-part-recited Act for the purposes hereinafter mentioned:

Now, therefore, I, John Poynder Dickson-Poynder, Baron Islington, the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers and authorities vested in me by the said Act, and of every other power and authority in anywise enabling me in this behalf, do hereby direct that the bridges described in the Schedule hereto, and known as the Coalgate and Glentunnel Bridges (hereinafter called “the said bridges”), shall, from and after the date of this Warrant, be under the exclusive care, control, and management of the Selwyn County Council; and, in further pursuance and exercise of the powers aforesaid, I do hereby fix and determine that the cost of maintaining, repairing, or improving the said bridges is to be provided and paid by the local authorities hereinafter mentioned in the following proportions—viz., the Selwyn County Council to pay five-sixths of such cost and the Malvern County Council to pay one-sixth of such cost respectively:

And I do also hereby direct that the contribution hereby required to be made as aforesaid by the Malvern County Council towards the cost of maintaining, repairing, or improving the said bridges shall be paid from time to time, in the proportion hereinbefore prescribed, out of the county fund of the said County of Malvern, within a period of one month after demand in writing made by or on behalf of the Council of the County of Selwyn, stating the amount so required to be paid and the purpose for which it is required, shall have been left at the office of the Malvern County Council, and the payments so required to be made shall be made from time to time to the Clerk of the Selwyn County Council for and on behalf of the Council of the County of Malvern:

And I do hereby cancel and revoke the Proclamations dated the twenty-third day of November, one thousand eight hundred and ninety-eight, vesting the control and apportioning the cost of maintaining the said bridges, published in the New Zealand Gazette No. 86, pages 1913 and 1914, of the first day of December, one thousand eight hundred and ninety-eight.

SCHEDULE.

THAT bridge over the Selwyn River, known as the Coalgate Bridge, at the crossing of the Hororata to Coalgate Road, in the Canterbury Land District.

Also that bridge over the Selwyn River at the crossing of the Wairiri Valley Road, known as the Glentunnel Bridge, situated in the Canterbury Land District.

As the sites of the said bridges are more particularly delineated on the plan marked P.W.D. 30474, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon shown in red colour and lettered B and A respectively.

As witness the hand of His Excellency the Governor, this seventeenth day of October, one thousand nine hundred and eleven.
