IN pursuance and exercise of the powers and authorities conferred upon him by the Census and Statistics Act, 1910 (hereinafter termed “the said Act”), His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and direct that the account described in section twenty-eight of the said Act shall be taken on the twentieth day of October, one thousand nine hundred and eleven.

Authorizing the Laying-off of Two Streets in Block VI, Town District, situate in the Borough of Mornington, of a Width less than 66 ft. but not less than 40 ft.

ORDER IN COUNCIL.

At the Government House, at Wellington, this tenth day of October, 1911.

His Excellency the Governor in Council.

WHEREAS by section one hundred and seventy-eight of the Municipal Corporations Act, 1908, it is, inter alia, provided that where the configuration of any borough is such that within any particular area or areas thereof it is difficult or inexpedient to construct streets of the width of sixty-six feet as required by the said Act, the Governor may, by Order in Council defining the limits of such particular area or areas, authorize the Council to permit within such area or areas the construction of streets and private streets of a width less than sixty-six feet but not less than forty feet:

And whereas the configuration of the Borough of Mornington is such that within the area described in the Schedule hereto it is inexpedient to construct two streets of sixty-six feet in width:

Now, therefore, in pursuance and in exercise of the powers vested in him by the Municipal Corporations Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby permit, within the area described in the Schedule hereto, the laying-off of two streets of a width less than sixty-six feet but not less than forty feet.

SCHEDULE.

ALL that parcel of land in the Otago Land District, situated in the Borough of Mornington, being part of Section 65, Block VI, town district, and bounded by a line commencing at a point on the south-eastern side of Avoca Street, about 530 links north-east of the junction of the south-western side of Maryhill Terrace with Avoca Street, and proceeding thence in a south-westerly direction for a distance of about 930 links along the said south-eastern side of Avoca Street and that side produced to 76R; thence in a south-easterly direction for a distance of about 230 links along the north-eastern boundary of 76R to the southern boundary of the Borough of Mornington; thence in a north-easterly direction for a distance of about 440 links along the southern boundary of the Borough of Mornington to the street known as Leckhampton Court; thence in a north-westerly direction for a distance of about 60 links along the south-western side of the said Leckhampton Court; thence in a north-easterly direction for a distance of about 100 links along the north-western side of the said Leckhampton Court; thence by a right line in a north-westerly direction for a distance of about 375 links to the north-western corner of Lang’s Road; thence in a north-easterly direction for a distance of about 330 links along the north-western side of Lang’s Road; thence by a right line in a north-westerly direction for a distance of about 380 links; thence by a right line in a south-westerly direction for a distance of about 180 links; thence by a right line in a north-westerly direction for a distance of about 150 links to the place of commencement: as the said parcel of land is more particularly delineated on the plan marked P.W.D. 30195, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon shown in green border.

Authorizing the Exchange of Portion of a Reserve in the Borough of Hamilton for other Land.

ORDER IN COUNCIL.

At the Government House, at Wellington, this tenth day of October, 1911.

Present:

His Excellency the Governor in Council.

WHEREAS the land mentioned in the first column of the Schedule hereto forms portion of a reserve vested in the Mayor, Councillors, and Burgesses of the Borough of Hamilton, as an endowment in aid of the borough funds: And whereas the said borough is desirous of having the said land exchanged for an area of equal value, described in the second column of the said Schedule; and, in the opinion of the Governor, it is expedient to give effect to such exchange:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by the twelfth section of the Public Reserves and Domains Act, 1908, doth hereby declare that the said land described in the first column of the Schedule hereto may be exchanged for the land described in the second column of the Schedule hereto.

All that area in the Auckland Land District, containing by admeasurement 3 roods 38·71 perches, more or less, being part of Allotment No. 59A of the Town of Hamilton West. Bounded towards the north-east by Tisdale Street, 23 links; towards the south-east, again towards the north-east, again towards the south-east, and again towards the north-east by other part of Allotment No. 59A, Town of Hamilton West. 146, 22·3, 149·3, and 301·2 links respectively; again towards the south-east by Allotment No. 59, Town of Hamilton West aforesaid, 214·4 links; towards the south-west by the last-mentioned Allotment No. 59, and Allotment No. 407, 400 links; and towards the north-west by Allotments Nos. 481, 445, and 451 of the same town, 500 links: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. 1911/1169B, deposited in the Head Office, Department of Lands, at Wellington, and thereon coloured red. All that area in the Auckland Land District, containing by admeasurement 3 roods 35·81 perches, more or less, being Lots 4, 5, and 6 of a subdivision of Allotments 70, 71, and 72 of the Town of Hamilton West. Bounded towards the north-east by other part of the said Allotments Nos. 70, 71, and 72, 289·39 links; towards the south-east by Allotment No. 73 of Town of Hamilton West, 336·5 links; towards the south-west by Anglesey Street, 289·39 links; and towards the north-west by Lots Nos. 3 and 1 of the before-mentioned subdivision, 336·53 links: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. 1911/1169A, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red
