Consenting to the Auckland Electric Tramways Company (Limited) erecting Two Overhead Bare Feeder-wires along and across Roads and Streets in the Road District of Epsom and Borough of Mount Eden.

ISLINGTON, Governor.

WHEREAS section 12 of the Tramways Amendment Act, 1910, prescribes that the powers conferred on the promoters of a tramway by clause eighteen of the Second Schedule to the Tramways Act, 1908, may be exercised for the purposes of the convenient working of any tramway, whether heretofore constructed or hereafter to be constructed, in, over, along, or across any road upon the route of the tramway specified in the authorizing Order, and also, with the consent of the Governor, and upon such terms and conditions as the Governor prescribes, in, over, along, or across any road not upon the route of the tramway, or any road in the district of any adjacent local authority: And whereas the Auckland Electric Tramways Company (Limited) (hereinafter called “the company”), the promoters of the electric tramways constructed and worked by them by virtue of several authorizing Orders granted from time to time by the Governor in Council under the provisions of the Tramways Act, 1894, and the Tramways Act, 1908, has applied for permission to erect the two overhead feeder-wires hereinafter mentioned in, over, along, or across the streets and roads, or portions of streets and roads, described in the Schedule hereto, which streets and roads are not upon the route of the said tramways, for the purpose of the convenient working of such tramways: And whereas the Council of the Borough of Mount Eden and the Board of the Epsom Road District, through which districts the said wires are to be carried, have been notified of the said application, and they have consented to the same being given effect to: Now, therefore, I, John Poynder Dickson-Poynder, Baron Islington, the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers and authorities vested in me by section twelve of the Tramways Amendment Act, 1910, do hereby consent to two No. 4/0 bare overhead feeder-wires of solid, hard-drawn copper being erected by the company in, over, along, or across the roads and streets, or portions of roads and streets, described in the Schedule hereto, subject to the work being carried out in strict accordance with the Board of Control’s requirements. For that purpose the company may exercise all or any of the powers conferred on them by clause eighteen of the Second Schedule to the Tramways Act, 1908.

SCHEDULE.

ALL that route upon which the feeder-wires are to be carried, commencing at the Epsom Sub-power Station, about 3 chains east of the junction of Epsom Road and Green Lane, and proceeding thence in a westerly direction along Green Lane, across Epsom Road, and along Derby Street to its junction with a road known as “The Drive”; thence in a southerly direction along The Drive to its junction with the road forming the northern and north-eastern boundaries of Subdivisions 9, 19, 20, 21, 22, 23, 33, 34, and 39 of Allotments 62 and 63, Suburbs of Auckland; thence in a westerly, then north-westerly, again westerly, and again north-westerly direction along that road to its junction with Church Street; thence in a northerly direction along Church Street to its junction with Mount Albert and Epsom Road; thence in a westerly direction along Mount Albert and Epsom Road to its junction with Dominion Road: all in the Epsom Road District and Mount Eden Borough: as the said route is more particularly delineated on the plan marked P.W.D. 29989, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District.

As witness the hand of His Excellency the Governor, this twenty-fifth day of July, one thousand nine hundred and eleven.

Changing the Purpose of a Portion of a Reserve in the Borough of Akaroa, Canterbury Land District.

ISLINGTON, Governor.

WHEREAS the land described in the Schedule hereto forms portion of a reserve for a site for buildings for the general purposes of the Provincial Government of the Province of Canterbury, being a reserve within Class I of the Second Schedule to the Public Reserves and Domains Act, 1908, and such land has not been vested in trust in any society, body corporate, or trustees:

And whereas it is expedient that such land shall be appropriated as a site for a public school, being a reserve within Class III of the aforesaid Act:

Now, therefore, I, John Poynder Dickson-Poynder, Baron Islington, Governor of the Dominion of New Zealand, in exercise of the powers and authorities conferred upon me by the eleventh section of the Public Reserves and Domains Act, 1908, do by this notification declare that the said land shall, from and after the twenty-seventh day of July, one thousand nine hundred and eleven, be appropriated as a site for a public school under Class III of the Public Reserves and Domains Act, 1908; and I do hereby direct that this notification shall be published in the New Zealand Gazette.

SCHEDULE.

ALL that area in Canterbury Land District, containing by admeasurement 2 roods, more or less, being part of Reserve 82, situated in the Borough of Akaroa. Bounded towards the south-east by Lavaud Street, 324·8 links; towards the south-west by a right-of-way along the foreshore of Akaroa Harbour, 257·7 links; towards the north-west by Jolie Street, 165·3 links; and towards the north-east by a line intersecting the said Reserve 82, 201·6 links; be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. 5543/1, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered pink.

As witness the hand of His Excellency the Governor, this twenty-sixth day of July, one thousand nine hundred and eleven.

Warrant vesting Control of the Kawhatau Bridge, on the Potaka Road, in the Rangitikei County Council, and apportioning the Cost of maintaining the Same.

ISLINGTON, Governor.

WHEREAS by section one hundred and twenty of the Public Works Act, 1908 (hereinafter called “the said Act”), it is, inter alia, enacted that the Governor may, by Warrant under his hand publicly notified and gazetted, direct that any bridge already constructed, or which may hereafter be constructed, over or across any river or arm of the sea respectively shall, from and after the date to be fixed in such Warrant, be under the exclusive care, control, and management of such local authority as shall be mentioned in that behalf in such Warrant; and may by any such Warrant as aforesaid fix and determine whether all or any, and, if so, what part of the cost, whether theretofore incurred or thereafter to be incurred, of maintaining, repairing, improving, or reconstructing any such bridge is to be provided and paid by the local authority or local authorities, and, if so, by what local authority or local authorities; and may by any such Warrant as aforesaid direct how, when, and to whom any such payment is to be made:

And whereas it is considered expedient to make provision under the said Act for the purposes and in the manner hereinafter set forth:

Now, therefore, I, John Poynder Dickson-Poynder, Baron Islington, the Governor of the Dominion of New Zealand, in pursuance and in exercise of the power and authority vested in me by the said Act, and of all other powers and authorities in anywise enabling me in this behalf, do hereby direct that the bridge, known as the Kawhatau Bridge, over the Kawhatau River, as described in the Schedule hereto (and hereinafter referred to as “the said bridge”), shall, from and after the date of the gazetting hereof, be under the exclusive care, control, and management of the Rangitikei County Council: And, in further pursuance and in exercise of the aforesaid powers and authorities, I do hereby fix and determine that the cost of maintaining, repairing, improving, or reconstructing the said bridge shall be borne by the Rangitikei County Council and the Kiwitea County Council in equal proportions:

And I do also further direct that any contribution hereby required to be made as aforesaid by the Kiwitea County Council shall be paid from time to time in the proportion hereinbefore prescribed out of the funds of that county within a period of thirty days after demand in writing made by or on behalf of the Rangitikei County Council, and all such payments for and on account of the Kiwitea County Council shall be made to the Clerk of the Rangitikei County Council.
