WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, it is provided that such approval may be either absolute or subject to such conditions with respect to the building-line as the Governor by Order in Council thinks fit to impose:

And whereas on the twelfth day of June, one thousand nine hundred and eleven, the New Plymouth Borough Council, the local authority having control of the portions of streets described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said portions of streets:

And whereas it is deemed expedient that such resolution should be approved:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution in so far as it affects the said portions of streets described in the Schedule hereto.

SCHEDULE.

All that portion of Vivian Street, in the Borough of New Plymouth, commencing at its junction with Dawson Street, and running in a westerly direction for a distance of 250 links, more or less, and abutting on Section 356 of the Borough of New Plymouth.

Also all that portion of Dawson Street, in the Borough of New Plymouth, commencing at its junction with Vivian Street, and running in a southerly direction for a distance of 205 links, more or less, and abutting on Sections 356 and 357 of the Borough of New Plymouth.

As the said portions of streets are more particularly delineated on the plan marked P.W.D. 29835, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured blue.

BY virtue of the powers and authorities vested in me by the twenty-sixth section of the Public Reserves and Domains Act, 1908, I, John Poynder Dickson-Poynder, Baron Islington, the Governor of the Dominion of New Zealand, by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the reserve for recreation in the Nelson Land District described in the Schedule hereto shall be and the same is hereby brought under the operation of and

BRAEBURN DOMAIN.

ALL that area in the Nelson Land District, containing by admeasurement 5 acres, more or less, and being Section 1, Block IV, Tutaki Survey District. Bounded towards the northward and eastward by continuations of the roads forming respectively the northern and eastern boundaries of Section 2, Block VIII, of the before-mentioned survey district, 636'9 links and 730'7 links respectively; and towards the southward and westward by parts of Section 2 aforesaid, 634'9 links and 849'3 links respectively : be all the aforesaid linkages more or less : as the same is delineated on the plan marked L. 1477, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

SCHEDULE.

ALL that area in the Canterbury Land District, containing by admeasurement 1 rood, more or less, being Section 541, Town of South Rakaia, and now forming part of Reserve 2986. Bounded towards the north-east by Section 542, Town of South Rakaia ; towards the south-east by Section 543 of said town ; towards the south-west by Michael Street ; and towards the north-west by Tancred Street.

Also all that area in the Canterbury Land District, containing by admeasurement 1 rood, more or less, being Section 552, Town of South Rakaia, and now forming part of Reserve 2986. Bounded towards the north-east by Dundford Street ; towards the south-east by Section 554, Town of South Rakaia ; towards the south-west by Section 551 of said town ; and towards the north-west by Section 550, Town of South Rakaia aforesaid.

As the same are delineated on the plan marked L. 1448/5, deposited in the Head Office, Department of Lands, at Wellington, and thereon coloured red.
