instead of in the form given in the Schedule to the Local
Bodies’ Loans Act, 1908 : And whereas it appears that
the ratepayers have not been misled by such irregularity,
and it is expedient to validate the same :
Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and exercise of
the powers and authorities conferred by section one
hundred and twenty-one of the Local Bodies’ Loans Act,
1908, and acting by and with the advice and consent of
the Executive Council of the said Dominion, doth hereby
order and declare that the said poll shall be and be
deemed to have been as good and effectual as if the voting-
papers used at such poll had been in the form given in
the Schedule to the Local Bodies’ Loans Act, 1908, and
that the proceedings relative to such loan shall not be
called into question by reason only of the irregularity
aforesaid.

Sections of the Road Boards Act, 1908, to apply to Point
Chevalier Road Board.

At the Government Buildings, at Wellington, this twenty-
third day of January, 1911.
Present :
THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G.,
PRESIDING IN COUNCIL.
WHEREAS the Board of the Point Chevalier Road
District, in the County of Eden, being a county in
which the Counties Act, 1908, is suspended, have made
an application under section one hundred and forty-five of
the Road Boards Act, 1908, and it is expedient to grant
such application :
Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and in exercise
of the powers and authorities vested in him by the Road
Boards Act, 1908, and acting by and with the advice and
consent of the Executive Council of the said Dominion,
doth hereby order and declare that the provisions of sec-
tions one hundred and forty-six, one hundred and forty-
seven, and one hundred and forty-eight of the Road Boards
Act, 1908, shall apply to the said Point Chevalier Road
Board as from the date of the publication hereof in the
New Zealand Gazette.

Vesting Control of a Reserve under the Tourist and
Health Resorts Control Act, 1908.

ISLINGTON, Governor.
ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-
third day of January, 1911.
Present :
THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G.,
PRESIDING IN COUNCIL.
IN pursuance and exercise of the power and authority
conferred on him by section five of the Tourist and
Health Resorts Control Act, 1908 (hereinafter termed “the
said Act”), His Excellency the Governor of the Dominion
of New Zealand, acting by and with the advice and con-
sent of the Executive Council of the said Dominion, doth
hereby vest the control of the reserve for scenic purposes
described in the Schedule hereto in the Minister of the
Crown for the time being having the administration of
the said Act, and doth hereby declare that the said reserve
shall be administered under the said Act.

SCHEDULE.
ALL that area in the Westland Land District, containing
by admeasurement 430 acres, more or less, being Reserve
No. 1055, situated in Blocks VII and XI, Mahinapua
Survey District, and bounded as follows : Starting from
a point on the eastern side of the Hokitika-Ross Railway
Reserve at the intersection of the south boundary of the
endowment for aged and infirm miners; thence by that
boundary to the reserve along Mahinapua Lake; thence
by that reserve to the road running along the north
boundary of the Hokitika Harbour Board Endowment
No. 146, and known as the Ruatapu Road ; thence by
that road to Sawmill-site No. 1697, and by that site on
the north-west and on the south 10 chains and 5 chains
respectively to the east boundary of the before-mentioned
railway reserve; thence by said railway reserve to starting-
point; including the road reserve traversing the above-
described area, but exclusive of all present and prospective
mining rights : as the same is delineated on the plan
marked L. 136/1, deposited in the Head Office, Depart-
ment of Lands, at Wellington, and thereon bordered red.

ORDER IN COUNCIL.
At the Government House, at Wellington, this ninth day
of January, 1911.
Present :
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by section nine of the Mining Act, 1908,
it is enacted that the Governor may from time to
time by Order in Council appoint fit persons to be
Wardens, who shall hold office during the Governor’s
pleasure :
Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and exercise of
the power and authority conferred by the said section nine
of the Mining Act, 1908, and acting by and with the
advice and consent of the Executive Council of the said
Dominion, doth hereby appoint
WILLIAM REEVE HASELDEN, Esq.,
to be a Warden, to hold and exercise the duties of such
office under and subject to the provisions of the said Act
during pleasure, on and from the first day of February,
one thousand nine hundred and eleven.

Consenting to a Mortgage of Native Land.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-
third day of January, 1911.
Present :
THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G.,
PRESIDING IN COUNCIL.
WHEREAS by section two hundred and thirty of the
Native Land Act, 1909, it is provided that no
instrument of alienation of Native land by way of mort-
gage or charge, other than a mortgage or charge in favour
of a State Loan Department, shall be confirmed by a
Board or the Court without the precedent consent of the
Governor in Council :
And whereas application has been made for the consent
of the Governor in Council to a mortgage of the block or
parcel of land mentioned in the Schedule hereto : And
whereas it is expedient that the precedent consent of the
Governor in Council should issue :
Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Do-
minion, doth hereby consent to the alienation by way of
mortgage of the block or parcel of land set out in the Sche-
dule hereto. And it is hereby declared that this Order in
Council is made under the provisions in that behalf of the
Native Land Act, 1909, and shall operate accordingly as a
consent of the Governor in Council to the proceedings
hereby authorized.
