proportion of the cost of maintaining the said road should be borne by the local authorities affected :

And whereas an inquiry was duly held, and a report was made, in respect to the matter :

And whereas it is expedient that effect should be given to the recommendations contained in the said report, and that provision should be made under the said Act for the purposes and in the manner hereinafter set forth :

Now, therefore, I, John Poynder, Dickson-Poynder, Baron Islington, the Governor of the Dominion of New Zealand, in pursuance and in exercise of the power and authority vested in me by the said Act, and of all other powers and authorities in anywise enabling me in this behalf, do hereby direct that the said road shall, from and after the date of this Warrant, be under the control of the Wanganui East Borough Council; and, in further pursuance and in exercise of the aforesaid powers and authorities, I do hereby fix and determine that the cost of maintaining the said road shall be borne in the following proportions, viz. : The Wanganui East Borough Council to bear half of such cost and the Mataongaonga Road Board to bear half of such cost respectively :

I do also further direct that any contribution hereby required to be made as aforesaid by the Mataongaonga Road Board shall be paid from time to time to the Wanganui East Borough Council in the proportion hereinbefore prescribed out of the funds of the said Board, within a period of thirty days after demand in writing made by or on behalf of the Wanganui East Borough Council, and that such payments shall be made from time to time to the Clerk of the Wanganui East Borough Council for and on account of such Road Board.

SCHEDULE.

ALL that portion of road in the Wellington Land District, known as the No. 3 Line Road, situated between the Wanganui East Borough and the Mataongaonga Road District, commencing at its junction with the Gordon Park Road and proceeding in an easterly direction to the boundary between Sections 72 and 73, Block II, Ikitara Survey District, being a distance of 24 chains, more or less; as the said portion of road is more particularly delineated on the plan marked P.W.D. 29682, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured purple.

As witness the hand of His Excellency the Governor, this fourteenth day of June, one thousand nine hundred and eleven.

Warrant vesting Control of Basque Road, Portion of the New North Road, and Portion of Mount Eden Road in the Auckland City Council, and apportioning the Cost of Construction and Maintenance of the Same.

ISLINGTON, Governor.

WHEREAS by section twelve of the Public Works Amendment Act, 1909 (hereinafter termed “the said Act”), it is provided that where a road or street lies along the boundary of two or more districts, whether that road or street is wholly within one or is partly within one and is partly within another of those districts, or is within none of those districts, the Governor may from time to time, by Warrant under his hand and gazetted, direct which of the local authorities of those districts shall have control of the road or street or any part thereof; and may also in like manner determine from time to time whether any of those local authorities shall contribute to the cost of the construction or maintenance of that road or street, and, if so, in what proportions :

And whereas the road or street and portions of roads or streets known as Basque Road, New North Road, and Mount Eden Road, described in the Schedule hereto, and hereinafter termed “the said road” and “portions of roads” respectively, form part of the boundary between the Auckland City and Eden Terrace Road District :

And whereas a dispute has arisen as to which local authority should have control of the said road and portions of roads, and what proportion of the cost of constructing and maintaining the said road and portions of roads should be borne by the local authorities affected :

And whereas an inquiry was duly held, and a report was made, in respect to the matter :

And whereas it is expedient that effect should be given to the recommendations contained in the said report, and that provision should be made for the purposes and in the manner hereinafter set forth ;

Now, therefore, I, John Poynder Dickson-Poynder, Baron Islington, the Governor of the Dominion of New Zealand, in pursuance and in exercise of the power and authority vested in me by the said Act, and of all other powers and authorities in anywise enabling me in this behalf, do hereby direct that, from and after the date of this Warrant, the control and maintenance of the said road and portions of roads shall be as provided for in an agreement made between the Auckland City Council and the Eden Terrace Road Board—viz., the Auckland City Council shall construct and maintain the said road and portions of roads, the Auckland City Council to pay half the cost of such construction and maintenance and the Eden Terrace Road Board to pay half of such cost; but if the Auckland City Council or if that Council and the Eden Terrace Road Board can get a contribution from Mount Eden Borough towards the cost of maintaining the portion of Mount Eden Road that bounds the Eden Terrace Road District and the Auckland City, that the contribution of each side for the construction or maintenance of the said portion last mentioned shall be proportionately reduced.

The kerbing, channelling, and footpaths on either sides of the said road and portions of roads are to be maintained by the local authority of the district contiguous to each such footpath respectively. The Auckland City Council shall not expend any money on permanent improvement (other than maintenance) on any of these roads without first giving three calendar months’ notice to the Eden Terrace Road Board of its intention so to do, and therein giving the approximate cost.

And I do also further direct that any contribution hereby required to be made as aforesaid by the Mount Eden Road Board shall be paid from time to time in the proportion hereinbefore prescribed out of the funds of the said Board, within a period of thirty days after demand in writing made by or on behalf of the Auckland City Council, and that such payments shall be made from time to time to the Clerk of the Auckland City Council for and on account of the Mount Eden Road Board.

SCHEDULE.

ALL that road situated between the City of Auckland and the Eden Terrace Road District, known as Basque Road, commencing at its junction with New North Road and proceeding in a westerly direction to its present terminus, a distance of 11 chains.

Also all that portion of road situated between the City of Auckland and the Eden Terrace Road District, known as New North Road, commencing at its junction with Mount Eden Road and proceeding in a south-westerly direction to its junction with Basque Road, being a distance of 2 chains, more or less.

Also all that portion of road known as Mount Eden Road, commencing at its junction with New North Road and proceeding in a south-easterly direction to the boundary between the Eden Terrace Road District and the Mount Eden Borough, being a distance of 8 chains, more or less.

As the said road and portions of roads are more particularly delineated on the plan marked P.W.D. 27905, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured red.

As witness the hand of His Excellency the Governor, this fourteenth day of June, one thousand nine hundred and eleven.
