And whereas it is expedient to give effect to the recommendations contained in the said report, and that provision should be made for the purposes and in the manner hereinafter set forth :
Now, therefore, I, John Poynder Dickson-Poynder, Baron Islington, the Governor of the Dominion of New Zealand, in pursuance and in exercise of the power and authority vested in me by the said Act, and of all other powers and authorities in anywise enabling me in this behalf, do hereby direct that the said portion of road shall, from and after the date of this Warrant, be under the control of the Auckland City Council. And, in further pursuance and in exercise of the aforesaid powers and authorities, I do hereby determine that the cost of the construction and maintenance of the said portion of road, less any contribution as may be made thereto by any other local authority or local authorities, shall be borne by the Auckland City Council and the Epsom Road Board in the following proportions, viz. : The Auckland City Council shall, out of its own funds, pay seventy-five per centum, and the Epsom Road Board shall, out of its own funds, pay to the Auckland City Council twenty-five per centum, of such cost respectively. Each local authority shall itself pay the cost of constructing and maintaining the footpaths, kerbing, and channelling on its side of the said portion of road, if made.
And I do also further direct that any contribution hereby required to be made as aforesaid by the Epsom Road Board shall be paid from time to time, in the proportion hereinbefore prescribed, out of the funds of the said Board within a period of thirty days after demand in writing made by or on behalf of the Auckland City Council, and that such payments shall be made from time to time to the Town Clerk, Auckland, for and on account of such Road Board.

SCHEDULE.
ALL that portion of road situated between the City of Auckland and the Epsom Road District, known as Boston Road, commencing at its junction with Kyber Pass Road and running in a south-westerly direction to the boundary of the Mount Eden Borough and Epsom Road District, being a distance of 4½ chains; as the said portion of road is more particularly delineated on the plan marked P.W.D. 27905, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured red.
As witness the hand of His Excellency the Governor,
this fourteenth day of June, one thousand nine hundred and eleven.

Warrant vesting Control of Park Avenue and Portion of Carleton Gore Road in the Auckland City Council, and apportioning the Cost of Maintenance of the Same between the said City Council and the Newmarket Borough Council.

ISLINGTON, Governor.
WHEREAS by section twelve of the Public Works Amendment Act, 1909 (hereinafter termed “the said Act”), it is provided that where a road or street lies along the boundary of two or more districts, whether that road or street is wholly within one or is partly within one and is partly within another of those districts, or is within none of those districts, the Governor may from time to time, by Warrant under his hand and gazetted, direct which of the local authorities of those districts shall have control of the road or street or any part thereof; and may also in like manner determine from time to time whether any of those local authorities shall contribute to the cost of the construction or maintenance of that road or street, and, if so, in what proportions :
And whereas the street known as Park Avenue and portion of the street known as Carleton Gore Road, described in the Schedule hereto, and hereinafter termed “the said street” and “portion of street” respectively, form part of the boundary between the City of Auckland and the Borough of Newmarket :
And whereas a dispute has arisen as to which local authority shall have control of the said street and portion of street, and what proportion of the cost of maintaining the said street and portion of street should be borne by the local authorities affected :
And whereas an inquiry was duly held, and a report was made, in respect to the matter :
And whereas it is expedient that effect should be given to the recommendations contained in the said report, and that provision should be made for the purposes and in the manner hereinafter set forth :
Now, therefore, I, John Poynder Dickson-Poynder, Baron Islington, the Governor of the Dominion of New Zealand, in pursuance and in exercise of the power and authority vested in me by the said Act, and of all other powers and authorities in anywise enabling me in this behalf, do hereby direct that, from and after the date of this Warrant, the control and maintenance of the said street and portion of street shall be as provided for in an agreement made between the Auckland City Council and the Borough of Newmarket—viz., the Auckland City Council shall, at its own expense, control and maintain that part of Carleton Gore Road between the Borough of Newmarket and the City of Auckland, with the exception of the footpath, channelling, and kerbing on the Newmarket side of the said portion of Carleton Gore Road, which shall be kept and maintained by the Newmarket Borough Council.
And I do also hereby further direct that Park Avenue shall be under the control of the Auckland City Council, and the Newmarket Borough Council shall pay to the Auckland City Council half the cost of constructing and maintaining Park Avenue aforesaid, and the other half of such cost shall be paid by the Auckland City Council; with the exception that the footpaths, kerbing, and channelling on each side of the aforesaid Park Avenue shall be constructed and maintained by the aforesaid Councils to whose districts they are respectively contiguous.
And I do also further direct that any contribution hereby required to be made as aforesaid by the Newmarket Borough Council shall be paid from time to time in the proportion hereinbefore prescribed, out of the funds of the said Council, within a period of thirty days after demand in writing made by or on behalf of the Auckland City Council, and that such payments shall be made from time to time to the Clerk of the Auckland City Council for and on account of the Newmarket Borough Council.

SCHEDULE.
ALL that street situated between the City of Auckland and the Borough of Newmarket, known as Park Avenue, commencing at its junction with Park Road, in the said city and borough, and proceeding in a southerly direction to its junction with Carleton Gore Road, in the said city and borough, being a distance of 13 chains, more or less.
Also all that portion of street situated between the City of Auckland and the Borough of Newmarket, known as Carleton Gore Road, commencing at its junction with the aforesaid Park Avenue and proceeding in a westerly direction to the westernmost boundary of the Borough of Newmarket, being a distance of 3 chains, more or less.
As the said street and portion of street are more particularly delineated on the plan marked P.W.D. 27905, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured red.
