authorize the Council of the County of Hawke’s Bay to execute the work; and I do hereby declare that the cost thereof, less such contribution as may be made thereto (if any) by the Government of New Zealand, shall be borne by the Council of the County of Hawke’s Bay and the Council of the County of Wairoa in the following proportions, in terms of an agreement entered into between the Hawke’s Bay County Council and the Wairoa County Council, and dated the twenty-first day of March, one thousand nine hundred and eleven, viz. :

Within twelve months after the issue of this Warrant the Wairoa County Council shall pay to the Hawke’s Bay County Council a sum of money equivalent to one-fourth part of the total estimated cost of building and making safe and convenient the said work, and of constructing all such works as the engineer in charge may deem necessary for the protection thereof: Provided always that the Wairoa County Council shall not be liable under this clause for the payment of any greater sum than eight hundred pounds: Provided, further, that in case the Hawke’s Bay County Council shall raise a loan under the Local Bodies’ Loans Act, 1908, for the purpose of defraying the estimated cost aforesaid, then the Wairoa County Council shall be at liberty to fulfil their obligations under this clause by paying to the Hawke’s Bay County Council in each year during the currency of the said loan the sum of forty pounds (£40), or such lesser sum as may be required of them in this behalf, in satisfaction pro tanto of the yearly charges imposed on the Hawke’s Bay County Council in respect of the said loan; and in such case and subject to the sanction aforesaid the said yearly payments shall be accepted by the Hawke’s Bay County Council as a sufficient performance on the part of the Wairoa County Council of their obligation under this clause—that is to say, their obligation to contribute one-fourth part of the total estimated cost above referred to.

The Hawke’s Bay County Council on their part shall contribute the residue of the total actual cost of constructing the said work—that is, the said bridge, approaches, and protective works; but for the purposes of the agreement any grant or grants in aid they may receive from the General Government shall be reckoned as part of their contribution to the said total cost.

The construction of the said work shall be carried out under the sole and exclusive control of the Hawke’s Bay County Council, and according to their directions and subject to their supervision and to their satisfaction in all things; and for the purposes of the said work the Hawke’s Bay County Council may employ such engineers, contractors, servants, and workmen as they shall choose, and for such respective periods of time and at such respective rates of remuneration or wages as they shall think fit, and they shall be solely responsible for the payment of all costs and expenses of and incidental to the execution of the said work.

In case the Wairoa County Council shall elect to perform the obligation under the agreement by paying the annual sum mentioned in clause 1 hereof, then that annual payment shall not be varied so long as the boundary between the Counties of Wairoa and Hawke’s Bay shall remain unchanged; but if at any future time any change shall be made in the said boundary so as to include in the County of Hawke’s Bay some portion of the present County of Wairoa, or so as to include in the County of Wairoa some portion of the present County of Hawke’s Bay, then and in any such case the parties hereto shall make as between themselves a fair and equitable readjustment and reapportionment of the cost of the said work: Provided that if the said parties shall fail to agree with regard to the terms of the said readjustment and reapportionment, then the same shall be made on their behalf by the Commissioner of Crown Lands for the Land District of Hawke’s Bay, whose decision shall be final and without appeal.
And I do hereby further direct that any contribution hereby required to be made as aforesaid by the Council of the County of Wairoa shall be paid from time to time respectively in the proportion hereinbefore prescribed out of the funds of the said county, within a period of thirty days after demand in writing made by or on behalf of the Hawke’s Bay County Council, and all such payments shall be made from time to time to the Clerk of the Hawke’s Bay County Council for and on behalf of the Wairoa County Council.

SCHEDULE.
That bridge over the Esk or Petane River at a point on the main road from Napier to Wairoa, distant about nine miles from the Napier Post-office, and being within the boundaries of the County of Hawke’s Bay; as the site of the said bridge is more particularly delineated on the plan marked P.W.D. 28562, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Land District, and thereon shown in red colour.
As witness the hand of His Excellency the Governor, this eighth day of April, one thousand nine hundred and eleven.
