PLUNKET, Governor.

WHEREAS by a Warrant dated the ninth day of June, one thousand nine hundred and six, and published in the New Zealand Gazette of the fourteenth day of the same month, the control of the bridge known as the Clarence Bridge (which bridge, together with the protective and other works in connection therewith, as described in the Schedule hereto, is and are hereinafter collectively termed “the said bridge”) was vested in the Kaikoura County Council in terms of section one hundred and nineteen of the Public Works Act, 1905, and the cost of maintenance of the said bridge was apportioned in the manner set forth in the said Warrant; but the said Council has recently applied for a reapportionment of such cost:

And whereas the Public Works Act, 1905, was repealed by the Public Works Act, 1908:

And whereas an inquiry as to the necessity for such reapportionment has recently been held by a Commissioner duly appointed in that behalf by His Excellency the Governor, and such Commissioner has reported to the Governor his opinion thereon:

And whereas it is considered expedient to revoke the said Warrant and to make provision in lieu thereof, under the powers granted by section one hundred and twenty of the said Act, for the purposes and in the manner herein-after set forth:

Now, therefore, I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, in pursuance and in exercise of the power and authority vested in me by the said Act, and of all other powers and authorities in anywise enabling me in this behalf, do hereby revoke the said Warrant, and in lieu thereof do hereby direct that the said bridge shall, from and after the date of this Warrant, be under the exclusive care, control, and management of the Awatere Road Board; and, in further pursuance of the aforesaid powers and authorities, I do hereby fix and determine that the cost of maintaining, repairing, improving, or reconstructing the said bridge shall be apportioned as follows: The Kaikoura County Council to bear forty-five per centum, the Awatere Road Board to bear forty-five per centum, the Wairau Road Board to bear five per centum, the Omaka Road Board to bear two and a half per centum, and the Pelorus Road Board to bear two and a half per centum of such cost respectively.

And I do also further direct that any contribution hereby required to be made as aforesaid by the Council of the County of Kaikoura and the Boards of the Road Districts of Wairau, Omaka, and Pelorus shall be paid from time to time in the proportion hereinbefore prescribed out of the funds of the said county or road districts respectively, within a period of thirty days after demand in writing made by or on behalf of the Awatere Road Board, and such payments shall be made from time to time to the Clerk of that Road Board for and on account of such Council and Road Boards.
