Exempting Portion of Rodrigo Road, Kilbirnie, in the City of Wellington, from the Provisions of Section 117 of the Public Works Act, 1908, subject to certain Conditions as to the Building-line.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twentieth day of June, 1910.

Present :

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council :

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that such approval may be either absolute or subject to such conditions as the Governor by Order in Council thinks fit to impose :

And whereas on the twenty-fourth day of February, one thousand nine hundred and ten, the Council of the City of Wellington, the local authority having control of that portion of street, known as Rodrigo Road, described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said portion of Rodrigo Road :

And whereas it is deemed expedient that such resolution should be approved, subject to the condition hereinafter mentioned :

Now, therefore, His Excellency the Administrator of the Government of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution, subject to the condition that no building or part of a building shall at any time be erected on either side of the said portion of Rodrigo Road within a distance of thirty-three feet from the centre-line of such portion of Rodrigo Road.


SCHEDULE.

All that portion of street in the City of Wellington, known as Rodrigo Road, Kilbirnie, commencing at a point about half a chain from the junction of Duncan Terrace and the said Rodrigo Road, and proceeding towards Childers Terrace for a distance of 19 chains, more or less ; as the said portion of street is more particularly delineated on the plan marked P.W.D. 26427, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured red, and lettered A.B.

Revoking an Order in Council taking Land in Block XIII, Opoti Survey District, for a Cemetery.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twentieth day of June, 1910.

Present :

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL.

WHEREAS by the Public Works Amendment Act, 1909, it is enacted that if at any time after the issue or making of any Order in Council taking land under the Public Works Act, 1908, and before the payment or award of any compensation in respect of the taking thereof, it is found that any error in form or substance exists in or

in relation to that Order in Council, the Governor may, by a subsequent Order in Council gazetted, revoke the former Order in Council, either wholly or so far as he thinks necessary : And whereas it is found that the Order in Council taking land for a cemetery in Paeroa No. 2 Block, Block XIII, Opoti Survey District, made under the Public Works Act, 1905, dated the eighteenth day of February, one thousand nine hundred and eight (hereinafter termed “the said Order in Council”), and published in the New Zealand Gazette Nos. 12, 15, 16, and 19, pages 612, 737, 781, and 839, of the twentieth and twenty-seventh days of February of the said year, and the fifth and twelfth days of March following, contains an error both in form and in substance : And whereas compensation in respect of the taking of the said land has not been paid or awarded :

Now, therefore, in pursuance and in exercise of the powers vested in him by the Public Works Amendment Act, 1909, and of all other powers in anywise enabling him in this behalf, His Excellency the Administrator of the Government of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the said Order in Council.

WHEREAS by the Public Works Amendment Act, 1909, it is enacted that if at any time after the issue or making of any Order in Council taking land under the Public Works Act, 1908, and before the payment or award of any compensation in respect of the taking thereof, it is found that the land or any part thereof is not required for the purpose for which it was taken, the Governor may, by a subsequent Order in Council gazetted, revoke the former Order in Council, either wholly or so far as he thinks necessary : And whereas it is found that the whole of certain land in Paeroa No. 2, Block XIII, Opoti Survey District, taken for a cemetery-site by an Order in Council made under the Public Works Act, 1905, dated the twenty-seventh day of November, one thousand nine hundred and five (hereinafter termed “the said Order in Council”), and published in the New Zealand Gazette Nos. 107, 109, and 112, pages 2818, 2865, 2950, of seventh, fourteenth, and twenty-first days of December, one thousand nine hundred and five, and in Gazette No. 1, page 4, of the eleventh day of the month following, is not required for the purpose for which it was taken : And whereas compensation in respect of the taking of the said land has not been paid or awarded :

Now, therefore, in pursuance and in exercise of the powers vested in him by the Public Works Amendment Act, 1909, and of all other powers enabling him in this behalf, His Excellency the Administrator of the Government of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the said Order in Council.
