Domain Board appointed to have Control of the Spreydon and Halswell Domain.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twentieth day of June, 1910.
Present:
HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL.
IN pursuance and exercise of the powers and authorities conferred by the Public Reserves and Domains Act, 1908 (hereinafter termed “the said Act”), His Excellency the Administrator of the Government of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke a certain Order in Council, dated the twenty-ninth day of August, one thousand nine hundred and four, delegating powers to the Spreydon and Halswell Domain Board, and doth hereby appoint
HUGH EAGLESOME,
ARTHUR JOHN BIRDLING,
SAMUEL HUMPHREYS,
JOHN ECCLES FERGUSON,
EDWARD PATERSON,
OWEN MCGOUGH,
PERCIVAL CHARLES TRIGGS, and
HARRY COX
to be the Spreydon and Halswell Domain Board, having, subject to the said Act, control of the land described in the Schedule hereto, which land is a public domain, and shall be called the Spreydon and Halswell Domain; and also doth hereby appoint Monday, the twenty-fifth day of July, one thousand nine hundred and ten, at half past seven o’clock p.m., as the time when, and the Road Board Office, Halswell, as the place where, the first meeting of the Board shall be held.

SCHEDULE.
SPREYDON AND HALSWELL DOMAIN.
ALL that area in the Canterbury Land District, containing by admeasurement 20 acres, more or less, being Reserve No. 110 (in red), situate in Block XIV, Christchurch Survey District. Bounded towards the north-west by the Lower Lincoln Road; towards the north-east by Rural Section No. 379; and towards the south by Rural Section No. 1072 and Reserve No. 128: as the same is delineated on the plan marked L. 1367, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

Exempting North Esk Street, in the City of Nelson, from the Provisions of Section 117 of the Public Works Act, 1908, subject to certain Conditions as to the Building-line.

At the Government House, at Wellington, this twentieth day of June, 1910.

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL.
WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:
And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, it is provided that such approval may be either absolute or subject to such conditions as the Governor by Order in Council thinks fit to impose:
And whereas on the eighteenth day of March, one thousand nine hundred and ten, the Nelson City Council, the local authority having control of the street described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said street:
And whereas it is deemed expedient that such resolution should be approved, subject to the condition hereinafter mentioned:
Now, therefore, His Excellency the Administrator of the Government of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution, subject to the condition that no building or part of a building shall at any time be erected on either side of the said street within a distance of thirty-three feet from the centre-line of such street.

SCHEDULE.
ALL that street known as North Esk Street, in the City of Nelson, Nelson Land District, commencing at its junction with Kawai Street, and proceeding in a north-westerly direction generally along the frontages of Sections 1117, 1118, 1115, and 1114, across Vanguard Street, and along the north-eastern frontage of Victory Square to its junction with St. Vincent Street; all in the City of Nelson; as the said street is more particularly delineated on the plan marked P.W.D. 26347, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured red.

Exempting Road through Bon Accord Estate, in Blocks XXXIII, XL, XLIII, and XLIV, Tokomairiro Survey District, from the Provisions of Section 117 of the Public Works Act, 1908.

Now, therefore, His Excellency the Administrator of the Government of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution in so far as it affects the said portion of road described in the Schedule hereto.
