ISLINGTON, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this fifth day of December, 1910.
Present:
His Excellency The Governor in Council.
ON the recommendation of the Native Land Purchase Board, referred to in section three hundred and sixty-three of the Native Land Act, 1909, and in exercise of the power in this behalf conferred upon him by that section, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council thereof, doth hereby prohibit for the period of one year from the date of this Order in Council all alienations of the Native lands specified in Schedule 1 and Schedule 2 to the Parliamentary Paper G.-10, Session 1909, Appendix to the Journals of the House of Representatives, other than alienations in favour of the Crown.
J. F. ANDREWS,
Clerk of the Executive Council.
Restricting Fishing in the Oruru River, Mangonui and Whangaroa Acclimatization District.
ISLINGTON, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this fifth day of December, 1910.
Present:
His Excellency The Governor in Council.
WHEREAS it is provided by section 83 of the Fisheries Act, 1908, that the Governor may from time to time, by Order in Council gazetted, make regulations prohibiting or restricting from time to time, for any period the Governor thinks necessary, fishing in any waters in which young fish or spawn have been placed or deposited, or at the mouth or entrance of any such waters, or of any river, or stream, or lake:
And whereas it is desirable to make regulations restricting fishing in the Oruru River, in the Mangonui and Whangaroa Acclimatization District:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the hereinbefore-recited power and authority, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations:—
REGULATIONS.
- No person shall take or kill, or attempt to take or kill, any fish whatsoever, with the exception of eels, with any device whatsoever, in the Oruru River or at the mouth or entrance thereof:
Provided that any fish, with the exception of trout, may be taken or fished for within that portion of the said river extending from the bridge known as “Wilkinson’s Bridge” to and including the mouth or entrance of the said river. - For the purposes of these regulations the mouth or entrance of the said river shall be deemed to include every outlet of the same and the sea-shore between such outlets, and shall extend for a radius of five hundred yards from the point or line where the waters of such river meet those of the sea at low-water spring tides.
- Any person committing a breach of the above regulations shall be liable to a fine not exceeding £5.
J. F. ANDREWS,
Clerk of the Executive Council.
Validating the Public Notification of the Notice of making and levying a Special Rate as Security for a Special Loan of £300, being the Westport Borough Council's Share of the Cost of the Erection of the Orowaiti Bridge.
ISLINGTON, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this fifth day of December, 1910.
Present:
His Excellency The Governor in Council.
WHEREAS the Westport Borough Council, on the twenty-first September, one thousand nine hundred and ten, passed a special order which was confirmed on the twenty-first day of October, one thousand nine hundred and ten, making and levying a special rate of seven-five-hundredths of a penny in the pound as security for the purpose of providing the interest and other charges on such loan of three hundred pounds from the New Zealand State-guaranteed Advances Office Superintendent, authorized to be raised in pursuance of a Warrant dated the thirtieth day of September, one thousand nine hundred and nine, issued under the hand of His Excellency the Governor in terms of section one hundred and nineteen of the Public Works Act, 1908:
And whereas the provisions of the Municipal Corporations Act, 1908, were not strictly complied with by the said Council, inasmuch as, although four public notices of intention to levy the said rate were given, such notices were published in two newspapers circulating in the district, instead of one newspaper only:
And whereas it appears that the ratepayers have not been misled by such irregularity, and it is expedient to validate the same:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred by section one hundred and twenty-one of the Local Bodies’ Loans Act, 1908, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the said notice of intention to raise the said rate shall be and be deemed to have been as good, valid, and effectual as if the said notices had been regularly made, and doth hereby validate the same accordingly; and doth hereby also declare the proceedings relative to the said loan shall not be called into question by reason only of the irregularity aforesaid.
