In consideration of the concessions and privileges granted by this Order in Council, the licensees shall, on being supplied with a copy thereof, pay to the Minister the sum of two pounds ten shillings, and thereafter an annual sum of one pound in advance, such annual payments to date from the date hereof.

The rights, powers, and privileges conferred by this Order in Council shall continue in force for fourteen years, computed from the date of this Order in Council, unless in the meantime such rights, powers, and privileges shall be altered, modified, or revoked by competent authority; and the licensees shall not assign, charge, or part with any such right, power, or privilege without the previous written consent of the Minister first obtained.

The said rights, powers, and privileges may be at any time resumed by the Governor, and the licensees may be required to remove the wharf and tramway at their own cost, without payment of any compensation whatever, on giving to the licensees three months' previous notice in writing. Any such notice shall be sufficient if given by the Minister and delivered at or posted to the last known address of the licensees or either of them in New Zealand.

The licensees shall maintain the above-mentioned wharf and tramway in good order and repair, and shall at all times exhibit therefrom, and maintain at their own cost, suitable and necessary lights for the guidance of vessels: Provided that no light shall be exhibited until after it has been approved of by the Minister.

Any person authorised by the Minister may, at all reasonable times, enter upon the said wharf and tramway and view the state of repair thereof; and upon such Minister leaving at or posting to the last known address of the licensees, or either of them, a notice in writing of any defect or want of repair in such wharf and tramway, requiring them, within a reasonable time, to be therein prescribed, to repair the same, they shall with all convenient speed cause such defect to be removed or such repairs to be made.

The licensees shall be liable for any injury which may be sustained by any vessel or boat in passing the wharf and tramway, or by contact therewith, and which may be occasioned by any default or neglect on their part.

In case the licensees shall—
(1.) Commit or suffer a breach of the conditions hereinbefore set forth, or any of them;
(2.) Cease to use or occupy the said wharf and tramway for a period of thirty days;
(3.) Fail to pay the sums specified in clause three of these conditions; or
(4.) Become bankrupt, or be in any manner brought under the operation of any law in force for the time being relating to bankruptcy,
then and in any of the said cases this Order in Council, and every right, power, or privilege, may be revoked and determined by the Governor in Council without any notice to the licensees or other proceeding whatsoever; and publication in the New Zealand Gazette of an Order in Council containing such revocation shall be sufficient notice to the licensees, and to all persons concerned or interested, that this Order in Council, and the rights and privileges thereby conferred, have been revoked and determined; and upon such revocation the Minister may cause the said wharf and tramway to be removed, and may recover the cost incurred by any such removal from the licensees.
- The construction of the wharf and tramway, or either of them, shall be deemed to be an acceptance by the licensees of the conditions of this Order in Council.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this eighteenth day of August, 1909.
Present:
THE HONOURABLE GEORGE FOWLDS PRESIDING IN COUNCIL.
WHEREAS the land described in the Schedule hereto has been duly set apart for sewage purposes:
And whereas, in the opinion of the Governor, it is expedient to vest the said reserve in the Wallace and Fiord Hospital Contributors (Incorporated):
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities vested in him by the fourth section of “The Public Reserves and Domains Act, 1908,” doth hereby declare that, from and after the day of the date hereof, the reserve described in the Schedule hereto shall become vested in the Wallace and Fiord Hospital Contributors (Incorporated), in trust, as a reserve for sewage purposes.
SCHEDULE.
ALL that area in the Southland Land District, containing by admeasurement 2 roods, more or less, being Sections Nos. 5 and 14, Block XIX, Town of Riverton. Bounded towards the north-east by Lansdowne Place, 100 links; towards the south-east by Sections Nos. 13 and 6, Block XIX, Town of Riverton, 500 links; towards the south-west by Lucknow Street, 100 links; and towards the north-west by Sections Nos. 4, 3, 2, and 1, Block XIX aforesaid, 500 links: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. 48344/13, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

Notifying Lands in Auckland Land District for Sale by Public Auction.

IN pursuance of the powers and authorities conferred upon me by the one-hundred-and-twenty-sixth section of “The Land Act, 1908,” I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, do hereby appoint Friday, the twenty-second day of October, one thousand nine hundred and nine, as the time at which the lands enumerated in the Schedule hereto shall be sold by public auction; and I do hereby fix the prices at which the said lands shall be sold as those mentioned in the said Schedule hereto.

Mangati Village is situated about the centre of the Te Akau Block, about twenty-nine miles from Ngaruawahia Railway-station, and about twelve miles from Raglan. The land is level to undulating, and of good quality; very largely in grass. Good building-sites on all sections.

IN pursuance and exercise of the powers and authorities conferred upon me by “The Land Act, 1908,” I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, having received the report of the Under-Secretary in this behalf, as provided in section one hundred and fifty-four of the said Act, do hereby declare that the lands described in the Schedule hereto shall be open for sale or selection on Monday, the eighteenth day of October, one thousand nine hundred and nine; and also that the lands mentioned in the said Schedule may, at the option of the applicant, be purchased for cash, or be selected for occupation with right of purchase, or on renewable lease; and I do hereby also fix the prices at which the said lands shall be sold, occupied, or leased, as mentioned in the said Schedule hereto, and do declare that the said lands shall be sold, occupied, or leased under and subject to the provisions of “The Land Act, 1908.”
