Regulations under which Advances may be made to Occupiers of Land in Rangataua Village Settlement.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this eighteenth day of August, 1909.

Present:

THE HONOURABLE GEORGE FOW LDS PRESIDING IN COUNCIL.

WHEREAS by section two hundred and four of “The Land Act, 1908,” it is enacted that the Governor in Council is authorised to make regulations under which advances of money may be made by the Minister of Finance from any sums voted for the purpose by Parliament to occupiers of village-settlement lands under section two hundred and three of the said Act, in order that they may be enabled to profitably occupy their respective allotments:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations upon which advances of money may be made to occupiers of lands in Rangataua Village Settlement, Wellington Land District:—

REGULATIONS.

  1. An advance of a sum not exceeding £50 may be made to the lessee within the first five years from the date of selection towards the cost of fencing, and building a dwellinghouse.

  2. Applications for advances must be made to the Commissioner of Crown Lands, at Wellington.

  3. No advance shall exceed three-fourths the value of the fencing and building erected, or to be erected, by the lessee upon his section.

  4. No advance shall be made save on the written certificate of an Inspector appointed in that behalf by the Land Board, specifying the total value of the work done by the lessee, the amount to which tenders have been accepted for the erection of any fencing and building, and the amount of the advance to which he is entitled, and certifying that such work has been well and faithfully done and to the Inspector’s satisfaction.

  5. Such advance, together with interest thereon at the rate of 5 per cent. per annum computed from the date of advance, shall be repayable by the lessee by equal half-yearly instalments in advance, extending over such period, being not less than five nor more than ten years, as, with the approval of the Minister, the Land Board thinks fit to prescribe. All such payments shall be made to the Receiver of Land Revenue, at Wellington, on the half-yearly rent-days: Provided that the lessee may at any time during such period repay the whole or any less number of the then future instalments under a duly proportionate rebate of interest.

  6. A certificate under the hand of the said Commissioner shall at all times and from time to time be conclusive evidence as to the date and amount of the advance, the amounts and due dates of the instalments, and the sums paid and unpaid in respect thereof.

  7. As long as any instalment remains unpaid, the lessee shall insure all buildings and erections in the name of His Majesty, in a sum equal to the full insurable value thereof, and for the purposes of this provision the covenant for insurance set out in the Fifth Schedule to “The Land Transfer Act, 1908,” shall be implied in the lease.

Declaring Roads known as Pitt and Findlay Streets, in the Ellerslie Town District, to be Town District Roads.

IN pursuance and in exercise of the powers vested in him by “The Public Works Act, 1908,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the roads described in the Schedule hereto shall, on and after the date of this Order in Council, be town district roads.

SCHEDULE.

PITT AND FINDLAY STREETS.

ALL that road in the Auckland Land District, Eden County and Ellerslie Town District, known as Pitt Street, commencing as its junction with Millar Street, and proceeding thence towards the north-east along the boundaries of Allotments 48, 47, 33, 32A, 31A, and 12, Lawry Settlement, to its junction with Panmure Road.

Also all that road in the Auckland Land District, Eden County and Ellerslie Town District, known as Findlay Street, commencing at its junction with Pitt Street, and proceeding thence in a north-westerly direction along the northern boundaries of Allotments 44, 43, and 42, Lawry Settlement, to its junction with the Auckland-Rotorua Railway.

As the said roads are more particularly delineated on the plan marked P.W.D. 25018, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured red, and lettered respectively A.B. and C.D.

Licensing McCallum and Company to use and occupy a Part of the Foreshore at Kaipipi Bay, Stewart Island, as a Site for a Wharf and Tramway.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this eighteenth day of August, 1909.

Present:

THE HONOURABLE GEORGE FOW LDS PRESIDING IN COUNCIL.

WHEREAS, there being no Harbour Board empowered to grant the license hereinafter mentioned, Archibald McCallum and William Asher, of Invercargill, trading under the style or title of “McCallum and Company” (hereinafter called “the licensees”), have applied to the Governor in Council for a license under “The Harbours Act, 1908” (hereinafter called “the said Act”), to occupy a part of the foreshore and land below low-water mark at Kaipipi Bay, Stewart Island, in order to construct and maintain thereon a wharf and tramway; and, in accordance with the one-hundred-and-fiftieth section of the said Act, have deposited a plan in the office of the Marine Department at Wellington (marked M.D. 3368) showing the place where it is intended to construct such tramway, the area of foreshore and land below low-water mark intended to be occupied for such purpose, and the manner in which it is proposed to carry out the work: And whereas it has been made to appear to the Governor in Council that the proposed work will not be or tend to the injury of navigation, and the said plan has, prior to the making of this Order in Council, been approved by the Governor in Council: And whereas it is expedient that a license under the said Act, for the purpose aforesaid, should be granted and issued to the licensees on the terms and conditions hereinafter expressed:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the said Act, and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the purpose or object for which the said license is required by the licensees as aforesaid; and, in further pursuance and exercise of the said power and authority, and with the like advice and consent as aforesaid, doth hereby license and permit the licensees to use and occupy that part of the foreshore and land below low-water mark which is particularly shown and delineated on the plan so deposited as aforesaid, for the purpose of constructing thereon a wharf and tramway in accordance with the said plan; such license to be held and enjoyed by the licensees upon and subject to the following terms and conditions, that is to say:—

  1. In these conditions the term “Minister” means the Minister of Marine, as defined by “The Shipping and Seamen Act, 1908,” and includes any officer, person, or authority acting by or under the direction of such Minister.

  2. The concessions and privileges conferred by this Order in Council shall extend and apply only to the part of the foreshore and land below low-water mark necessary for the construction of the wharf and tramway as shown on plan M.D. 3368.
