3. His Majesty or the Governor, and all officers in the Government service acting in the execution of their duty, shall at all times have free ingress, passage, and egress into, through, and out of the said wharf without payment.

4. The Board shall complete the erection of the said wharf in accordance with the approved plans marked M.D. 3273, within twelve calendar months from the date of this Order in Council.

5. The Board shall maintain the above-mentioned wharf in good order and repair, and shall at all times exhibit therefrom, and maintain at its own cost, suitable and necessary lights for the guidance of vessels: Provided that no light shall be exhibited until after it has been approved of by the Minister.

6. Any person authorised by the Minister may, at all reasonable times, enter upon the said wharf and view the state of repair thereof; and upon such Minister leaving at or posting to the last known address of the Board a notice in writing of any defect or want of repair in such wharf, requiring the Board, within a reasonable time, to be therein prescribed, to make good the same, the Board shall with all convenient speed cause such defect to be removed or such repairs to be made, as the case may be.

7. Nothing herein contained shall authorise the Board to do or cause to be done anything repugnant to or inconsistent with any law relating to the Customs, or any regulation of the Minister of Customs, or with any provisions of “The Harbours Act, 1908,” or any regulations made thereunder, and that are now or may hereafter be in force.

8. The rights, powers, and privileges conferred by or under this Order in Council shall continue in force for fourteen years from the date hereof, unless in the meantime such rights, powers, and privileges shall be altered, modified, or revoked by competent authority; and the Board shall not assign, charge, or part with any such right, power, or privilege without the previous written consent of the Minister first obtained.

9. The Board may make such charges for the use of the wharf as may be approved of by the Minister of Marine.

10. The said rights, powers, and privileges may be at any time resumed by the Governor, without payment of any compensation whatever, on giving to the Board three calendar months’ previous notice in writing. Any such notice shall be sufficient if given by the Minister and delivered at or posted to the last known address of the Board.

11. The Board shall be liable for any injury which the said wharf may cause any vessel or boat to sustain through any default or neglect on its part.

12. In case the Board shall—
    (1.) Commit or suffer a breach of the conditions hereinbefore set forth, or any of them; or
    (2.) Cease to use or occupy the said wharf for the purposes aforesaid for a period of thirty days,
    then and in either of the said cases this Order in Council, and every license, right, power, or privilege thereby conferred, may be revoked and determined by the Governor in Council without any notice to the Board or other proceeding whatsoever; and publication in the New Zealand Gazette of an Order in Council containing such revocation shall be sufficient notice to the Board, and to all persons concerned or interested, that this Order in Council, and the license, rights, and privileges thereby granted and conferred, have been revoked and determined.

13. The erection of the said wharf shall be sufficient evidence of the acceptance by the Board of the terms and conditions of this Order in Council.

Domain Board appointed to have Control of the Blackball Domain.

WHEREAS by section forty of “The Public Reserves and Domains Act, 1908” (hereinafter termed “the said Act”), it is enacted that the Governor may from time to time, with respect to any public domain, appoint such persons (not exceeding nine) as he thinks fit to be a Domain Board having, subject to the said Act, control of such domain:

And whereas by an Order in Council made on the seventeenth day of December, one thousand nine hundred and eight, and published in the New Zealand Gazette of the twenty-third day of December, one thousand nine hundred and eight, the land described in the Schedule hereto was brought under the operation of and declared to be subject to the provisions of Part II of the said Act:

And whereas it appears expedient to appoint a Domain Board to control the said domain:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in exercise of the powers conferred by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

SCHEDULE.

BLACKBALL DOMAIN.

ALL that area in the Westland Land District, containing by admeasurement 7 acres, more or less, being Reserve No. 1297, Block II, Mawheranui Survey District, Grey County. Bounded by a line commencing at a point marked “A” on the plan hereinafter referred to (the said point being on the south side of the public road forming the south-eastern boundary of the Blackball Township), and proceeding thence in a south-westerly direction along a line bearing S. 3° 17′ W., a distance of 1242·8 links, to a point marked “B” on the plan hereinafter referred to; thence again in a south-westerly direction along a line bearing S. 60° W., a distance of 610 links; thence in a north-westerly direction along a line bearing N. 39° 38′ W., a distance of 162·5 links; thence again in a north-westerly direction along a line bearing N. 2° 23′ W., a distance of 425 links; thence in a north-easterly direction along a line bearing N. 49° 30′ E., a distance of 250 links; thence again in a north-easterly direction along a line bearing N. 28° 25′ E., a distance of 250 links; and thence again in a north-easterly direction along a line bearing N. 60° 12′ E., a distance of 568·1 links, to point A aforesaid, the place of commencement: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. 40128/13, deposited in the Head Office, Department of Lands, at Wellington, and thereon coloured red.
