any class of persons for a longer period than is permitted by subsection one of the said section sixteen:

And whereas, in the opinion of the Governor, it is expedient that, in respect to the hereinafter-mentioned persons employed in the Electoral Department, the period of temporary employment should be extended from ten to twelve months in the case of the first-mentioned person and from twelve to eighteen months in the case of the other three persons:

Now, whereas His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by the said Act, and acting by and with the consent of the Executive Council of the said Dominion, doth hereby authorise the temporary employment of the persons employed in the Electoral Department included in the Schedule hereto for twelve months in the case of the first-mentioned person and for eighteen months in the case of the other three persons.

WHEREAS by Order in Council dated the twenty-eighth day of April, one thousand nine hundred and three, and published in the New Zealand Gazette of the seventh day of May, one thousand nine hundred and three, regulations were made under “The Post Office Act, 1900,” for the conduct of the Post-Office Savings-Bank, and it is expedient to alter and amend such regulations in the manner hereinafter set forth:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred on him by “The Post and Telegraph Act, 1908,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the regulation set forth in the Schedule hereto, and doth order that it shall be added to and shall form part of the regulations hereinbefore mentioned as number 57A, and doth declare that such regulation shall have effect on and after the date of the publication of this Order in Council in the New Zealand Gazette.


SCHEDULE.

MINIMUM AMOUNT OF DEPOSIT FOR CREDIT OF ACCOUNT OPEN IN ANOTHER POSTAL DISTRICT.

57A. The minimum amount which may be deposited at any one time for credit of a savings-bank account open in a postal district other than that in which such deposit is tendered shall not be less than five pounds (£5).

Varying Close Season for Mullet in North Island.

WHEREAS by Order in Council dated the twenty-ninth day of July, one thousand nine hundred and seven, and published in the New Zealand Gazette No. 67, of the first day of August, one thousand nine hundred and seven, regulations were made prescribing a close season for the species of Mugil known as mullet or kanae in the North Island of New Zealand:

And whereas by Orders in Council dated the twenty-fifth day of November, one thousand nine hundred and seven, the seventh day of December, one thousand nine hundred and seven, and the fourteenth day of January, one thousand nine hundred and nine, such close season was varied:

And whereas it is desirable to further vary such close season:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by “The Fisheries Act, 1908,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulation by way of further amendment to the hereinbefore-recited Order in Council of the twenty-ninth day of July, one thousand nine hundred and seven, and of the regulations made thereby:—

REGULATION.

The close season for the species of Mugil known as mullet or kanae in the North Island of New Zealand, which was prescribed by regulations made by Order in Council dated the 29th day of July, 1907, shall not operate or have effect in the waters of the Dominion as defined by the said Act on the eastern portion of the east coast of the North Island between Cape Karaka, Rangaunu Bay, and the south head of Whangaruru Harbour.

Licensing the Wairoa Road Board to use and occupy a Part of the Foreshore of the Wairoa River, Auckland.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twentieth day of January, 1909.

Present:

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G.,
PRESIDING IN COUNCIL.

WHEREAS, there being no Harbour Board empowered to grant the license hereinafter mentioned, the Wairoa Road Board (hereinafter called “the Board”) has applied to the Governor in Council for a license, under “The Harbours Act, 1908” (hereinafter called “the said Act”), to occupy a part of the foreshore and land below low-water mark of the Wairoa River, at Clevedon, in order to erect and maintain thereon a wharf; and, in accordance with the one-hundred-and-fiftieth section of the said Act, has deposited plans, in duplicate (two sheets), in the office of the Marine Department at Wellington (marked M.D. 3273) showing the place where it is intended to erect such wharf, the area of foreshore and land below low-water mark intended to be occupied for such purpose, and the manner in which it is proposed to erect the wharf: And whereas it has been made to appear to the Governor in Council that the proposed work will not be or tend to the injury of navigation, and the said plans have, prior to the making of this Order in Council, been approved by the Governor in Council, without modification or addition: And whereas it is expedient that a license under the said Act, for the purpose aforesaid, should be granted and issued to the Board on the terms and conditions hereinafter expressed:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the said Act, and of all other powers and authorities enabling him in that behalf, and by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the purpose or object for which the said license is required by the Board as aforesaid; and, in further pursuance and exercise of the said power and authority, and with the like advice and consent as aforesaid, doth hereby license and permit the Board to use and occupy that part of the foreshore and land below low-water mark which are particularly shown and delineated on the plans marked M.D. 3273 so deposited as aforesaid, for the purpose of constructing or erecting thereon a wharf; such license to be held and enjoyed by the Board upon and subject to the following terms and conditions, that is to say:—

  1. In these conditions the term “Minister” means the Minister of Marine, as defined by “The Shipping and Seamen Act, 1903,” and includes any officer, person, or authority acting by or under the direction of such Minister.

  2. The concessions and privileges conferred by this Order in Council shall extend and apply only to the parts of the foreshore and land below low-water mark necessary for the erection of such wharf, which are shown on the plans marked M.D. 3273, and deposited in the office of the Marine Department as aforesaid.
