Cancelling Conditions as to setting back the Building-line of Bond Street, Auckland, imposed by an Order in Council under Section 117 of “The Public Works Act, 1908.”

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twentieth day of January, 1909.

WHEREAS by section three, (1), of “The Public Works Act Amendment Act, 1908,” it is enacted that when by an Order in Council issued in pursuance of section one hundred and seventeen of “The Public Works Act, 1905,” as amended by section three of “The Public Works Act, 1906,” conditions have been imposed with respect to the building-line in the case of any street or road exempted from the provisions of those sections, the Governor may from time to time, by Order in Council, on the application of the local authority having control of that road or street, amend the first-mentioned Order in Council by cancelling or varying the conditions imposed thereby, and any such cancellation or variation may extend to the whole or to any part or parts of the said road or street:
And whereas by an Order in Council dated the twenty-third day of September, one thousand nine hundred and seven, exempting the street described in the Schedule hereto, and known as Bond Street, Arch Hill, Auckland, from the provisions of section one hundred and seventeen of “The Public Works Act, 1905,” published in New Zealand Gazette, page 2907, the condition was imposed “that no building or part of a building shall at any time be erected on either side of the said street within a distance of thirty-three feet from the centre-line of the said street”:
And whereas the Arch Hill Road Board, the local authority having control of the street, has made application that the said Order in Council may be amended by striking out the condition with regard to the building-line, and it is desirable that such application should be granted:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend the said Order in Council by cancelling the condition “that no building or part of a building shall at any time be erected on either side of the said street within a distance of thirty-three feet from the centre-line of the said street.”
SCHEDULE.
That street known as Bond Street, in the Arch Hill Road District, commencing at its junction with the Great North Road, and proceeding south-east to the watercourse at the southernmost corner of Lot 114 of Original Lot 16 of Section 7, Suburbs of Auckland; being a distance of about 18 chains; as the said street is more particularly delineated on the plan marked R. 8826, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured green.

Exempting Roslyn Road and Shakespeare Terrace, Napier, from the Provisions of Section 117 of “The Public Works Act, 1908.”

WHEREAS by subsection one of section one hundred and seventeen of “The Public Works Act, 1908,” it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:
And whereas by subsection two of section one hundred and seventeen of “The Public Works Act, 1908,” it is provided that such approval may be either absolute or subject to such conditions as the Governor by Order in Council thinks fit to impose:
And whereas on the fourth day of June, one thousand nine hundred and eight, the Council of the Borough of Napier, the local authority having control of the streets known as Roslyn Road and Shakespeare Terrace, being the streets described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said streets:
And whereas it is deemed expedient that such resolution should be approved:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution.
SCHEDULE.
THAT street known as Roslyn Road, in the Borough of Napier, in the Hawke’s Bay Land District, commencing at its junction with Shakespeare Terrace, in Suburban Section 59, in the said borough, and proceeding thence in a north-westerly direction generally through part of Suburban Section 59 and Suburban Sections 57 and 58, and proceeding thence in a north-easterly direction generally through Suburban Section 56 to its junction with the said Shakespeare Terrace; also that street in the said borough and land district known as Shakespeare Terrace, commencing at its junction with Roslyn Road, and proceeding thence in a south-easterly direction generally through Suburban Section 57 and part of Suburban Section 59 to its junction with the said Roslyn Road: as the said streets are more particularly delineated on the plan marked R. 9914, deposited in the office of the Chief Engineer of Roads, at Wellington in the Wellington Land District, and thereon coloured pink and blue respectively.

In pursuance and exercise of the powers conferred by section eleven of “The Surveyors’ Institute and Board of Examiners Act, 1908,” His Excellency the Governor of the Dominion of New Zealand, by and with the advice of the Executive Council thereof, doth hereby appoint, as from the first day of January, one thousand nine hundred and nine, the undermentioned persons to be members of the Surveyors’ Board constituted by the said Act, namely,
