plan D.P. 2736, and described in the said Schedule as a site
for a public pound.
SCHEDULE.
ALL that piece of land, situated at the north-west corner of
Kurow Survey District and Township, being a portion of
that part of the Kurow Recreation Reserve, containing 2 roods,
more or less: bounded, towards the north by Hakataramea
Valley Road, 221.1 links; towards the east by the main road,
221.1 links; towards the south by a line parallel to the north-
ern boundary, 221.1 links; and towards the west by a line
parallel to the western boundary, 221.1 links.

IN pursuance and exercise of the powers and authorities by
section one hundred and three of “The Public Works
Act, 1908,” vested in His Excellency the Governor, and with
in this behalf, His Excellency the Governor of the Dominion
of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, doth hereby
order that the road described in the Schedule hereto shall
be and form the date of this Order in Council, become a
Government road.

Consenting to Land being taken for the Purposes of an Elec-
tric-power Station by the City of Auckland.

ORDER IN COUNCIL.
At the Government House at Wellington, this tenth day
of May, 1909.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by “The Public Works Act, 1908,” (herein-
After called “the said Act”), it is in section fifteen
of the said Act amongst other things enacted that, where any
railway or defence purposes, or for the purposes of any
electric-power station, should, in the opinion of the Governor,
nothing in this Act contained shall authorize the taking of
any part of a public reserve, being a park, or part of a public
recreation-ground, not only, for the purpose of the Governor in Council to take or use
part of any such park or recreation-ground, without the previous consent of
Parliament being obtained:
And whereas an application has been made by the Auck-
land City Council (in this order called the said Council)
under the said Act consenting to the taking of the land
described in the Schedule hereto for the purposes of an
electric-power station required for lighting the streets and
public places of the City of Auckland by electricity and for
the purpose of providing power for industrial uses, which
land, or portions of the said land, are occupied by
pastures:
Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
doth hereby consent to the said Council to so take and use the
land described in the Schedule hereto for the purposes
above mentioned.

Withdrawing Land from the Operation of “The Kaurí-gum
Industry Act, 1909.”
PLUNKET, Governor.
ORDER IN COUNCIL.
At the Government House at Wellington, this tenth day
of May, 1909.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by section three of “The Kaurí-gum
Industry Act, 1908” (hereinafter called “the said
Act”), it is enacted that the Governor may by order in
Council declare that any Crown land shall cease to be a
kaurí-gum reserve, and which is no longer required for the
purposes of such reserve; and, on the publication of the
said Act, and thereupon the land shall cease to be a kaurí-
gum reserve, and may be dealt with as for other Crown
lands which have not been reserved: And where such
Council shall only be issued in pursuance of a resolution of
the Land Board in whose district the land is situated and if
the Governor in Council deems necessary:
And whereas the North Auckland of the Auckland Land
District has duly passed a resolution recommending the
withdrawal of Section No.3 Kauri-gum Reserve, described
in the Schedule hereto, from the operation of the said Act,
Act, and it is expedient to give effect to such recom-
mendation:
Now, therefore, I, William Lee, Baron Plunket, the
Governor of the Dominion of New Zealand, in pursuance
and exercise of the powers and authorities conferred upon
me by section thirty-three of the said Act, and acting by
and with the advice and consent of the Executive Council
of the said Dominion, do hereby order and declare that the
Section 3, Block XII, Whangarei Survey District,
in the Schedule hereto shall be no longer subject to the pro-
visions of the said Act.
SCHEDULE.
ALL that area in the Auckland Land District, containing by
admeasurement 43 acres 0 roods and 14 perches, more or less,
being Section No. 3, Block XII, Whangarei Survey District,
portion of the Mangawhai No. 2 Kauri-gum Reserve, set apart
by Order in Council dated the 27th day of September, 1897,
New Zealand Gazette of 7th May, 1901, page 1080. Bounded
towards the north-east by a public road, 3757 links; towards
the south-east and south, by Crown land; towards the north-
west by Crown land; towards the south-west by Section No. 2, Mangawhai
No. 2 Kauri-gum Reserve, as shown on a plan deposited in the
Department of Lands, at Wellington, and thereon edged red.
