Excepting Land from the Operation of Section 117 of “The
Native Land Court Act, 1894.”

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twentieth
day of April, 1909.

Present:
THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G.,
Presiding in Council.

WHEREAS by section four of “The Native Land
Court Act Amendment Act, 1895,” it is enacted that
section one hundred and seventeen of “The Native Land
Court Act, 1894,” hereinafter called “the principal
Act,” shall not apply to any Native land which by Order
in Council is exempted therefrom: And whereas the conditions
as shall be in such Order specified: And whereas it is desirable to give
to the operation of the said section in respect of the lands hereinafter
described: And whereas it is expedient to make such exemption in
favour exclusively of any person or persons who have, in the opinion of the
Governor, good and sufficient reason for receiving moneys to Native owners
for lease or purchase of Native land or interests therein : And whereas an
Order in Council under the provisions of this section, dated
the twenty-first day of August, one thousand nine hundred
and five, has been heretofore revoked: And whereas
that the Ikaroa District Maori Land Board, by a
resolution dated the second day of December, one thousand
nine hundred and eight, and received on the fifth
day of December, one thousand nine hundred and eight, has recommended
the Governor to except from the operation of the one hundred and seventeen
of the principal Act, for the purpose of the sale, of the block or parcel of
land particularised in the Schedule hereto.

Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and exercise of the
power and authority conferred upon him by section four
of “The Native Land Court Amendment Act, 1895,” and
acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby except the said
land from the operation of section one hundred and seven
teen of “The Native Land Court Act, 1894,” for the purpose
of alienation by way of sale.

SCHEDULE.

All that piece or parcel of land, situate in the Mangahao
Number One-a, Mangahao Number One-b, Mangahao
Number One-c, Number One-d, Number One-e, Number One-f
Blocks, in the Ikaroa Maori Land District, containing
by admeasurement 1,944 acres 3 roods and 14 perches,
more or less.

Thames High School to be subject to the Provisions of
“The Public Bodies’ Leases Act, 1908.”

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twentieth
day of April, 1909.

Present:
THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G.,
Presiding in Council.

WHEREAS the Board of Governors of the Thames
High School, being an incorporated body having the
power to lease lands held by it in trust for public purposes,
but whose leasing-powers are limited, is, in the opinion of
the Governor, a public body within the meaning of “The Public
Bodies’ Leases Act, 1908,” hereinafter called “the said Act”:

Now, therefore, His Excellency William Lee,
Baron Plunket, the Governor of the Dominion of New Zealand,
by and with the advice and consent of the Executive
Council of the said Dominion, and in pursuance and
exercise of the powers and authorities conferred on him by
the said Act, doth hereby order and declare that, from and
after the publication of this Order in Council in the New Zealand
Gazette, the lands for leasing authority, within the meaning
of “The Public Bodies’ Leases Act, 1908.”

Regulations under the “Education Acts”—Staffs and
Salaries of Schools.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twentieth
day of April, 1909.

Present:
THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G.,
Presiding in Council.

IN exercise and pursuance of the powers and authorities
conferred by Part II of “The Education Act, 1908,” and
“The Education Amendment Act, 1908,” the Governor
of the Dominion of New Zealand, by and with the advice and
consent of the Executive Council of the said Dominion, doth
hereby revoke clause eight of the regulations relating to
the staffs and salaries of public schools, published in the
Gazette of the seventh day of February, one thousand nine
hundred and six, and in lieu thereof doth make the regulation hereto
set forth in the Schedule hereto, and doth order and declare
that this Order shall come into force on the date
hereof.

REGULATION.

  1. A average daily attendance, for the purposes of para
    graph (b), (i), of subsection (1) of section 3 of the principal
    Act, shall be computed by dividing the average attendance
    for the quarter immediately preceding.

Authorising Maori Land Board to dispose of Land by way
of Lease without Public Competition.

PLUNKET, Governor.
ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this tenth day
of May, 1909.

Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section eight of “The Native and Maori
Land Laws Amendment Act, 1908,” hereinafter
called “the said Act,” it is provided that the Governor may,
by Order in Council, on the recommendation of the Maori
Land Board, and upon such terms and conditions as he thinks
fit, authorise any Maori Land Board to dispose of several blocks
of Maori land, or any portion thereof, by way of lease under
separate titles, and if so specified in the Board as a site
for a Native township, and without public competition,
being a Maori Land Board site for a Native township:

And whereas by resolution, bearing date the third day
of March, one thousand nine hundred and nine, the said
Board declared the lands comprised therein to be vested
in the Tuauaka-o-te-rangi Native Land Board, and that the
same are suitable for a site for a Native township, and assigned
the said township the name of “Mawherawhera,” and the said
Board has made a recommendation to the Governor that the
lands be leased without public competition:

And whereas by section ten of the said Act it is provided
that every Maori Land Board shall have power and authority
to deal with such lands by way of sale, lease, exchange, or
otherwise, in accordance with the terms of the resolution
and Order in Council relating thereto:

And whereas by regulations under the hand bearing date
the eighteenth day of February, one thousand nine hundred
and three, the Governor prescribed the mode and terms and
conditions under which the said land might be disposed of:

And whereas the said Board has, in its resolution, also
provided that all dealings with allotments other than residential
allotments, in Mawherawhera Native Township, should
be, shall be, for a term not exceeding twenty-one years, at the
rent and upon the terms and conditions prescribed by the said
regulations, either by public auction or public tender, as the
Board may think fit:

And whereas the said regulations do not in all respects con
stitute in and form part of the Tuauaka-o-te-rangi Native Township,
and it is therefore necessary to authorise the Tuauaka-o-te-rangi
Maori Land Board, acting in the capacity of a Maori Land Board,
to dispose of the same
by way of lease, without public competition, for a term not
exceeding twenty-one years:

Now, therefore, His Excellency the Governor of the Do
minion of New Zealand, in pursuance and exercise of the powers
and authorities conferred upon him by the said Act, and of all
other powers him there
unto enabling, and acting by and with the advice and con
sent of the Executive Council thereof, doth hereby authorise
the Mawherawhera Maori Land Board to lease land to
