THE NEW ZEALAND GAZETTE

[No. 39

of the Executive Council of the said Dominion, doth hereby
declare that the said land is set apart for the purposes
and described in the Schedule hereto, is hereby taken for
the purposes of the said Act; and he doth also declare, on behalf of
His Majesty the King, as from the twenty-sixth day of May,
one thousand nine hundred and nine.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twentieth
day of April, 1909.

Present :

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G.
PRESIDING IN COUNCIL.

WHEREAS the land mentioned in the Schedule hereto
is required to be taken for a public work, to wit,
for the purposes of a Native school site:

And whereas the said land is held or occupied by Native
owners, and the title thereto is not derived from the Crown:

And whereas a map of the said land has been prepared in
duplicate, as required by “The Public Works Act, 1908”:

Now, therefore, in pursuance and exercise of the powers
and authorities vested in him by the said Act, His Excellency the Governor of the Dominion of New Zealand, by and with
the advice and consent of the Executive Council of the said
Dominion, doth hereby declare that the land shown in His
Majesty the King as from the second day of June,
one thousand nine hundred and nine.

Native Cemetery, Poh Street, Borough of Motueka, closed
and vested in Trustees.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twentieth
day of April, 1909.

Present :

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G.
PRESIDING IN COUNCIL.

WHEREAS it appears to the Governor that burials in
the Native cemetery, Poh Street, Borough of Motueka,
which said cemetery is described in the Schedule hereto,
should be discontinued, and the land forming the
cemetery not within the limits of any borough or town district, His Excellency the Governor, by and with the advice and
consent of the Executive Council of the Dominion, and in
pursuance and exercise of the powers and authorities
vested in him by the “Cemeteries Act, 1908,” and of
every other power and authority enabling him in that
behalf, doth hereby order and direct, from and after the first
day of May, one thousand nine hundred and nine, that
burials within the Native cemetery in the Borough of
Motueka, described in the Schedule hereunder, shall be
wholly discontinued; and, further, that the said cemetery
land shall be and the same is hereby vested in the Bishop of Nelson and the Vicar for the time being of Motueka,
being persons—namely, John Alexander Thomas Boyce,
Bishop of Nelson, and the Reverend Alexander Hamilton,
Joseph Quayle, Clarence Roy York, all of Motueka, and
Frederick Ernest Cowling, of Lower Moutere—as joint
tenants, subject to the provisions of section eighty-sixth of
the said “Cemeteries Act, 1908.”

SCHEDULE.

All that area in the Nelson Land District being part of
Section 184, Motueka Survey District, and of Motueka
Survey District, containing by admeasurement 1 rood
9 perches, more or less: Bounded towards the north by
other portion of the said Section 184, 100 links; towards the
east by the Native Mission House site, 256 links; towards
the south by a road, 100 links; and towards the west by
on the Crown grant, 482 links ; towards the south by Fah
Street, 100 links ; and towards the west again by a public
road and partly by other portion of the said Section 184,
416 links: all on the Motueka Survey District map.
