Commencing at a point marked A (shown on plan hereinafter referred to) on the eastern side of a public road, distant 669·2 links north of the northernmost corner of the western portion of Section No. 13, Block XVI, Cloudy Bay Survey District, and being bounded thence towards the north-east by the Opawa River to point marked B (shown on plan hereinafter referred to) on the northern side of old Renwick Road; towards the south by the last-mentioned road, 1743·9 links; and towards the south-west by right lines bounding the west portions of Sections Nos. 14 and 13 of the said Block XVI, 1918·6 links, and by a public road, 669·2 links, to point A, the place of commencement: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. 49340/30, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

WHEREAS the Foxton Borough Council lately proposed to raise a loan of three hundred pounds, under “The Local Bodies’ Loans Act, 1908,” for the purpose of forming and metalling Gladstone, Futter, Hetta, Liddell, and Watson Streets, and Ravensworth Place: And whereas the voting-paper used was in the form as contained in “The Local Elections Act, 1904,” instead of Form 1 in the Second Schedule to “The Local Bodies’ Loans Act, 1908”: And whereas it appears that the ratepayers have not been misled by such irregularity, and it is expedient to validate the same:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by section one hundred and twenty-one of “The Local Bodies’ Loans Act, 1908,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby validate the voting-paper so used, and doth hereby declare that the proceedings relative to such loan shall not be called into question by reason only of the irregularity aforesaid.

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred by the said section nine of “The Mining Act, 1908,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint
JAMES RANKIN BARTHOLOMEW, Esquire,
to be a Warden, to hold and exercise the duties of such office under and subject to the provisions of the said Act during pleasure, on and from the twenty-second day of April, one thousand nine hundred and nine.

At the Government Buildings, at Wellington, this twentieth day of April, 1909.

PRESIDING IN COUNCIL.
WHEREAS by subsection one of section one hundred and seventeen of “The Public Works Act, 1908,” it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:
And whereas by subsection two of section one hundred and seventeen of “The Public Works Act, 1908,” it is, inter alia, provided that such approval may be either absolute or subject to such conditions as the Governor by Order in Council thinks fit to impose:
And whereas on the twenty-fourth day of February, one thousand nine hundred and nine, the Council of the City of Dunedin, the local authority having control of the portion of the street known as Bradshaw Street, described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to such portion of the said street:
And whereas it is deemed expedient that such resolution should be approved, subject to the condition hereinafter mentioned:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution, subject to the condition that no building or part of a building shall at any time be erected on the south-western side of the said portion of the street within a distance of seven feet from the present street-line on the south-western side of the said portion of street.
SCHEDULE.
That portion of the street in the Township of Forbury, City of Dunedin, known as Bradshaw Street, fronting Allotments 4, 5, 6, 7, 8, 9, 10, and 11, Block V, Township of Forbury; as the said portion of street is more particularly delineated on the plan marked R. 10704, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured blue.
