And whereas since the commencement of the said Act a town district, called the Pleasant Point Town District, situate within the boundaries of the Northern District, as defined by “The Timaru Harbour Board Amendment Act, 1906,” of the County of Levels, within the said harbour district, has been constituted by Proclamation dated the twelfth day of March, one thousand nine hundred and eight:

And whereas by section twenty-five of the said Act it is provided that, in the event of any alteration in the territorial limits, designation, constitution, or other alteration whatsoever, in any borough, road district, town district, county, or place the ratepayers of which now have, or may hereafter have, the right to vote at the election of one or more members of the said Harbour Board, the Governor may, by Proclamation, make such changes in any or all of the districts or places entitled to elect such members, and in the names of such districts or places as in his opinion such alterations may render desirable:

Provided that the proportion of representation as at present existing shall be interfered with as little as possible by the changes so to be made:

Now, in pursuance and in exercise of the powers and authorities vested in me by section twenty-five of the said Act, I, William Lee, Baron Plunket, Governor of the Dominion of New Zealand, do hereby proclaim and declare that on and from the twenty-fifth day of February, one thousand nine hundred and nine, the electors of the Borough of Geraldine, situated within the Timaru Harbour District, shall be entitled to vote at the election of a member of the said Harbour Board for the Geraldine Road District, and for the purposes of section three of “The Timaru Harbour Board Act, 1882,” the Borough of Geraldine shall be deemed to be included in the Geraldine Road District, and for voting purposes the electors’ roll of the said borough shall be combined with the ratepayers’ roll of the said road district.

And, in further pursuance and exercise of the said powers and authorities, I do hereby proclaim and declare that on and from the said twenty-fifth day of February, one thousand nine hundred and nine, the electors of the Town District of Pleasant Point, situated within the Timaru Harbour District, shall be entitled to vote at the election of members of the said Harbour Board for the Northern District of the County of Levels, and for the purposes of section three of “The Timaru Harbour Board Act, 1882,” the Town District of Pleasant Point shall be deemed to be included in the said Northern District, and for voting purposes the electors’ roll of the said town district shall be combined with the ratepayers’ roll of the said Northern District.

Given under the hand of His Excellency the Right Honourable William Lee, Baron Plunket, Knight Commander of the Most Distinguished Order of Saint Michael and Saint George, Knight Commander of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty’s Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House, at Wellington, this twenty-fourth day of February, in the year of our Lord one thousand nine hundred and nine.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twentieth day of January, 1909.

Present:

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.

WHEREAS the land mentioned in the Schedule hereto is required for a public work, to wit, for the purpose of a road in Block VIII, Thames Survey District:

And whereas the said land is held or occupied by Native owners under a title which is not derived from the Crown:

And whereas a map in duplicate has been prepared of the said land, as required by the ninetieth section of “The Public Works Act, 1908”:

Now, therefore, in pursuance and in exercise of the powers vested in him by the ninetieth section of the said Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the land shown upon such map, and described in the Schedule hereto, shall be deemed to be taken for the purposes of the said road; and the said land shall vest in His Majesty the King as from the eighth day of March, one thousand nine hundred and nine.
