And whereas, as required by “The Public Works Act, 1908,” maps have been prepared showing accurately the position and extent of the said land, and such maps are hereto attached:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in exercise and pursuance of the powers and authorities conferred by “The Public Works Act, 1908,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the land shown upon the said maps and described in the Schedules hereto, is hereby taken for the purposes of the said Native school and access thereto; and shall vest in His Majesty the King as from the thirty-first day of March, one thousand nine hundred and nine.

Validating Leases of Native Land.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-seventh day of January, 1909.

THE HONOURABLE JAMES CARROLL PRESIDING IN COUNCIL.
WHEREAS by section forty-six of “The Maori Land Claims Adjustment and Laws Amendment Act, 1907,” it is enacted that the Governor may, by Order in Council, validate as from the date or respective dates thereof certain leases granted to Gertrude Ellen Meinertzhausen by the Native owners of the block of land known as Waimarama No. 3A, in the Hawke’s Bay District, reported upon by a Commission appointed by the Governor on the twenty-first day of January, one thousand nine hundred and seven, so far as the same relate to the area of five thousand acres recommended for lease to the said Gertrude Ellen Meinertzhausen by the said Commission: And whereas by the said section forty-six the said Commission was empowered to more particularly define the said area of five thousand acres so far as is necessary to give effect to the purpose of the said section forty-six: And whereas the said Commission, in exercise and pursuance of the powers conferred by the said section forty-six, has by its report to His Excellency the Governor, dated the eighth day of February, one thousand nine hundred and eight, defined the said area of five thousand acres, as the same is described in the Second Schedule hereto: And whereas the said leases, so far as the same relate to the said area of five thousand acres, are specified in the First Schedule hereto:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in exercise and pursuance of the powers and authority conferred upon him by section forty-six of “The Maori Land Claims Adjustment and Laws Amendment Act, 1907,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby validate as from the date or respective dates thereof the leases specified in the First Schedule hereto granted by the Native owners of the block of land known as Waimarama No. 3A, in the Hawke’s Bay District, to the said Gertrude Ellen Meinertzhausen, but such leases are validated only so far as the same relate to the area of five thousand acres described in the Second Schedule hereto.

MEMORANDUM of lease, bearing date the 21st day of April, 1906, from Tutamariki (otherwise called “Tu”) Tiakitai of his undivided share and interest (amounting in the aggregate to 1,733 acres) in the block of land known as Waimarama No. 3A, situated in the Hawke’s Bay District, containing 15,825 acres, to Gertrude Ellen Meinertzhausen, of Waimarama, spinster.

Memorandum of lease, bearing date the 21st day of April, 1906, from Horiana Tiakitai and Pani Karauria of their respective undivided shares and interests (amounting in the aggregate to 1,858 acres) in the block of land known as Waimarama No. 3A aforesaid to the said Gertrude Ellen Meinertzhausen.

Memorandum of lease, bearing date the 21st day of April, 1906, from Erena Karauria, Wiremu Ngaika, Hone (otherwise Hoani) Puriri, Toko Oriwia, Mereti Oriwia, Pita te Naera, Heta te Miha, and Harawira te Naera of their respective undivided shares and interests (amounting in the aggregate to 1,879 acres 3 roods 8 perches) in the block of land known as Waimarama No. 3A aforesaid to the said Gertrude Ellen Meinertzhausen.

Memorandum of lease, bearing date the 21st day of April, 1906, from Te Amohaere Morehu (otherwise Morehu Turoa), Anaru Puriri, and Akenehi Tomoana of their respective undivided shares and interests (amounting in the aggregate to 1,575 acres and 16 perches) in the block of land known as Waimarama No. 3A aforesaid to the said Gertrude Ellen Meinertzhausen.

Memorandum of lease, bearing date the 17th day of November, 1906, from Arihi te Nahu, Iripera Te Miha, and Te Ngaere Kingi of their undivided shares and interests (amounting in the aggregate to 238 acres) in the block of land known as Waimarama No. 3A aforesaid to the said Gertrude Ellen Meinertzhausen.

Memorandum of lease, bearing date the 29th day of November, 1906, from Peti (otherwise Irihapeti) te Wheoro and Horomona Paraone of their respective undivided shares and interests in, inter alia, the block of land known as Waimarama No. 3A aforesaid to the said Gertrude Ellen Meinertzhausen.
THE SECOND SCHEDULE.
ALL that piece or parcel of land being part of the block known as Waimarama No. 3A, situated in the Hawke’s Bay District, containing 5,000 acres, more or less, comprising 4,940 acres of the subdivision of Waimarama No. 3A known as Waimarama 3A No. 6, and 60 acres of the subdivision of Waimarama No. 3A known as Waimarama 3A No. 5, the said area of 5,000 acres being more particularly delineated and in outline coloured red on a plan deposited in the Head Office of the Lands and Survey Department, at Wellington, and numbered 19366, certified under the hands of the members of the above-named Commission as being the plan of the lands defined by the said Commission in exercise and pursuance of the powers conferred on the said Commission by section 46 of “The Maori Land Claims Adjustment and Laws Amendment Act, 1907.”
