Declaring Road in the County of Rangitikei to be a County Road.

At the Government House, at Wellington, this second day of February, 1909.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and in exercise of the powers vested in him by “The Public Works Act, 1908,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the road described in the Schedule hereto shall, on and after the date of this Order in Council, be a county road.

SCHEDULE.

Huia Road.

ALL that portion of road in the Wellington Land District, Rangitikei County, known as the Huia Road, commencing at its junction with the Mangamahoe-Mataroa Road, and proceeding generally in a south-easterly direction, fronting Section 31, Block II, Tiriraukawa Survey District, and terminating at a point 14 chains north of the boundary between Sections 31 and 22, Block II aforesaid, being a distance of 1 mile 44 chains or thereabouts; as the same is more particularly delineated on the plan marked R. 1041, coloured red, and deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District.

Declaring Portion of Mangamaire Road, Dannevirke County, to be a County Road.

At the Government House, at Wellington, this second day of February, 1909.

IN pursuance and in exercise of the powers vested in him by “The Public Works Act, 1908,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the road in the Dannevirke County described in the Schedule hereto shall, on and after the date of this Order in Council, be a county road.

SCHEDULE.

Mangamaire Road.

ALL that portion of road in the Hawke’s Bay Land District, Dannevirke County, known as the Mangamaire Road, commencing at a point where it is touched by the line dividing Sections 6 and 7, Block X, Mangatoro Survey District, at the most northern boundary of Section 6, and proceeding thence in a south-easterly direction generally for a distance of 30 chains, more or less; as the said road is more particularly delineated on the plan marked R. 6723, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured red, and lettered A.B.

Exempting Part of Perry Street, Borough of Masterton, from the Provisions of Section 117 of “The Public Works Act, 1908.”

ORDER IN COUNCIL
At the Government House, at Wellington, this second day of February, 1909.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of “The Public Works Act, 1908,” it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:

And whereas by subsection two of section one hundred and seventeen of “The Public Works Act, 1908,” it is provided that such approval may be either absolute or subject to such conditions as the Governor by Order in Council thinks fit to impose:

And whereas on the fourteenth day of April, one thousand nine hundred and eight, the Masterton Borough Council, the local authority having control of the street described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said street:

And whereas it is deemed expedient that such resolution should be approved:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution.

SCHEDULE.

ALL that street in the Borough of Masterton, Wellington Land District, known as Perry Street, situated between Queen Street and Chapel Street, in the said borough; as the said street is more particularly delineated on the plan marked R.9819, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured pink.

Changing the Purpose of a Reserve in the Marlborough Land District.

PLUNKET, Governor.

WHEREAS the land described in the Schedule hereto has been duly set apart for road purposes, being a reserve within Class I of “The Public Reserves and Domains Act, 1908,” and such land has not been vested in trust in any society, body corporate, or trustees:

And whereas it is expedient that such land shall be appropriated for a site for a public school, being a reserve within Class III of the aforesaid Act:

Now, therefore, I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, in exercise of the powers and authorities vested in me by the eleventh section of “The Public Reserves and Domains Act, 1908,” do by this notification declare that the said land shall, from and after the eleventh day of February, one thousand nine hundred and nine, be appropriated for a site for a public school under Class III of “The Public Reserves and Domains Act, 1908”; and I do hereby direct that this notification shall be published in the New Zealand Gazette.
