And whereas the said land is held or occupied by Native
owners under a title which is not derived from the Crown:
And whereas a map in duplicate has been prepared of the
said land, as required by the ninetieth section of "The
Public Works Act, 1908":
Now, therefore, in pursuance and in exercise of the
powers vested in him by the ninetieth section of the said
Act, and of all other powers in anyway enabling him
in this behalf, His Excellency the Governor of the Dominion
of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, doth hereby
declare that the land shown upon such map, and described
in the Schedule hereto, shall be deemed to be taken for the
purposes of the said road as from the eighth day of March,
one thousand nine hundred and nine.

WHEREAS the land mentioned in the Schedule hereto is required to be taken for a public work, to wit, for the purposes of a road in Ahikouka No. 2B Block and Reporua No. 3 Block, Block XIV, Waiapu Survey District:
And whereas the said land is held or occupied by Native owners under a title which is not derived from the Crown;

And whereas by an order of the Native Land Court bearing date the thirtieth day of May, one thousand nine hundred and one, certain aboriginal Natives are declared to be the owners of the Awaroa A No. 3 Block, within which the said land is situated:
