Exempting Part of Leach Street, in the Borough of New Plymouth, from the Provisions of Section 117 of “The Public Works Act, 1908.”

ORDER IN COUNCIL.
At the Government House, at Wellington, this fourteenth day of December, 1909.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by subsection one of section one hundred and seventeen of “The Public Works Act, 1908,” it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:
And whereas by subsection two of section one hundred and seventeen of “The Public Works Act, 1908,” it is provided that such approval may be either absolute or subject to such conditions as the Governor by Order in Council thinks fit to impose:
And whereas on the eleventh day of October, one thousand nine hundred and nine, the New Plymouth Borough Council, the local authority having control of the street known as Leach Street, described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to part of the said street:
And whereas it is deemed expedient that such resolution should be approved:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution.
SCHEDULE.
ALL that portion of Leach Street, in the Borough of New Plymouth, situated between Liardet Street and Gover Street, and fronting Sections Nos. 956 to 960 (E.R.), 948A (E.R.), and 961 to 964, all in the said borough; as the said portion of street is more particularly delineated on the plan marked P.W.D. 25555, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured red.

Netting in New River Estuary.

ORDER IN COUNCIL.
At the Government House, at Wellington, this fourteenth day of December, 1909.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS it is enacted by section eighty-three of “The Fisheries Act, 1908,” that the Governor may from time to time, by Order in Council gazetted, make regulations (to have force and effect throughout New Zealand or only in such waters or places as are specified in the regulations) for, amongst other things, prohibiting the use of nets or seines of all descriptions or of any specified description:
And whereas by Orders in Council dated the twenty-first day of September, one thousand nine hundred and four, and the twenty-third day of August, one thousand nine hundred and seven, and published in the New Zealand Gazette No. 78, of the twenty-second day of September, one thousand nine hundred and four, and No. 76, of the twenty-ninth day of August, one thousand nine hundred and seven, the use of nets at the mouth of every river or stream is prohibited:
And whereas it is desirable to revoke such prohibition so far only as relates to a portion of the New River Estuary:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the hereinbefore-recited power and authority, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the prohibition of netting made by the said Orders in Council of the twenty-first day of September, one thousand nine hundred and four, and the twenty-third day of August, one thousand nine hundred and seven, at the mouths of rivers and streams so far only as relates to the portion of the New River Estuary below a right line drawn from Owi Point to the north-eastern boundary of Stanley Township, and not further or otherwise, and doth hereby make the following regulations:—
REGULATIONS.

No person shall use a net or seine of any description (other than a landing-net for trout, perch, and tench taken by rod and line) in that portion of the New River Estuary or in any river or stream running therein above a right line drawn from Owi Point to the north-eastern boundary of Stanley Township. The point on each side of the river from which such line shall be drawn shall be marked by a post bearing the words “Netting prohibited line.”

The penalty for breach of the above regulation shall not be less than £5 or more than £50.

Domain Board appointed to have Control of the Mount Hobson Domain.

ORDER IN COUNCIL.
At the Government House, at Wellington, this fourteenth day of December, 1909.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
IN pursuance and exercise of the power and authority conferred by “The Public Reserves and Domains Act, 1908,” His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke an Order in Council, dated the first day of February, one thousand nine hundred and four, delegating powers to the Mount Hobson Domain Board, and doth hereby appoint
THE REMUERA ROAD BOARD
to be the Mount Hobson Domain Board, having, subject to the said Act, control of the land described in the Schedule hereto, which land is a public domain, and shall be called the Mount Hobson Domain; and also doth hereby appoint Monday, the seventeenth day of January, one thousand nine hundred and ten, at half past seven o’clock p.m., as the time when, and the Remuera Road Board Office, Remuera, as the place where, the first meeting of the said Board shall be held.
SCHEDULE.
MOUNT HOBSON DOMAIN.
ALL that area in the Auckland Land District, containing by admeasurement 23 acres 1 rood, more or less, being Lot 2A, of Section No. 11, Suburbs of Auckland, and known as the Mount Hobson Reserve. Bounded towards the north-east by a public road 100 links wide, 956, 306, and 794 links; towards the south-east by Lots 4, 5, and 6 of Section 11, Suburbs of Auckland, 515, 277, 157, and 738 links; towards the south-west by Lot 7 of the aforesaid section, 1009 links; and towards the west generally by Lots 2 and 3 of the aforesaid section, 1300 and 522 links: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. 1364, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

WHEREAS by section forty of “The Public Reserves and Domains Act, 1908” (hereinafter termed “the said Act”), it is enacted that the Governor may from time to time, with respect to any public domain, appoint such persons (not exceeding nine) as he thinks fit to be a Domain Board having, subject to the said Act, control of such domain:
