And whereas the Mount Herbert County Council has applied for such consent in respect to the road described in the Schedule hereto:
Now, therefore, in pursuance and in exercise of the above-in-part-recited Act, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the closing of the road mentioned in the Schedule hereto.

SCHEDULE.

Area of Land contained in Road to be closed. A. R. P. 0 3 17 Adjoining or passing through Section 228 Situated in Block III Halswell Shown on Plan P.W.D. 25504 Coloured on Plan Green.

In the Canterbury Land District; as the same is more particularly delineated on the plan marked and coloured as above mentioned, and deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District.

Declaring a Portion of the Road to the Cable-station, Wakapuaka, in the Suburban North Road District, to be a District Road.

ORDER IN COUNCIL.
At the Government House, at Wellington, this fourteenth day of December, 1909.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and in exercise of the powers vested in him by "The Public Works Act, 1908," and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the road described in the Schedule hereto shall, on and after the date of this Order in Council, be a district road.

SCHEDULE.

ALL that portion of road known as the Cable Bay Road, in the Wakapuaka Survey District, Waimea County, Nelson Land District, commencing on the northern side of the Wakapuaka River, at the iron gate on the south-western boundary of Section 3, in Native reserve, Block VI, and proceeding thence generally in a north-easterly and north-westerly direction through the said Section 3, thence through Section 7, Block VII, thence again through the said Section 3, thence again through the said Section 7, thence through Section 2, Block III, thence through Section 1, Lot 3 of Section 1, and Section 90, Block II, and terminating at the northern boundary of the said Section 90, being a distance of 4 miles 18 chains, more or less; as the said portion of road is more particularly delineated on the plan marked P.W.D. 25395, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured red, and marked A-B.

Exempting Mountain Road, Epsom Road District, from the Provisions of Section 117 of "The Public Works Act, 1908," subject to certain Conditions as to the Building-line.

ORDER IN COUNCIL.
At the Government House, at Wellington, this fourteenth day of December, 1909.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of "The Public Works Act, 1908," it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:
And whereas by subsection two of section one hundred and seventeen of "The Public Works Act, 1908," it is provided that such approval may be either absolute or subject to such conditions as the Governor by Order in Council thinks fit to impose:
And whereas on the eleventh day of May, one thousand nine hundred and nine, the Epsom Road Board, the local authority having control of the road described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said road:
And whereas it is deemed expedient that such resolution should be approved, subject to the condition hereinafter mentioned:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution, subject to the condition that no building or part of a building shall at any time be erected on either side of the said road within a distance of thirty-three feet from the centre-line of the said road.

SCHEDULE.

ALL that road in the Auckland Land District, Epsom Road District, known as Mountain Road, commencing at its junction with Owen's Road, and proceeding thence in a northerly direction, forming the western boundaries of Allotments 35, 36, and 58 of Section 6, Suburbs of Auckland; as the said road is more particularly delineated on the plan marked P.W.D. 25493, and deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured red, and lettered A-B.
