In these regulations the words “the secretary or fishery officer of the acclimatisation society” shall, in the case of the Rotorua Acclimatisation Society, mean the General Manager of the Department of Tourist and Health Resorts, or his appointee.

Any person committing a breach of the above regulations shall be liable to a fine not exceeding twenty pounds.

Regulations as to Taking of Whitebait.

ORDER IN COUNCIL.
At the Government House, at Wellington, this sixth day of October, 1908.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS it is enacted by the fifth section of “The Fisheries Act, 1908” (hereinafter called “the said Act”), that the Governor may from time to time, by Order in Council gazetted, make regulations, which shall have force and effect either throughout New Zealand or only in such waters or places as are specified in the regulations, for any of the matters specified in that section:
And whereas by Orders in Council dated the twenty-third day of May, one thousand nine hundred and six, and the twenty-eighth day of July, one thousand nine hundred and eight, and published in the New Zealand Gazette of the thirty-first day of May, one thousand nine hundred and six, and the thirtieth day of July, one thousand nine hundred and eight, respectively, certain regulations were made providing, amongst other things, for the matters relating to taking whitebait:
And whereas it is desirable to revoke certain of such regulations, and to make others in lieu thereof:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke clauses numbered 26, 27, 29, 43, and 44 of the said regulations of the twenty-third day of May, one thousand nine hundred and six, and the regulations numbered 1 and 2 of the twenty-eighth day of July, one thousand nine hundred and eight, and doth hereby make the following regulations in lieu thereof:—
REGULATIONS.

No scrim or whitebait net shall be used as a set-net, or be set or placed in openings made in the banks of rivers or streams, or in dams constructed therein; and no scrim hand-net having an opening of more than seven square feet shall be used for the purpose of catching whitebait: Provided that scrim hand-nets having an opening of nine square feet may be used for the purpose of catching whitebait within the Provincial District of Canterbury and in the waters of the Waitaki River: Provided further that whitebait nets having an opening of not more than three feet by one foot may be used as set-nets in the River Ashley and the waters thereof, and in its tributaries the Taranaki and Waikuku Creeks.

No person shall use, for the purpose of enabling him to catch whitebait, the device or appliance known as a “jigger,” which is an appliance formed of pieces of metal or other substance attached to a line and placed in a river or stream for the purpose of turning the fish into nets; nor shall any other device or contrivance be used which tends to wholly prevent the movement of such fish up or down stream.

No person shall take whitebait by use of nets in paddocks which are formed by constructing groins from the banks of rivers and streams, and making holes for the fish between the groins and the banks.

No person shall use more than one set-net, and no person shall set or place his set-net or use any other fishing-net within a distance of two chains from another set-net in the River Ashley and the waters thereof, and in its tributaries the Taranaki and Waikuku Creeks.

Any person committing a breach of the foregoing regulations shall be liable to a penalty of not less than one pound and not exceeding twenty pounds, except where otherwise specially provided.

Extending Time for Election, Town District of Bay, County of Peninsula.
PLUNKET, Governor.
WHEREAS by misadventure the biennial general election of members of the Bay Town Board was not held on the sixteenth day of September, one thousand nine hundred and eight, as provided by section twenty of “The Town Districts Act, 1908”:
And whereas it is considered expedient to extend the time within which such election may be held:
Now, therefore, I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon me by “The Town Districts Act, 1908,” do hereby extend the time for holding the said biennial general election of the members of the said Bay Town Board to the twenty-eighth day of October, one thousand nine hundred and eight; and do hereby appoint Henry Duckworth, of Oaklands, to be the Returning Officer to conduct the said election; and do hereby direct that such election shall be held on the said twenty-eighth day of October, one thousand nine hundred and eight.
As witness the hand of His Excellency the Governor, this eighth day of October, one thousand nine hundred and eight.

Exempting Crown Land from “The Mining Act, 1908.”
PLUNKET, Governor.
IN exercise of the powers conferred on me by “The Mining Act, 1908,” I, William Lee, Baron Plunket, Governor of the Dominion of New Zealand, do hereby exempt from the aforesaid Act the Crown land described in the Schedule hereto.
SCHEDULE.
ALL that area in the Auckland Land District, containing by admeasurement 100 acres, more or less, situated in Block IX, Aroha Survey District. Bounded towards the north-west by a public road bounding Te Ruakaka Block; towards the north-east by parts of Sections Nos. 17B and 17D, being subdivisions of Original Section No. 17, Block IX aforesaid; towards the south-east generally by part of Section No. 17A, part of the Te Aroha Township, and part of Section No. 17C; and towards the south-west by a public road: as the same is delineated on a plan marked Mines, 1908/946, deposited in the Head Office, Mines Department, at Wellington, and thereon coloured red.
As witness the hand of His Excellency the Governor, this twenty-ninth day of September, one thousand nine hundred and eight.

Warrant vesting Control of the Mangatainoka Bridge in the Pahiatua Borough Council, and apportioning the Cost of Maintenance of the same between the Pahiatua Borough Council and the Pahiatua County Council.
PLUNKET, Governor.
WHEREAS by section one hundred and twenty of “The Public Works Act, 1908” (hereinafter called “the said Act”), it is, inter alia, enacted that the Governor may, by Warrant under his hand publicly notified and gazetted, direct that any bridge already constructed, or which may hereafter be constructed, over or across any river or arm of the sea respectively shall, from and after a date to be fixed in such Warrant, be under the exclusive care, control, and management of such local authority as shall be mentioned in that behalf in such Warrant; and may by any such Warrant as aforesaid fix and determine whether all or any, and if so what part, of the cost, whether theretofore incurred or thereafter to be incurred, of maintaining, repairing, improving, or reconstructing any such bridge is to be provided and paid by the local authority or local authorities; and may by any such Warrant as aforesaid direct how, when, and to whom any such payment is to be made:
And whereas it is expedient that provision should be made under the hereinbefore-in-part-recited Act for the purposes hereinafter mentioned:
