ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-eighth day of September, 1908.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS the land mentioned in the Schedule hereto is required to be taken for a public work, to wit, for the purposes of a road in Puhanga-te-uru No. 3b, No. 7161, Block VI, Waihou Survey District:
And whereas the said land is held or occupied by Native owners under a title which is not derived from the Crown:
And whereas a map in duplicate has been prepared of the said land, as required by the ninetieth section of “The Public Works Act, 1908”:
Now, therefore, in pursuance and in exercise of the powers vested in him by the ninetieth section of the said Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the land shown upon such map, and described in the Schedule hereto, shall be deemed to be taken for the purposes of the said road as from the fifth day of November, one thousand nine hundred and eight.

Excepting Land from the Operation of Section 117 of “The Native Land Court Act, 1894.”

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-eighth day of September, 1908.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by section four of “The Native Land Laws Amendment Act, 1895,” it is enacted that the Governor may, by Order in Council, except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894” (hereinafter called “the said Act”), for a limited period or otherwise, and either generally or for such purposes and subject to such restrictions as shall be in such Order specified, any land, wheresoever situate, which is for the time being subject to the operation of the said section, or any interest therein or right over the same, or may in like manner make such exception in favour exclusively of any lessee or other person who has been bona fide in occupation of and has made improvements on such land, or has paid money to Native owners for lease or purchase thereof, prior to the passing of the said Act: Provided that no Order in Council under the provisions of this section shall take effect until after the expiration of two months from the date of the publication thereof in the Gazette: Provided also that every alienation under the provisions of this section shall be confirmed by the Court in terms of section fifty-three of the said Act:
And whereas the Aotea District Maori Land Board, by a recommendation made on the twenty-ninth day of July, one thousand nine hundred and eight, and received on the sixth day of August, one thousand nine hundred and eight, has recommended the Governor to except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of mortgage to a lending department of the Government, the parcel of land particularised and set out in the Schedule hereto:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by section four of “The Native Land Laws Amendment Act, 1895,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby except the said land from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” so far as to enable the same to be mortgaged as aforesaid.
SCHEDULE.
ALL that piece or parcel of land, situate in the Karioci Survey District, containing 111 acres 1 rood 12 perches, more or less, known as Rangiwaea-Tarere No. 2b1, and comprised in a partition order of the Native Land Court dated the 28th day of June, 1906, in favour of Te Whango te Wiki and others.

Validating the Special Order making the Special Rate as the Security for the Loan of £600 to be raised by the Opotiki Town Board for certain Public Works.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-eighth day of September, 1908.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS the Opotiki County Council and the Opotiki Town Board lately proposed to raise a joint loan of six thousand pounds from the Minister of Finance, under the provisions of “The Local Bodies’ Loans Act, 1901,” for the purpose of constructing certain public works:
And whereas a resolution was made by the Opotiki Town Board on the fourth day of February, one thousand nine hundred and eight, resolving to make a special rate of one-ninth of a penny in the pound sterling as security for a special loan of six hundred pounds to be expended in two successive years as part of the joint special loan of six thousand pounds in conjunction with the Opotiki County Council:
And whereas the particular works for which such joint special loan was to be raised were set out in the proposal for the said loan, but were not set out in the special order making the special rate as security for such loans, as required by “The Local Bodies’ Loans Act, 1901,” and its amendments:
And whereas it appears that the ratepayers of the Opotiki Town District have not been misled, and it is expedient to validate such irregularity as aforesaid:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise and pursuance of the powers and authorities vested in him by section one hundred and twenty-one of “The Local Bodies’ Loans Act, 1908,” doth hereby declare that the said resolution making the said special rate shall be deemed and taken to be as valid to all intents and purposes as though the same were regular and in form, and doth hereby declare that the proceedings relative to such resolution shall not be called into question by reason only of the irregularities aforesaid.
