Validating the Special Order making the Special Rate as the Security for the Loan of £5,400 to be raised by the Opotiki County Council for certain Public Works.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-eighth day of September, 1908.

Present:

His Excellency the Governor in Council.

WHEREAS the Opotiki County Council and the Opotiki Town Board lately proposed to raise a joint loan of six thousand pounds from the Minister of Finance, under the provisions of “The Local Bodies’ Loans Act, 1901,” for the purpose of constructing certain public works in the Opotiki County: And whereas a resolution was made by the Opotiki County Council on the twenty-fifth day of January, one thousand nine hundred and eight, resolving to make a special rate of one-fifth of a penny in the pound sterling as security for a special loan of five thousand four hundred pounds as part of the said joint special loan of six thousand pounds in conjunction with the Opotiki Town Board: And whereas the particular works for which such joint special loan was to be raised were set out in the proposal for the loan, but were not set out in the special order making the special rate as security for such loan, as required by “The Local Bodies’ Loans Act, 1901,” and its amendments: And whereas it appears that the ratepayers of the Opotiki County have not been misled, and it is expedient to validate such irregularity as aforesaid:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise and pursuance of the powers and authorities vested in him by section one hundred and twenty-one of “The Local Bodies’ Loans Act, 1908,” doth hereby declare that the said resolution making the special rate shall be deemed and taken to be as valid to all intents and purposes as though the same were regular and in form, and doth hereby declare that the proceedings relative to such resolution shall not be called into question by reason only of the irregularities aforesaid.

Revoking Order in Council licensing Daniel Gilbert Lane to use and occupy a Part of Foreshore of Hokianga as a Site for a Wharf.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-eighth day of September, 1908.

Present:

His Excellency the Governor in Council.

WHEREAS by an Order in Council dated the seventeenth day of September, one thousand nine hundred and six, and published in the New Zealand Gazette No. 80, of the twentieth day of the same month, His Excellency the Governor in Council did, in pursuance of the provisions of “The Harbours Act Amendment Act, 1883,” license Daniel Gilbert Lane to use and occupy a part of the foreshore and land below low-water mark at Rawene, Hokianga Harbour, for a wharf in accordance with plans marked M.D. 2996 (three sheets), and deposited in the office of the Marine Department at Wellington, and upon and subject to the terms and conditions therein set forth:

And whereas the said Daniel Gilbert Lane desires that the said license shall be revoked, and it is advisable that this should be done:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of all the powers enabling him in that behalf, doth hereby revoke and determine the said recited Order in Council of the seventeenth day of September, one thousand nine hundred and six, and the rights and privileges thereby conferred.

Vesting Control of a Reserve under “The Tourist and Health Resorts Control Act, 1908.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-eighth day of September, 1908.

Present:

His Excellency the Governor in Council.

IN pursuance and exercise of the power and authority conferred on him by “The Tourist and Health Resorts Control Act, 1908” (hereinafter termed “the said Act”), His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby vest the control of the reserve described in the Schedule hereto in the Minister of the Crown for the time being having the administration of the said Act, and doth hereby declare that the said reserve shall be administered under the said Act.

SCHEDULE.

All that area in the Auckland Land District, containing by admeasurement 148 acres, more or less, being Sections Nos. 1 and 2, Block VII, Tarawera Survey District; as the same is delineated on the plan marked L. 57182/27, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

Regulations for Trout-fishing, Rotorua Acclimatisation District.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-eighth day of September, 1908.

Present:

His Excellency the Governor in Council.

IN pursuance of the powers and authorities vested in him by “The Fisheries Act, 1908,” His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations for the Rotorua Acclimatisation District and the waters thereof; and doth hereby declare that these regulations shall, as from the first day of October, one thousand nine hundred and eight, supersede all regulations at variance therewith, and such regulations are hereby revoked:—

REGULATIONS.

  1. Licenses to fish for trout in all waters within that district or part of the North Island known as the Rotorua Acclimatisation District, described in the First Schedule hereto, and comprising the Counties of Rotorua, Whakatane, and East Taupo, and parts of the Counties of Wairoa, West Taupo, and Piako, may be issued under the hand of the General Manager of the Tourist and Health Resorts Department, or any one authorised in writing by the said General Manager in that behalf: Provided that the General Manager, or his appointee, may refuse to issue a license to any person who within the previous two years has been convicted of any breach of the provisions of any Act relating to fishing for trout, or of any regulation made thereunder.

  2. The fee to be charged for a license as aforesaid to each male person over the age of sixteen years shall be twenty shillings. Licenses may also be issued to boys attending school or under the age of sixteen, or to women, at a reduced fee of five shillings for each license so issued: Provided that it shall be lawful for the said General Manager, or his appointee, in any case where application is made for a license on or after the twentieth day of December in any year, to issue a license to any man for the sum of twelve shillings and sixpence, but so that such license shall extend only from the time of granting the same until the termination of the then trout-fishing season. No license shall confer any right of entry upon the land of any person without his consent. The General Manager, or his appointee, may issue
