Defining the Middle Line of a Further Portion of the Lawrence-Roxburgh Railway.

A PROCLAMATION.

WHEREAS the Lawrence-Roxburgh Railway—namely, an extension of the Lawrence Branch Railway to Beaumont (hereinafter termed “the said railway”)—is a railway the construction of which is authorised by “The Public Works Act, 1908”: And whereas the said railway has been partly constructed, and it has been determined to construct and maintain the remaining portion of the same:
Now, therefore, I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, in exercise and pursuance of the powers and authorities conferred by “The Public Works Act, 1908,” and in exercise of every other power and authority in anywise enabling me in this behalf, do hereby proclaim and declare that the middle line of the said remaining portion of the said railway shall be that defined and set forth in the Schedule hereto.

SCHEDULE.

COMMENCING at a point in the railway reserve distant about 32 chains in an easterly direction from the north-western corner of Section 53, Block III, Tuapeka West Survey District, which point is marked 29 miles, and is also the termination of a previous portion of the Lawrence-Roxburgh Railway, as described in a Proclamation dated the 18th day of September, 1906, and published in the New Zealand Gazette No. 80, of the 20th day of September, 1906; proceeding thence generally in a north-westerly direction for a distance of about 6 miles 16 chains, and passing in, into, through, or over the following lands—viz., railway reserve, Block III, Tuapeka West Survey District; railway reserve and Sections 2, 3, 4, and 5, Block III, Beaumont Survey District; Sections 2, 3, 4, 30, 31, and railway reserve, Block I, Beaumont Survey District; railway reserve, Block III, Beaumont Survey District; Block XXI, Town of Dunkeld; and again into railway reserve, Block I, Beaumont Survey District—and terminating at a point marked 35 miles 16 chains on the southern bank of the Beaumont River in the said Block I, Beaumont Survey District, distant about 14½ chains from the southern boundary of Section 28, Block I, Beaumont Survey District: including all adjoining and intervening places, lands, reserves, roads, tracks, rivers, streams, and watercourses: all in the Land District of Otago: as the same is delineated on the plan marked P.W.D. 23668, deposited in the office of the Minister of Public Works, at Wellington, in the Provincial District of Wellington.

Given under the hand of His Excellency the Right Honourable William Lee, Baron Plunket, Knight Commander of the Most Distinguished Order of Saint Michael and Saint George, Knight Commander of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty’s Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House, at Wellington, this twenty-sixth day of September, in the year of our Lord one thousand nine hundred and eight.

A PROCLAMATION.

IN pursuance and in exercise of the powers conferred by section eleven of “The Land Act, 1908,” I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, do hereby, with the consent of the owners, lessees, and mortgagees of the lands mentioned in the First Schedule hereto, and of the Okato, Werekino, and Parihaka Road Boards, being the local authorities in whose districts the said lands are situated, proclaim as a road the lands in Cape Survey District described in the First Schedule hereto; and also do hereby, with the like consents as aforesaid, proclaim as closed the road described in the Second Schedule hereto, which is not required by reason of the road first hereinbefore proclaimed,

ORDER IN COUNCIL.

At the Government House, at Wellington, this fifteenth day of September, 1908.

Present:

His Excellency the Governor in Council.

WHEREAS the land mentioned in the Schedule hereto is required to be taken for a public work, to wit, for the purposes of a road in Maunu No. 1e No. 3 North No. 5a, Block XI, Purua Survey District:
And whereas the said land is held or occupied by Native owners under a title which is not derived from the Crown:
And whereas a map in duplicate has been prepared of the said land, as required by the ninetieth section of “The Public Works Act, 1908”:
Now, therefore, in pursuance and in exercise of the powers vested in him by the ninetieth section of the said Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the land shown upon such map, and described in the Schedule hereto, shall be deemed to be taken for the purposes of the said road as from the fifth day of November, one thousand nine hundred and eight.
