Native Land taken for the Purposes of a Road in Paremata No. 4, Block XII, Uawa Survey District, Cook County.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-fifth day of August, 1908.
Present :
His Excellency The Governor in Council.
WHEREAS the land mentioned in the Schedule hereto is required to be taken for a public work, to wit, for the purposes of a road in Paremata No. 4, Block XII, Uawa Survey District :
And whereas the said land is held or occupied by Native owners under a title which is not derived from the Crown:
And whereas a map in duplicate has been prepared of the said land, as required by the ninetieth section of “The Public Works Act, 1908”:
Now, therefore, in pursuance and in exercise of the powers vested in him by the ninetieth section of the said Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the land shown upon such map, and described in the Schedule hereto, shall be deemed to be taken for the purposes of the said road as from the eighth day of October, one thousand nine hundred and eight.

Declaring Part of Turoto Road, Waitomo County, to be a Government Road.

At the Government House, at Wellington, this twenty-fifth day of August, 1908.

His Excellency The Governor in Council.
IN pursuance and in exercise of the powers vested in him by “The Public Works Act, 1908,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the road described in the Schedule hereto shall, on and after the date of this Order in Council, be a Government road.

Exempting Henry Street, Kilbirnie, in the City of Wellington, from the Provisions of Section 117 of “The Public Works Act, 1908,” subject to certain Conditions as to the Building-line.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-fifth day of August, 1908.
Present:
His Excellency The Governor in Council.
WHEREAS by subsection one of section one hundred and seventeen of “The Public Works Act, 1908,” it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council :
And whereas by subsection two of section one hundred and seventeen of “The Public Works Act, 1908,” it is provided that such approval may be either absolute or subject to such conditions as the Governor in Council thinks fit to impose:
And whereas on the sixth day of August, one thousand nine hundred and eight, the Council of the City of Wellington, the local authority having control of the street described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said street:
And whereas it is deemed expedient that such resolution should be approved, subject to the condition as hereinafter mentioned:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution, subject to the condition that no building or part of a building shall at any time be erected on either side of the said street within a distance of twenty feet from the centre-line of the said street.
SCHEDULE.
THAT street known as Henry Street, Kilbirnie, in the City of Wellington, between Seatoun Road and Wellington Road, Kilbirnie, in the said City of Wellington; as the said street is more particularly delineated on the plan marked R. 9844, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured pink.
