Given under the hand of His Excellency the Right Honourable William Lee, Baron Plunket, Knight Commander of the Most Distinguished Order of Saint Michael and Saint George, Knight Commander of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty’s Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House, at Wellington, this fourteenth day of January, in the year of our Lord one thousand nine hundred and eight.

Native Land taken for the Purposes of a Wharf-site in Rangiuru No. 1a Block, Block III, Maketu Survey District.

PLUNKET, Governor.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this sixteenth day of December, 1907.

Present :

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.

WHEREAS the land mentioned in the Schedule hereto is required for a public work, to wit, for the purpose of a wharf-site in the Rangiuru No. 1a Block, Block III, Maketu Survey District :

And whereas the said land is held or occupied by Native owners under a title which is not derived from the Crown :

And whereas a map in duplicate has been prepared of the said land, as required by the eighty-ninth section of “The Public Works Act, 1905 ” :

Now, therefore, in pursuance and in exercise of the powers vested in him by the eighty-ninth section of the said Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the land shown upon the map, and described in the Schedule hereto, shall be deemed to be taken for the purposes of the said wharf-site ; and the said land shall vest in His Majesty the King as from the twentieth day of February, one thousand nine hundred and eight.

Regulations (Amended) for Trout-fishing, Grey District Acclimatisation District.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this tenth day of January, 1908.

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.

IN pursuance of the powers and authorities vested in him by “The Fisheries Conservation Act, 1884,” and the Acts amending the same (hereinafter called “the said Acts”), His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations for the Grey District Acclimatisation District and the waters thereof, and all the boroughs and town districts situated within such district (hereinafter termed “the said district”), and doth hereby declare that these regulations shall, as from the date of the publication thereof in the New Zealand Gazette, supersede all regulations for the said district at variance therewith :—

REGULATIONS.

  1. Licenses to fish for trout in all the waters within the said district will be issued under the hand of the secretary of the Grey District Acclimatisation Society (hereinafter called “the society”), and for every such license a fee of twenty shillings will be charged: Provided that it shall not be obligatory upon the society to issue a license. The secretary may issue half-season licenses after the nineteenth day of December in each year, at a fee of twelve shillings and sixpence each, and seven-day licenses at a fee of two shillings and sixpence each. The charge for licenses for women, and for boys under the age of sixteen years or attending school, shall be five shillings each for the season during which such licenses are issued.

  2. Every such license shall entitle the person named therein to fish for trout in any of the said waters from the first day of October in each year to the thirtieth day of April in the following year inclusive; but no such license shall confer any right of entry upon the land of any person without his consent.

  3. No person shall fish for, take, catch, or kill, or have in his possession, or attempt to fish for, take, catch, or kill, in any manner whatever, any Salmonidæ or trout, except during the above-mentioned period: Provided always that this regulation shall not apply to fish caught by the officers of the said society for purposes of acclimatisation, or by officers of the Marine Department for the same purposes.

  4. Every such license shall entitle the person named therein to fish with one rod and line only, and with the following baits: Natural or artificial fly, natural or artificial minnow, silveries, bullies, grasshoppers, spiders, caterpillars, creepers, and worms.

  5. No person shall use any other bait, or any method, device, or contrivance of any sort or kind whatever, for the purpose of fishing for, taking, catching, or killing trout, except with a rod and line, and a landing-net or gaff for fish taken with rod and line.

  6. Except as aforesaid, no person shall fish with or use any net (other than a net for whitebait-fishing) or other engine, instrument, or device for taking fish in any river or stream within the district aforesaid, or at the mouth or entrance of any such river or stream :

Provided that nothing herein contained shall prevent the placing of any net other than a stake-net in or across the mouth of the Grey River, or at any place in the said river below a straight line drawn across the said river opposite Tainui Street, in the Town of Greymouth, for the purpose of taking indigenous fish only, nor render any person liable to any penalty for so doing, or for taking indigenous fish by such means.

  1. No cross-line fishing, stroke-hauling, or any other unsportsmanlike device shall be used for the purpose of taking, catching, or killing trout; nor shall any of the baits above mentioned be used with any medicated or chemical preparation whatever, except small fish put up in formalin or other preservative.

  2. No person shall fish for trout without a license; and every person fishing shall, on demand of any Ranger, constable, member of the society, or person producing a license, produce and show to such Ranger, member, constable, or person his license and the contents of his creel or bag, and the bait used by him for taking, catching, or killing trout.

  3. Every trout not exceeding nine inches in length from nose to tip of tail taken or caught by any person shall be immediately returned alive into the water from which the same is taken.
