A PROCLAMATION.

IN pursuance and in exercise of the powers conferred by section thirteen of “The Land Act, 1892,” and its amendments, I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, with the consent of the owners and of the mortgagees of the lands hereinafter mentioned, and with the consent of the Inangahua County Council, being the local authority in whose district the said lands are situated, do by this notice hereby proclaim as taken for a road the lands in Matiri Survey District described in the Schedule hereto.

Taking the Te Arai Estate under “The Land for Settlements Consolidation Act, 1900,” and its Amendments.

A PROCLAMATION.

WHEREAS by a notice published in the New Zealand Gazette of the thirty-first day of January, one thousand nine hundred and seven, it was therein stated that it was the intention of the Governor to take compulsorily, under the powers in that behalf conferred by “The Land for Settlements Consolidation Act, 1900,” and its amendments, the lands mentioned in such notice;

And whereas, in pursuance of such notice, a claim for compensation was made by the Hon. G. Randall Johnson, and the claim has been determined by the Compensation Court sitting at Gisborne, in the Provincial District of Auckland, in manner provided by such Acts:

And whereas, in pursuance of the said Acts, an order was made by the said Court on the second day of November, one thousand nine hundred and seven, declaring the land which the Minister is entitled to take (being identical with the land specified in the Schedule hereto), and also declaring the amount of compensation and costs to be paid in respect to the taking of such land, which order is now duly filed in the office of the Supreme Court, Gisborne:

Now, therefore, I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon me by the said Acts, and of all other powers and authorities in anywise enabling me in that behalf, do hereby proclaim and declare that the land described in the Schedule hereto (being identical with the land specified in the aforesaid order) is compulsorily taken under the said Acts, as from the thirty-first day of March, one thousand nine hundred and eight.


SCHEDULE.

TE ARAI ESTATE.

ALL that area in the Hawke’s Bay Land District, containing 10,773 acres 3 roods 19 perches, more or less, situated in Blocks V and IX, Turanganui Survey District, and Blocks VII, VIII, XI, and XII, Patutahi Survey District, comprising Te Arai No. 2 Block, Sections 1 to 10 inclusive, Tapatocho Block, Pukewhinau, Taomako No. 1, and Okahukurata Blocks, also portions of closed roads, and bounded towards the south generally by Pakowhai, Rangaiohinehau, Teranganui No. 3, and Ngapunaruā Blocks; towards the west and north generally by the Te Arai River; and towards the east generally by Tahuniorangi, Umukapua, Whennahou, Manutuke, and Hurnaute Blocks, the old bed of the Te Arai River, Okahukurata B Block, Te Papa, and Turangaote-whetuiapiti Blocks, and Werawera Lagoon: excepting out of the land herein described Taringamotuhia and Taomako No. 2 Blocks: being the whole of the land in certificate of title, Vol. 22, folio 39; Vol. 23, folio 194; and in Deeds Register, Vol. 1, folio 319: as the same is delineated on Plan No. 19369, deposited in the Head Office of the Department of Lands, at Wellington, and thereon edged with red.

WHEREAS the land mentioned in the Schedule hereto is required to be taken for a further portion of the Ngahere-Blackball Railway:

And whereas all conditions precedent required by law to be observed and performed prior to the taking of such land for the purposes hereinafter specified have been observed and performed:

Now, therefore, I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, in exercise of the powers and authorities conferred on me by section one hundred and eighty-eight of “The Public Works Act, 1905,” and of every other power and authority in anywise enabling me in this behalf, do hereby proclaim and declare that the land mentioned in the Schedule hereto is hereby taken for a portion of the aforesaid line of railway.
