Declaring Portion of Hutiwai Road, in the Clifton County, to be a County Road.

At the Government Buildings, at Wellington, this twenty-fifth day of April, 1908.

IN pursuance and in exercise of the powers vested in him by “The Public Works Act, 1905,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the road described in the Schedule hereto shall, on and after the date of this Order in Council, be a county road.

SCHEDULE.
THAT portion of road in the Taranaki Land District, Clifton County, known as Hutiwai Road, commencing from the eastern end of that portion of road already handed over to the south-west corner of Section 7, Block I, Mimi Survey District, along the frontage of Section 31 of the said Block I, Mimi Survey District, being a distance of 34 chains or thereabouts; as the said road is more particularly delineated on the plan marked R. 701, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured red.

Validating the Voting-paper used at a Poll of the Rate-payers on a Proposal to raise a Loan of £3,000 to form and metal Roads in the Pukekohe East Road District, applied for by the Pukekohe East Road Board.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-fifth day of April, 1908.
Present:
THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.
WHEREAS the Pukekohe East Road Board lately proposed to raise a special loan of three thousand pounds for the purpose of forming and metalling roads: And whereas the security for such a loan is a rate of one farthing in the pound, recurring annually for a period of forty-one years, upon all the rateable property included in the Pukekohe East Road District, and the date of the poll was duly notified in the Star and Herald newspapers of Auckland, circulating in the Pukekohe East Road District, on the nineteenth and twentieth days of September, one thousand nine hundred and seven, being sixteen days prior to the said poll: And whereas the form of voting-paper used at the poll was not in the form set forth in the Schedule to “The Local Bodies’ Loans Amendment Act, 1903”: And whereas the special order making the special rate was passed before the poll of the ratepayers instead of after, but a special order making the required rate was subsequently
passed—namely, on the fourth day of January, one thousand nine hundred and eight, and confirmed on the first day of January, one thousand nine hundred and eight: And whereas it appears that the ratepayers have not been misled, and it is expedient to validate such irregularities:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power conferred by section ten of “The Local Bodies’ Loans Amendment Act, 1902,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby validate the said voting-paper and the proceedings as taken above mentioned, and doth hereby declare that the said voting-paper and the proceedings in relation to the said loan and special order of the fourth day of January, one thousand nine hundred and eight, shall be and be deemed to have been as good, valid, and effectual as though the said voting-paper and proceedings had been in proper form and duly and regularly taken respectively.

Validating the Public Notification of the Special Order in connection with a Loan of £3,015 applied for by the Sluggish River Drainage Board.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-fifth day of April, 1908.
Present:
THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.
WHEREAS the Sluggish River Drainage Board lately proposed to raise a loan of three thousand and fifteen pounds, under “The Local Bodies’ Loans Act, 1901,” for the purpose of efficiently repairing and maintaining a drain known as the main drain, extending from the Oroua River to the north-eastern boundary of the Board’s district: And whereas the public notification of the special order making the special rate duly published in the Manawatu Evening Standard once a week for four successive weeks made reference to Sections 82 and 83 as being rated both as second- and third-class lands, owing to the word “part” being omitted in both instances when such word “part” should have appeared before Sections 82 and 83 under both classes: And whereas it appears that the ratepayers have not been misled by such irregularity, and it is expedient to validate the said notification:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power conferred by section ten of “The Local Bodies’ Loans Amendment Act, 1902,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that such public notification of the special order shall be deemed and taken to be as valid and effectual as though the said notification had been properly published, and that the proceedings relative to the said loan shall not be called in question by reason only of the irregularity aforesaid.

Altering the Boundaries of the Land Districts of Otago and Southland.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-fifth day of April, 1908.
Present:
THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.
WHEREAS by the twenty-second section of “The Land Act, 1892,” certain land districts are defined, but it is provided that the Governor, by Order in Council, if he shall deem it necessary, may from time to time alter the boundaries of any land district as he shall think fit:

And whereas it is desirable to alter the boundaries of the Otago and Southland Land Districts:

Now, therefore, I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon me by the hereinbefore-in-part-recited Act, and by and with the advice and consent of the Executive Council of the said
