further enacted that the Governor in Council may, subject
to certain exceptions, exempt from the payment of such
duty the owner or occupier of any such warehouse: And
whereas application has been made for a license for a
warehouse situate on Allotment No. 4, Section No. 1,
in the Town of Tauranga, of which Guinness Brothers
are the owners or occupiers, and it is expedient that the
owners or occupiers of the said warehouse should be exempt
from payment of the annual duty aforesaid:
Now, therefore, in exercise and pursuance of the said
power and authority, and with the advice and consent of
the Executive Council of New Zealand, I, William Lee,
Baron Plunket, the Governor of the Dominion of New
Zealand, do hereby order that the occupiers and owners of
the said warehouse shall be exempt from payment of the
annual duty chargeable thereon under the Act hereinbefore
recited.

Appointing Members of Assessment Courts under “The Government Valuation of Land Act Amendment Act, 1906.”

IN pursuance and exercise of the power and authority
vested in him by “The Government Valuation of Land
Act Amendment Act, 1906,” His Excellency the Governor of
the Dominion of New Zealand, acting by and with the
advice and consent of the Executive Council of the said
Dominion, doth hereby appoint the persons named in the
Schedule hereto to be members of the Assessment Court for
the special districts set opposite the name of each respectively.

Appointment of Members of the Taieri Drainage Board.

IN pursuance and exercise of the power and authority
conferred by the Taieri Land Drainage Act, 1907, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

The Commissioner of Crown Lands for the Land District of Otago;
The District Railway Engineer, Dunedin; and
The District Engineer, Public Works Department, Dunedin,

to be members of the Taieri Drainage Board having, subject to the said Act, control of the Taieri Drainage District.

Exempting Buckley Street, Vogeltown, City of Wellington, from the Provisions of Section 117 of “The Public Works Act, 1905,” subject to certain Conditions as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-fifth day of April, 1908.

Present:

PRESIDING IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of “The Public Works Act, 1905,” it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:
And whereas by section three of “The Public Works Act Amendment Act, 1906,” it is provided that such approval may be either absolute or subject to such conditions as the Governor by Order in Council thinks fit to impose:
And whereas on the sixth day of June, one thousand nine hundred and seven, the Wellington City Council, the local authority having control of Buckley Street, Vogeltown, City of Wellington, described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said street:
And whereas it is deemed expedient that such resolution should be approved, subject to the condition hereinafter mentioned:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution, subject to the condition that no building or part of a building shall at any time be erected on either side of the said street within a distance of thirty-three feet from the centre-line of the said street.


SCHEDULE.

That street in the City of Wellington known as Buckley Street, Vogeltown, commencing at its junction with Krull Street, and proceeding generally in a northerly direction to its junction with the boundary of Brooklyn, for a distance of about 17 chains, more or less; as the said street is more particularly delineated on the plan marked R. 9757, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured pink.

Consenting to closing Road in Mangawai Road District.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-fifth day of April, 1908.

Present:

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G.,
PRESIDING IN COUNCIL.

WHEREAS by section one hundred and thirty-three, (a), of “The Public Works Act, 1905,” it is enacted that a local authority shall not declare any county or district road to be stopped, and such road shall not be deemed to be stopped, until the consent thereto of the Governor by Order in Council gazetted is obtained:
And whereas the Mangawai Road Board has applied for such consent in respect to the road described in the Schedule hereto:
Now, therefore, in pursuance and in exercise of the above-in-part-recited Act, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the Mangawai Road Board closing the road mentioned in the Schedule hereto.
