Exempting Wellington Terrace, City of Wellington, from the Provisions of Section 117 of “The Public Works Act, 1905,” subject to certain Conditions as to the Building-line.

ORDER IN COUNCIL.

At the Government House, at Wellington, this ninth day of November, 1907.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of “The Public Works Act, 1905,” it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:

And whereas by section three of “The Public Works Act Amendment Act, 1906,” it is provided that such approval may be either absolute or subject to such conditions as the Governor by Order in Council thinks fit to impose:

And whereas on the sixth day of June, one thousand nine hundred and seven, the Council of the City of Wellington, the local authority having control of the street known as Wellington Terrace, being the street described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said street:

And whereas it is deemed expedient that such resolution should be approved, subject to the condition hereinafter mentioned:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution, subject to the condition that no building or part of a building shall at any time be erected on either side of the said street within a distance of thirty-three feet from the centre-line of the said street.

SCHEDULE.

THAT street known as Wellington Terrace, in the City of Wellington, situated between Bowen Street and Mount Street, a distance of about 56 chains; as the said street is more particularly delineated on the plan marked R. 9301, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured pink.

Domain Board appointed to have Control of the Plumer Domain.

ORDER IN COUNCIL.

At the Government House, at Wellington, this ninth day of November, 1907.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section two of “The Domain Boards Act, 1904” (hereinafter termed “the said Act”), it is enacted that the Governor may from time to time, with respect to any public domain, appoint such persons (not exceeding nine) as he thinks fit to be a Domain Board having, subject to “The Public Domains Act, 1881,” control of such domain:

And whereas by an Order in Council made under the provisions of “The Public Reserves Act, 1881,” on the thirtieth day of September, one thousand nine hundred and seven, and published in the New Zealand Gazette of the third day of October, one thousand nine hundred and seven, the land described in the Schedule hereto was brought under the operation of and declared to be subject to the provisions of “The Public Domains Act, 1881”:

And whereas it appears expedient to appoint a Domain Board to control the said domain:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in exercise of the powers conferred by the said Act, and acting by and with the advice of the Executive Council of the said Dominion of New Zealand, doth hereby appoint

ROBERT CRANWELL,
THOMAS ROBERTS,
EDWARD HENRY HOLT, and
JOHN EDWARD WEST

to be the Plumer Domain Board, having the control of the land described in the said Schedule hereto for the purposes of and subject to the provisions of the said Act; and doth hereby appoint Saturday, the seventh day of December, one thousand nine hundred and seven, at half past seven o’clock p.m., as the time when, and the Reading-room, Henderson, as the place where, the first meeting of the Board shall be held.

SCHEDULE.

PLUMER DOMAIN.

ALL that area in the Auckland Land District, being Section No. 11, Plumer Hamlet, situated in the Parish of Waipareira (Block II, Titirangi Survey District), and containing by admeasurement 3 acres and 11 perches, more or less. Bounded towards the north-east by a public road 100 links wide, 516·2 links; towards the south-east by Section No. 12 of the said Plumer Hamlet, 870·6 links; towards the south-west by Lot No. 31 of Section No. 7, Parish of Waipareira, 143·3 links; and towards the west generally by a public road along the Opanuku Stream, 350·8, 199, 208, 233, and 32·3 links: be all the aforesaid linkages more or less: as the same is delineated on the plan marked S.G. 19248/46, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

Recreation Reserve in Auckland Land District brought under “The Public Domains Act, 1881.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this ninth day of November, 1907.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

BY virtue of the powers and authorities vested in me by the twenty-fourth section of “The Public Reserves Act, 1881,” I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the reserve for recreation in the Auckland Land District described in the Schedule hereto shall be and the same is hereby brought under the operation of and declared to be subject to the provisions of “The Public Domains Act, 1881”; and such reserve shall hereafter be known as Lichfield Domain, and be managed, administered, and dealt with in manner directed by the said Act.

SCHEDULE.

LICHFIELD DOMAIN.

ALL that area in the Auckland Land District, containing by admeasurement 10 acres 3 roods 8 perches, more or less, being Section No. 26, Block XV, Patetere North Survey District (Selwyn Settlement). Bounded towards the north-west by Lots Nos. 430, 431, 432, 433, 434, and 435, Town of Lichfield, 800 links; towards the north-east by a public road 100 links wide, 1350 links; towards the south-east by Section No. 27, Block XV, Patetere North Survey District, 800 links; and towards the south-west by a public road 100 links wide, 1350 links: be all the aforesaid linkages more or less: as the same is delineated on the plan marked S.G. 57305/2, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.
