Exempting London Street, in the Waitotara County, from
the Provisions of Section 117 of “The Public Works Act,
1905.”

PLUNKET, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this ninth day
of November, 1907.

Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by subsection one of section one hundred
and seventeen of “The Public Works Act, 1905,”
it is, inter alia, provided that the said section shall not
apply in any case where the local authority having control
of a road or street by resolution declares that the provisions
thereof shall not apply to any specified road or street, or
any specified part thereof, and such resolution is approved
by the Governor in Council:

And whereas by section three of “The Public Works
Act Amendment Act, 1906,” it is provided that such ap-
proval may be either absolute or subject to such conditions
as the Governor by Order in Council thinks fit to impose:

And whereas on the third day of October, one thousand
nine hundred and seven, the Council of the Waitotara
County Council, the local authority having control of the
street known as London Street, being the street described
in the Schedule hereto, did by resolution declare that the
provisions of the said section one hundred and seventeen
should not apply to the said street:

And whereas it is deemed expedient that such resolution
should be approved:

Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and exercise of the
powers conferred by the above-in-part-recited Acts, and
acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby approve of the
said resolution.

SCHEDULE.

ALL that portion of the street known as London Street, in
the Waitotara County, in the Wellington Land District,
situated between Russell Street and Kaikopu Road, being
a distance of about 25 chains; as the said street is more
particularly delineated on the plan marked R. 8657, deposited
in the office of the Chief Engineer of Roads, at Wellington,
in the Wellington Land District, and thereon coloured
sienna.

Exempting Mortimer Terrace, in the City of Wellington
from the Provisions of Section 117 of “The Public Works
Act, 1905,” subject to certain Conditions as to the Building-
line.

WHEREAS by subsection one of section one hundred

hereto, did by resolution declare that the provisions of the
said section one hundred and seventeen should not apply to
the said street:

And whereas it is deemed expedient that such resolution
should be approved, subject to the condition hereinafter
mentioned:

Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and in exercise of
the powers conferred by the above-in-part-recited Acts, and
acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby approve of the
said resolution, subject to the condition that no building or
part of a building shall at any time be erected on either side
of the said street within a distance of thirty-three feet from
the centre-line of the said street.

SCHEDULE.

THAT street known as Mortimer Terrace, in the City of
Wellington, situated between the Town Belt, Native Reserve,
and Epuni Street, a distance of about 28 chains; as the said
street is more particularly delineated on the plan marked
R. 5647B, deposited in the office of the Chief Engineer of
Roads, at Wellington, in the Wellington Land District, and
thereon coloured pink.

Exempting Poole, Parker, and Atkins Streets, in the Borough
of Motueka, from the Provisions of Section 117 of “The
Public Works Act, 1905,” subject to certain Conditions as
to the Building-line.

of November, 1907.

and seventeen should not apply to the said streets:

And whereas it is deemed expedient that such resolution
should be approved:

Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and in exercise
of the powers conferred by the above-in-part-recited Acts,
and acting by and with the advice and consent of the
Executive Council of the said Dominion, doth hereby approve
of the said resolution, subject to the condition that no build-
ing or part of a building shall at any time be erected on
either side of the said streets within a distance of thirty-
three feet from the centre-line of the said streets.

SCHEDULE.

THAT portion of street in the Borough of Motueka, known
as Poole Street, extending westward from its intersec-
tion with Atkins Street, in the said borough, to a point in
line with the western boundary of Subdivision 6 of Sec-
tion 185, a distance of 16 chains, more or less; also that
portion of street in the Borough of Motueka, known as
Parker Street, extending westward from its intersection
with Atkins Street to a public road, a distance of 12 chains,
more or less; also that portion of Atkins Street, in the
Borough of Motueka, extending northerly and southerly
between the said Poole and Parker Streets, a distance of
20 chains, more or less: as the said streets are more particu-
larly delineated on the plan marked R. 9036, deposited in the
office of the Chief Engineer of Roads, at Wellington, in the
Wellington Land District, and thereon coloured pink.
