Exempting Onehuka and Price’s Roads, in the Borough of Lower Hutt, from the Provisions of Section 117 of “The Public Works Act, 1905,” subject to certain Conditions as to the Building-line.

ORDER IN COUNCIL.
At the Government House, at Wellington, this sixteenth day of September, 1907.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by subsection one of section one hundred and seventeen of “The Public Works Act, 1905,” it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:
And whereas by section three of “The Public Works Act Amendment Act, 1906,” it is provided that such approval may be either absolute or subject to such conditions as the Governor by Order in Council thinks fit to impose:
And whereas on the eleventh day of February, one thousand nine hundred and seven, the Council of the Borough of Lower Hutt, the local authority having control of the streets known as Onehuka and Price’s Roads, being the streets described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said streets:
And whereas it is deemed expedient that such resolution should be approved, subject to the condition hereinafter mentioned:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby approve of the said resolution, subject to the condition that no building or part of a building shall at any time be erected on either side of the said streets within a distance of thirty-three feet from the centre of the said streets respectively.
SCHEDULE.
That street in the Borough of Lower Hutt known as Onehuka Road, starting from its junction with the Drainage Reserve, and proceeding generally northerly to its junction with Price’s Road, a distance of about 10½ chains; also that street known as Price’s Road, in the Borough of Lower Hutt, commencing at its junction with the Western Hutt Road, and proceeding northerly and westerly for a distance of about 30 chains to the boundary-line of Section 186, Hutt: as the said streets are more particularly delineated on the plan marked R. 8353, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, thereon coloured pink.

Validating Special Order made by Petone Borough Council.

ORDER IN COUNCIL.
At the Government House, at Wellington, this sixteenth day of September, 1907.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS the Petone Borough Council in or about the month of May, one thousand nine hundred and six, proposed to raise a loan of two thousand pounds for the purpose of completing and furnishing the Petone municipal shops and offices: And whereas an irregularity occurred in the proceedings to obtain such loan, inasmuch as it appears that the resolution of the said Council passed on the eleventh day of May, one thousand nine hundred and six, purporting to strike a special rate as security for the said loan and the interest, sinking fund, and other charges thereon, was not confirmed within the time fixed by section seventy-three of “The Municipal Corporations Act, 1900”: And whereas it appears that the ratepayers of the Borough of Petone have not been misled, and it is expedient to validate such irregularity:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred upon him by section four hundred and twenty-seven of “The Municipal Corporations Act, 1900,” and of every other power him thereunto enabling, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the resolution of the said Council passed on the twenty-fifth day of June, one thousand nine hundred and six, purporting to confirm as a special order the resolution of the said Council passed on the eleventh day of May, one thousand nine hundred and six, striking a special rate as security for the payment of the said loan and the interest, sinking fund, and other charges thereon, shall be valid and effectual in the same way as if the same had been passed within the time limited by the said Act for the passing of special orders, and that the proceedings relative to the aforesaid loan shall not be called in question by reason only of the said irregularity.

Time for Preparation of Roll under Gold Duty Abolition and Mining Property Rating Act extended, Waihemo County.

ORDER IN COUNCIL.
At the Government House, at Wellington, this sixteenth day of September, 1907.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS, the Council of the County of Waihemo having failed, through misadventure, to prepare the valuation roll of mining property in the Waihemo County in the month of January, one thousand nine hundred and seven, as required by section seven of “The Gold Duty Abolition and Mining Property Rating Act, 1890,” it is expedient to extend the time for preparing the said roll and for doing the other things set forth in the said section, as hereinafter mentioned:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in order that the purpose and intent of “The Gold Duty Abolition and Mining Property Rating Act, 1890,” may have effect, and in pursuance and exercise of the powers vested in him by “The Rating Act, 1894,” which said Act is incorporated with the first above-mentioned Act, and by and with the advice and consent of the Executive Council of the said colony, doth hereby extend the time for the preparation of the valuation roll for the Waihemo County, under “The Gold Duty Abolition and Mining Property Rating Act, 1890,” until the twentieth day of September, one thousand nine hundred and seven; and doth also hereby extend the time within which the valuer shall give notice of the rateable value determined by him to each occupier, so that such notices may be given on or before the first day of October, one thousand nine hundred and seven, and that objections to such valuations may be made on or before the sixteenth day of October, one thousand nine hundred and seven.
