  1. LAKE COUNTY, NEW ZEALAND.
    By-law No. 3.—Bicycles.

In pursuance of the powers, provisions, and authorities contained in “The Counties Act, 1886,” and “The Public Works Act, 1905,” and all or any amendments thereof respectively, and of all other enabling powers, provisions, and authorities contained in any other Acts or otherwise vested in it, the Council of Lake County doth hereby, by special order, make and ordain the following by-law for Lake County, that is to say:—

  1. In this by-law “bicycle” shall include tricycle; “road” means any road under the care, control, or management of the Lake County Council, or any road within the Lake County as to which the Lake County Council has by law authority to make this by-law, or as to which the same is capable of operating.

  2. Every person riding or being upon a bicycle on a road shall keep such bicycle on the left or near side of the road when meeting, and on the right or off side when overtaking, any vehicle, and in either case shall leave a reasonable portion of the road for such vehicle.

  3. Every person riding or being upon a bicycle on a road and meeting or overtaking any vehicle shall, whenever necessary or whenever requested by the person in charge of such vehicle by signal or otherwise so to do, assist such person in charge to pass such bicycle with such vehicle.

  4. Every person riding or being upon a bicycle on a road at any time after sunset and before sunrise shall carry, attached to the bicycle, a lamp, which shall be so constructed and placed as to exhibit a white light in the direction in which such person is proceeding, and so lighted and kept lighted as to afford adequate means of signalling the approach or position of the bicycle.

  5. Upon overtaking any vehicle being on or proceeding along a road every person riding or being upon a bicycle on such road shall, within a reasonable distance from and before passing such vehicle, by sounding a bell or whistle, or otherwise, give audible and sufficient warning of the approach of the bicycle.

  6. Any person who shall commit a breach of this by-law shall be liable to a penalty, in the discretion of the Court inflicting the same, not exceeding in any case the sum of £5.

  7. This by-law shall apply to the whole of Lake County, and shall come into force on the 26th day of July, 1906.

This by-law was duly made by special order by the Lake County Council, and the resolution making such by-law by special order was duly passed at a special meeting of the said Council held on Tuesday, the 1st day of May, 1906, and was confirmed at a special meeting of the said Council held on Wednesday, the 20th day of June, 1906.

The common seal of the Chairman, Councillors, and Inhabitants of Lake County was hereto affixed by authority of the Lake County Council at its meeting held this 20th day of June, 1906, in the presence of—

    By-law No. 4.—Bridges and Culverts.

In pursuance of the powers, provisions, and authorities contained in “The Counties Act, 1886,” and “The Public Works Act, 1905,” and all or any amendments thereof respectively, and of all other enabling powers, provisions, and authorities contained in any other Acts or otherwise vested in it, the Council of Lake County doth hereby, by special order, make and ordain the following by-law for Lake County, that is to say,—

  1. In this by-law “cattle” means any bull, cow, ox, steer, heifer, calf, ass, or mule.

  2. No person shall cross or drive, lead, or take any horse, cattle, or any engine, agricultural or other machine, or vehicle over any bridge or culvert within Lake County under the care, control, or management of the Lake County Council at other than a walking-pace.

  3. Any person who shall commit a breach of this by-law shall be liable to a penalty, in the discretion of the Court inflicting the same, not exceeding in any case the sum of £5.

  4. This by-law shall apply to the whole of Lake County, and shall come into force on the 26th day of July, 1906.

    By-law No. 5.—Tires on Wheels.

In pursuance of the powers, provisions, and authorities contained in “The Counties Act, 1886,” and “The Public Works Act, 1905,” and all or any amendments thereof respectively, and of all other enabling powers, provisions, and authorities contained in any other Acts or otherwise vested in it, the Council of Lake County doth hereby, by special order, make and ordain the following by-law for Lake County, that is to say:—

  1. In this by-law “road” means any road or portion of road under the care, control, or management of the Lake County Council, or any road or portion of road within the Lake County as to which the Lake County Council has by law authority to make this by-law or as to which the same is capable of operating; and “Inspector” means the person for the time being appointed by the Lake County Council as Inspector under this by-law.

  2. This by-law shall not apply to any vehicle licensed under By-law No. 6 of the Lake County, relating to traction-engines and vehicles drawn thereby, nor to any vehicle used exclusively for carrying passengers or other persons and their luggage or His Majesty’s mails, and the meaning of “vehicle” in this by-law shall be restricted accordingly.

  3. No person shall use any vehicle (whether plying for hire or not) in the carriage of goods or things on any road unless the tires of the wheels of such vehicle are of such width proportioned to the weight of its load, excluding the weight of the vehicle, as is prescribed by Part I of the Schedule hereto according as such vehicle has two or four wheels. The weight of the load on any such vehicle shall be ascertained by actual weighing at some public or other weighbridge, or by computing the weight in accordance with the table contained in Part II of the Schedule hereto.

  4. If the Inspector or any person authorised in this behalf by the Lake County Council is of opinion that any of the tires of the wheels of any vehicle used as aforesaid is or are not of the width required by this by-law, he may request the owner, driver, or other person in charge of such vehicle to stop the same, and may examine and measure the width of the tires of such wheels, and at his discretion either may cause such vehicle and the load then thereon to be weighed at a public or other weighbridge if there is one within a reasonable and convenient distance, or may measure and compute the weight of such vehicle, or the load then thereon, or both; and the owner, driver, or other person in charge of any such vehicle shall stop the same when required to do so under this by-law, and shall allow any examination, weighing, computation, or measurement lawfully required under this by-law to be had without hindrance or obstruction, and if he shall fail to stop such vehicle when required to do so under this by-law he shall be deemed to be guilty of an offence under this by-law; and, further, the Inspector may thereupon stop and detain such vehicle for a reasonable time until such examination, weighing, computation, or measurement can be made or done.

  5. Every person who shall commit a breach of this by-law, and every person who shall be guilty of an offence under this by-law, shall be liable to a penalty, in the discretion of the Court inflicting the same, not exceeding £5.

  6. This by-law shall apply to the whole of Lake County, and shall come into force on the 26th day of July, 1906,
