Vesting Control of the Fords over the Opawa and Wairau Rivers in the Omaka Road Board, and apportioning the Cost of Maintenance.

PLUNKET, Governor.

WHEREAS by section one hundred and nineteen of “The Public Works Act, 1905” (hereinafter termed “the said Act”), it is, inter alia, enacted that the Governor may, upon the terms and conditions in the said section mentioned, by Warrant under his hand publicly notified and gazetted, direct that any ferry or ford already established, or which may be hereafter established, over or across any river or arm of the sea respectively shall, from and after a date to be fixed in such Warrant, be under the exclusive care, control, and management of such local authority as shall be mentioned in that behalf in such Warrant; and may by such Warrant as aforesaid fix and determine whether all or any, and if so what, part of the cost, whether theretofore incurred or thereafter to be incurred, of managing and maintaining any such ferry or ford and the machinery and appliances used therewith is to be provided and paid by the local authority or local authorities, and, if so, by what local authority or authorities; and may by any such Warrant as aforesaid direct how, when, and to whom any such payment is to be made:

And whereas by the said Act it is further provided that the Governor may from time to time, with the view of determining whether it is expedient to vest the exclusive care and control, management, and maintenance of any such ferry or ford in any local authority, direct any person to be a Commissioner to inquire into and report to him upon any matter which he shall deem necessary to enable him to determine any such question as aforesaid; and may by any subsequent Warrant, publicly notified from time to time, vary or alter such care, control, and management:

And whereas a Commissioner was appointed under the provisions of section one hundred and nineteen of “The Public Works Act, 1905,” and an inquiry was duly held, with a view to determine what local authority could most conveniently and efficiently manage and maintain the ferries or fords over the Opawa and Wairau Rivers on the line of road between Blenheim and Havelock mentioned in the Schedule hereto, and hereinafter referred to as “the said fords,” and what proportion of the cost of managing and maintaining the said fords should be paid by any, and if so which, local authority or authorities: And whereas such Commissioner did report to the Governor, after due inquiry, his opinion as to the matters respecting which he was appointed to report:

And whereas it is expedient to make provision under the said Act for the purposes and in the manner hereinafter set forth:

Now, therefore, I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, in pursuance and in exercise of the power and authority vested in me by the above-in-part-recited Act, do hereby direct that the said fords shall, from and after the date of this Warrant, be under the exclusive care, control, and management of the Omaka Road Board. And I do hereby declare that the cost of maintaining the said fords shall be borne by the Pelorus, Omaka, and Wairau Road Boards, the Spring Creek Board, the Havelock Town Board, and the Blenheim Borough Council in the following proportions, namely,—

The Pelorus Road Board to bear thirty per centum,
The Omaka Road Board to bear sixteen per centum,
The Wairau Road Board to bear eighteen per centum,
The Spring Creek Board to bear sixteen per centum,
The Havelock Town Board to bear four per centum, and
The Blenheim Borough Council to bear sixteen per centum of the cost of maintaining the said fords.

And I do hereby direct that any contribution hereby required to be made as aforesaid by the Pelorus Road Board, the Wairau Road Board, the Spring Creek Board, the Havelock Town Board, and the Blenheim Borough Council shall be paid from time to time in the proportions hereinbefore prescribed out of the funds of the said Boards and Council respectively, within a period of thirty days after demand in writing made by or on behalf of the Omaka Road Board, and all such payments shall be made from time to time to the Clerk of the said Road Board for and on account of such Road Board.

SCHEDULE.

The ferries or fords over the Opawa and Wairau Rivers, in the Marlborough Land District, on the road-line between Blenheim and Havelock; as the sites of the same are more particularly delineated on a plan marked R. 8692, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured red.

Awanui River and its Tributaries, Auckland Land District, notified under “The Timber-floating Act, 1884.”

PLUNKET, Governor.

IN pursuance and exercise of the powers and authorities conferred upon me by the second section of “The Timber-floating Act, 1884,” I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, do hereby notify that the undermentioned river and its tributary streams and branches may be used under license for the purposes of the said Act.

SCHEDULE.

AUCKLAND LAND DISTRICT.

The Awanui River and its branches or tributary streams situated in Mangonui County.

As witness the hand of His Excellency the Governor, this twenty-ninth day of April, one thousand nine hundred and seven.

Setting apart Crown Lands as a State Coal-mine.

PLUNKET, Governor.

PURSUANT to the provisions of “The Coal-mines Act, 1905,” and in exercise of the powers thereby conferred, I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, do hereby notify and declare that the Crown lands described in the Schedule hereto are hereby set apart for the purposes of the said Act.

SCHEDULE.

ALL that area in the Nelson Land District, containing by admeasurement 884 acres, more or less, situated in Block XV, Mokihinui Survey District. Bounded towards the north-west by a right line from the south-western corner of the said Block XV to the western corner of Section No. 8 of the said Block XV; thence towards the north-east by the said Section No. 8 to the southern boundary-line of Mokihinui Survey District; and thence towards the south by the said southern boundary-line to the place of commencement.

As witness the hand of His Excellency the Governor, this twenty-ninth day of April, one thousand nine hundred and seven.
