Notification of Vacancy of Seat in the House of Representatives for Electoral District of Taranaki.

IN compliance with the provisions of subsection (1) of section 91 of “The Electoral Act, 1905,” I, the Speaker of the House of Representatives, hereby notify that

EDWARD METCALF SMITH, Esq.,

a member of the House of Representatives for the Electoral District of Taranaki, died on the nineteenth day of April, one thousand nine hundred and seven, during a recess of the House, and that the said seat is vacant by reason of such death.

Rules made by Insurance Companies under “The Fire Brigades Act, 1906,” approved.

THE following rules made by the insurance companies have been approved by His Excellency the Governor, and are published in accordance with “The Fire Brigades Act, 1906.”

WHEREAS by section 4 of “The Fire Brigades Act, 1906,” it is enacted that elections by fire-insurance companies carrying on business in New Zealand of members of Boards under the said Act shall be held under rules made by such insurance companies: Now, the fire-insurance companies carrying on business in New Zealand hereby make the following rules under the said Act:—

ELECTION OF REPRESENTATIVES FOR THE FIRE-INSURANCE COMPANIES.

  1. All terms used in these rules shall, unless the contrary intention appears, have the same meaning as in “The Fire Brigades Act, 1906” (herein called “the Act”).

  2. On or before the 30th day of April, 1907, and thereafter on or before the 1st day of April in every second or alternate year, or so often as any casual vacancy shall occur amongst the insurance companies’ representatives, the Minister shall notify in the Government Gazette, and by circular addressed to each insurance company, and to the Secretary of the Council of the Fire Underwriters’ Associations of New Zealand, that an election of representatives of insurance companies is required. The notice shall state the number of persons to be elected, the Fire Boards for which they are to be elected, and the date of the election.

  3. Such biennial election shall be held on the third Monday in May, and any other election shall be held on such day within one month after a vacancy occurs as shall be determined by the Minister and notified as aforesaid.

  4. Only those companies that are carrying on fire-insurance business within the district concerned shall be entitled to vote at any election of the insurance companies’ representatives for such district.

  5. Before any election every insurance company entitled to vote per clause 4 shall, by its controlling or public officer, notify to the Minister and to the Secretary of the Council of the Fire Underwriters’ Associations of New Zealand the name of its principal officer, representative, or agent in the district concerned authorised to vote on behalf of such company, and the Secretary of the said Council shall inform each of the secretaries of the respective Fire Underwriters’ Associations in Auckland, Wellington, Christchurch, and Dunedin, or so many of them as may be concerned, of the name or names of the person or persons qualified to vote.

  6. Nomination-papers for members of the Board shall be in the form annexed, and shall be signed by the candidate and by at least two authorised voters, as per clause 5; and such nomination-paper shall be lodged at the office of the Fire Underwriters’ Association having jurisdiction within the said fire district not less than seven days prior to the date of the election, addressed to the secretary of such association; and the secretary of such association for the time being shall be the Returning Officer for the purpose of holding and declaring the result of such election, with power to appoint, in writing, a deputy for that purpose should he be unable to preside thereat, such deputy to be nominated prior to the date of the election and approved by the insurance companies in the district concerned or by a majority of them. No person shall be qualified for election who has not been duly nominated in accordance with the foregoing provisions.

  7. Should the number of persons so nominated not exceed the number to be elected these persons shall be deemed to be duly elected, and the Returning Officer, or his deputy, shall transmit, in writing, the names of the persons so elected to the Secretary of the Council of the Fire Underwriters’ Associations of New Zealand, who shall thereupon report such election to the Minister, who shall notify the same in the Government Gazette.

  8. Should the number of persons so nominated exceed the number to be elected, the Returning Officer, or his deputy, by registered letter or circular addressed to each insurance company in the fire district concerned, shall forthwith notify the names of the persons so nominated and call a meeting of the persons qualified to vote on behalf of the said insurance companies, to be held on the day appointed for the election in accordance with clause 3 hereof.

  9. The said meeting shall be held at 10 a.m. on the day aforesaid at the office of the Fire Underwriters’ Association concerned, when a poll shall be taken. Voting shall be by ballot, and the ballot shall be closed by the Returning Officer, or his deputy, at 1 p.m. on the same day.

The said meeting shall appoint a Chairman, and such Chairman’s power of voting shall remain unaffected by his appointment.

The meeting may appoint three scrutineers for the purposes of the poll and the counting of votes.

In the case of an equality of votes at any election the election shall be decided by lot in such manner as the Chairman shall determine.

  1. The Returning Officer, or his deputy, shall transmit in writing the result of the election for the said district to the Secretary of the Council of the Fire Underwriters’ Associations of New Zealand, who shall thereupon report the result to the Minister, who shall by notice in the Government Gazette declare the candidate or candidates so elected to be the representative member or members on the Board for the fire-insurance companies.

  2. A list of all insurance companies carrying on business within New Zealand and qualified to vote in the several fire districts shall be published by the Minister in the Government Gazette at least once in every year.

Any insurance company carrying on business in the colony and omitted from such list may have its name inserted therein by applying to the Minister.

Such list, with the name of any insurance company so added, shall be taken to be the roll of insurance companies
