Declaring Additional Infectious Diseases under "The Dairy Industry Act, 1898."β€”Notice No. 1078.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-sixth day of November, 1906.
Present:
His Excellency The Governor in Council.

IN pursuance and exercise of the powers and authorities conferred on him by "The Dairy Industry Act, 1898," His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby declare that rodent ulcer, malignant diseases, and venereal diseases are infectious diseases within the meaning of the said Act.

Constituting the Gisborne Judicial District, and altering the Boundaries of the Northern Judicial District.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-sixth day of November, 1906.
Present:
His EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section twenty of "The Supreme Court Act, 1882" (hereinafter termed "the said Act"), it is enacted that the Governor in Council may from time to time, for the purposes of the said Act, divide the colony into districts, and alter the limits of such districts from time to time as occasion may require:
And whereas by an Order in Council bearing date the first day of January, one thousand eight hundred and eighty-three, and made under the provisions of the said Act, the colony was divided into districts, and the limits of such districts therein defined: And whereas by Orders in Council dated the sixteenth day of December, one thousand eight hundred and eighty-nine, and the third day of February, one thousand eight hundred and ninety-one, the limits of the Northern District so defined were altered and redefined: And whereas it is expedient to define a district to be called the Gisborne District, and to alter and redefine the limits of the Northern District aforesaid:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred by the said Act, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby define the limits of the Gisborne District, and doth hereby alter the limits of the Northern District so altered and redefined as aforesaid; and doth hereby declare that, on and after the first day of January next, the limits of the said districts shall be those respectively set out in the Schedule hereto.

SCHEDULE.
NORTHERN DISTRICT.
All that portion of the Colony of New Zealand bounded towards the north-east generally by the ocean from Cape

gazetted, cause the same to be sold under the conditions set forth in the said Act : And whereas the land described in the Schedule hereto was acquired by the Ashley Road Board for drainage purposes, but is not required therefor, and it is desirable to sell the same, subject to the certain conditions hereinafter mentioned :
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance of the powers and authority conferred upon him by the said Act, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby direct the sale of the land described in the Schedule hereto, subject to conditions as follows, viz. :β€”

  1. That there is reserved and granted to the Corporation of the inhabitants of the Ashley Road District and to the Road Board representing the same, as an easement, the full and free right at all times to allow water to flow and overflow on to and over the said land from any drain, water-course, or drainage-works for the time being and from time to time vested in the said Corporation or Board or under its control.
  2. That the purchaser, his executors, administrators, and assigns, shall not, nor will at any time hereafter, commence or prosecute any action, suit, claim, or demand whatsoever against the said Corporation or Board, or His Majesty the King, for damages, injunction, or mandamus, or otherwise, for or on account of or in connection with any water which may hereafter flow or be brought on to the said land in consequence or by reason of the flow or overflow from any drain, watercourse, or drainage-works in the Ashley Road District for the time being vested in or under the control of the said Corporation or Board, whether such flow or overflow is due to any misfeasance or nonfeasance on the part of the said Corporation or Board or not.

Directing Sale of Land under "The Public Works Act, 1905."

PLUNKET, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-sixth day of November, 1906.
Present:
His EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by the thirtieth section of "The Public Works Act, 1905" (hereinafter termed "the said Act"), it is enacted that if it is found that any land held, taken, purchased, or acquired at any time under this or any other Act or provincial Ordinance, or otherwise howsoever, for any public work is not required for such public work, the Governor may, by Order in Council publicly notified and gazetted, cause the same to be sold under the conditions set forth in the said Act:
And whereas a memorial has been laid before the Governor by the Otamatea County Council (hereinafter called "the said Council"), accompanied by a map, setting forth that certain land was acquired for a public work: And whereas the said land as described in the Schedule hereto is not now required by the said Council for the purpose of the said public work or otherwise, and the said Council desires to sell the same:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance of the powers and authority conferred upon him by the said Act, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby direct the sale of the land described in the Schedule hereto.
